In participating in the services offered at Effortless Movement Pilates, I agree that I do so at my own risk. In consideration of being permitted to use the facilities and equipment located at Effortless Movement Pilates, I understand that Effortless Movement Pilates and Christine Binnendyk shall not be liable for the loss or theft of, or damage to, the personal property of a guest or member. I assume full responsibility for any injuries or damages which may occur using studio facilities and equipment, and I hereby fully and forever release and discharge Effortless Movement Pilates and Christine Binnendyk from any and all claims, demands, damages, rights of action, or causes of actions, present or future, whether the same be known or unknown, anticipated or unanticipated, resulting or arising out of my use or intended use of the facilities and equipment, on or about the premises of Effortless Movement Pilates. I acknowledge that I am fully liable for all medical expenses as a result of any injury incurred during my participation in the services offered at Effortless Movement Pilates.
I warrant, represent, and agree that I am in good physical condition and have no disability, impairment, or ailment preventing me from engaging in active or passive exercise that will be detrimental to health, safety, comfort, or physical condition if I do so engage or participate. If my health condition changes, I acknowledge that it is my obligation to take full responsibility for my health, wellbeing, and safety during any type of exercise, and avoid any exercises I have been advised by my physician not to do. I understand that I am not obliged to participate in any activity that I do not wish to do, and that it is my right to refuse such participation at any time.
Consent
I understand and acknowledge that I have the right to consensual practice and that consent is a requirement of tactile feedback and physical touch for all services at Effortless Movement Pilates.
CORONAVIRUS / COVID-19 WARNING, DISCLAIMER, AND CLIENT WARRANT
I acknowledge the contagious nature of the Coronavirus/COVID-19 and that the CDC and many other public health authorities still recommend practicing social distancing.
I further acknowledge that Effortless Movement Pilates has put in place preventative measures to reduce the spread of the Coronavirus/COVID-19 in all studio locations, offsite venues, and other locations of operation, and it is a condition of entry to comply with Effortless Movement Pilates’ COVID-19 Health and Safety Plan.
I further acknowledge that Effortless Movement Pilates cannot guarantee that I will not become infected with the Coronavirus/COVID-19. I understand that the risk of becoming exposed to and/or infected by the Coronavirus/COVID-19 may result from the actions, omissions, or negligence of myself and others, including, but not limited to, staff, and other clients and their families.
I voluntarily seek services provided by Effortless Movement Pilates and acknowledge that I am increasing my risk to exposure to the Coronavirus/COVID-19. I acknowledge that I must comply with all set procedures to reduce the spread while attending my appointment.
I acknowledge and agree to uphold the condition of entry to immediately notify Effortless Movement Pilates and agree to not enter any studio locations, offsite venues, and other locations of operations if:
- I am not experiencing any symptoms of illness such as cough, shortness of breath or difficulty breathing, fever, chills, repeated shaking with chills, muscle pain, headache, sore throat, or loss of taste or smell.
- I have not traveled internationally within the last 14 days.
- I have not traveled to a highly impacted area within the United States of America in the last 14 days.
- I do not believe I have been exposed to someone with a suspected and/or confirmed case of the Coronavirus/COVID-19.
- I have not been diagnosed with Coronavirus/COVID-19 and not yet cleared as non contagious by state or local public health authorities.
- I am following all CDC recommended guidelines as much as possible and limiting my exposure to the Coronavirus/COVID-19
