By clicking on I AGREE, I (“Participant”) hereby grant to Zaamush, LLC, DBA Wine-ing in the City/ Have Fun Wine-ing with Grae (together with all of its respective affiliates, successors, and assigns, “Sponsor”) that wine, liquor or other alcoholic beverages may be served at the Wine-ing in the City/ Have Fun Wine-ing with Grae (the “Event”) and that any consumption of either wine, liquor or other alcoholic beverages by me shall be in my sole discretion and risk. I further acknowledge that Sponsor
has advised me that under no circumstances should I either drive or operate a motor vehicle if I am the slightest bit impaired or serve as a passenger in a motor vehicle in a situation where the driver of such motor vehicle is the slightest bit impaired. I understand and agree that Sponsor shall assume no responsibility or liability with respect to the serving or consumption of any wine, liquor or other alcoholic beverages at the Event. I further agree, on behalf of myself, my next of kin and my
family members and personal representatives, that I hereby waive, release, and agree to indemnify and hold harmless, each of Sponsor, Grae Verlin, the W New York Hotel, NY Vintners and each of their respective affiliates, subsidiaries, directors, officers, employees, agents, shareholders, members, successors and assigns (collectively the “Released Parties”) from any and all damages, losses, claims, loss of expenses (including reasonable attorney’s fees), lawsuits and causes of action (collectively,
“Claims”) suffered, incurred or brought against any of the Released Parties that arise from, or are a result of, my participation in the Event including, but in no way limited to Claims arising from or related to (a) my consumption of wine, beer or any alcoholic beverages served or available at the Event; (b) any injuries to my person or property; and/or (c) any injuries to the person or property of any third parties. I also hereby grant the right to make pictures, audio and/or visual recordings
of Participant’s voice, and all other aspects of Participant’s appearance (the “Recordings”) taken or recorded at all Wine-ing in the City/ Have Fun WIne-ing with Grae Events, for use in Sponsor’s promotional materials (the “Materials”). Participant agrees that Sponsor may record all of said Recordings on tape, film or otherwise and use said Recordings, including the use of Participant’s voice and likeness therein contained, in connection with the exhibition, advertising, promotion, exploitation,
and any other use of the Materials as Sponsor may desire throughout the universe in perpetuity in any and all media now known or hereafter devised. Sponsor may use the Recordings and Participant’s name, voice and likeness and other information concerning Participant in the Materials as Sponsor sees fit. Participant expressly acknowledges that Participant shall have no right of approval as to the use of the Recordings or Participant’s name, voice and likeness in the Materials and Sponsor shall have
no obligation to use the Recordings or Participant’s voice, likeness or name in the Materials and that Sponsor may delete or edit or change or rearrange all or any of the Recordings.
