This AIRCRAFT AGREEMENT (“Agreement”) is made onDate* between Blue River Aviation, LLC whose address is 720 E Yukon st. Palmer, AK, 99645
and (“Pilot”) First Name* Last Name* field.

1) Payment is due when services are rendered. Blue River accepts cash, checks, Visa, MasterCard, American Express, and Discover as payment for services rendered. All past due accounts will incur a finance charge in the amount of 8% of the balance due per month. All checks returned for “Insufficient Funds” will incur a service charge in the amount of $25.00 per check in addition to the cost of services rendered.*

2) Past Due Account. All invoices are Due Upon Receipt. Pilot’s account must be paid current to maintain flying privileges with Blue River. Any outstanding balances in which Blue River has not received payment within thirty (30) days are subject to an interest payment penalty on a monthly basis of eight (8) percent, accrued every thirty (30) days until paid in full. An account past due 90 days or more will result in collection action being taken. The Pilot is responsible for attorney fees, court fees, and all other costs arising from any collection action.*

3) Account Payment Methods. All customer accounts must have a valid method of payment, such as a credit or debit card, on file. Should the card on file become invalid, the customer must provide the Blue River office with an updated form of payment prior to any flight.*

4) Flight Cancellations: All student/renter flights cancelled less than 12 hours in advance are subject to a non-refundable $100 cancellation fee at the discretion of Blue River staff, charged to the card on file.*

5) Flight Reservations: Blue River enforces a minimum flight time fee for reservations over three hours. Aircraft rental will be charged at half of the reserved time or the hourly rate based off of the billing meter installed in the aircraft, whichever is greater. For example, if an aircraft is reserved for six hours and it was only flown for 2.0 hours, the total time billed will be 3.0 hours. The minimum flight time fee will be billed at the normal hourly rate of the aircraft.*

6) Rental Fees: Aircraft rental and instructor rates are as published on the Blue River website. These rates are subject to change based on market fluctuations and company operational costs.*

7) Account Payments: Blue River Aviation offers bonus credits, discounts and incentives forindividuals purchasing flight hours in advance by putting money on their Flight Schedule Pro account. Thesepurchases are considered final sale and will not be refunded. Leftover funds do not expire and may betransferred to another Blue River Aviation account holder upon written request. Should a student choose todiscontinue their flight training at any time, a written request and notice of withdrawal may be made no laterthan 30 days after their last flight to Blue River Management. Management reserves the right to consider theserequests at their sole discretion. Absolutely no refunds will be made after 6 months from date of purchase.*

8) Flight Packages: Blue River sells bundled packages of flight hours and instruction at discounted rates. Anyflight instruction or aircraft rental hours utilized in excess of those included in the package will be billed to thecustomer’s account at the standard rates. Conversely, leftover funds from these packages will be transferredto the pilot’s account balance and will incur the same refund policy as noted above for Account Payments.*

9) Merchandise & Pilot Gear: All purchases made in the flight school office are considered final sale, including but not limited to: t-shirts, sweatshirts, hats, logbooks, training materials, fuel sumps, etc. Only Blue River branded merchandise, purchased as a gift, and in new, un-used condition, may be exchanged in the office for a different size, pending availability.*

10) Administrative Cancellations. Blue River reserves the right to reschedule aircraft as necessary. If an aircraft is downed for administrative reasons and alternatives are not available, Blue River Staff will notify the student as soon as possible via the flight reservation system.*

11) Federal Aviation Regulations (FARs). It is the Pilot’s sole responsibility to comply with all Federal Aviation Regulations at all times.*

12) Handling of Aircraft. With respect to pre-flight inspections, it is the Pilot’s sole responsibility to comply with all FARs and the aircraft manufacturer’s guidelines and any other source regulating pre-flight procedures. Any damage, unsafe conditions, or missing documents found during preflight of the aircraft must be reported to Blue River immediately PRIOR TO FLIGHT. Pilot agrees not to accept the aircraft until Pilot is satisfied with the aircrafts condition and functioning of its equipment and accessories. With respect to post-flight inspections, it is the Pilot’s sole responsibility to comply with all FARs and the aircraft manufacturer’s guidelines and any other source regulating post-flight procedures. Any damage found, must be reported to Blue River immediately and prior to leaving Blue River premises. Any damage caused by the Pilot or during Pilot’s use of the aircraft, and not reported to Blue River may, at the discretion of Blue River result in termination of flying privileges with Blue River and collection action being taken against the Pilot for the cost of repairs.*

13) Aircraft Flight Time. The Pilot is responsible for checking the current HOBBS/TACH time, to the highest tenth, on the aircraft dispatch. HOBBS/TACH differences found prior to starting the aircraft must be immediately reported to Blue River Staff for adjustment. Unreported differences are the Pilot’s responsibility. The Pilot will record on the aircraft dispatch, to the highest tenth, the ending HOBBS/TACH time after shutting down the aircraft.*

14) Securing of Aircraft. It is the Pilot’s responsibility to secure the aircraft, after each flight, with all means provided by Blue River (tie-down ropes, gust locks, throttle locks, pitot tube cover and cowl plugs etc.).*

15) Cleanliness. It is the Pilot’s responsibility to leave the aircraft interior in a clean condition after each flight.*

16) Smoking and Tobacco Products in Aircraft. Smoking or use of any tobacco products in the aircraft is strictly PROHIBITED. The Pilot will be refused any further flying privileges for failure to comply with this rule. Smoking on the ramp, or near any aircraft and/or fueling equipment within a radius of 50 feet is strictly PROHIBITED.*

17) Use of Cell Phones: The use of cell phones in the airplane movement areas by any student is prohibited. Texting while acting as Pilot in Command of any flight is strictly prohibited.*

18) Flight Plan. Blue River recommends that prior to any flight beyond 50 nautical miles, the Pilot file a flight plan with FSS. Student pilots are REQUIRED to file flight plans prior to any flight of 50 nautical miles or more. (Blue River provides various flight planning forms)*

19) Weight & Balance. Blue River recommends that prior to all flights, the Pilot should calculate the weight & balance of the aircraft. Student pilots on solo flights are REQUIRED to perform an aircraft weight and balance (Blue River provides weight and balance forms)*

20) Fees at Other Airports. The Pilot is responsible for settling all landing, tie-down, handling, and/or any other fees incurred in route or at the Pilot’s flight destination at the time they are incurred. If not settled at that time, the Pilot will be charged a processing fee $25.00 for failure to comply with this rule.*

21) Off Airport Landings. Other than with prior permission, or while in training with a Blue River Certified Flight Instructor, the Pilot is NOT ALLOWED to conduct any “off-airport landings”.*

22) It is the Pilot’s sole responsibility to comply with all FARs concerning currency.*

23) Pilot License & Medical Certificate. Blue River requires the Pilot to maintain a copy of Pilot’s current Pilot License and Medical Certificate on file with Blue River. Blue River also requires a copy of the Pilot’s valid driver’s license for identification purposes. The TSA (Transportation and Security Administration) now requires proof of citizenship (Original Birth Certificate or Valid Passport ONLY) be PROVIDED PRIOR TO ANY TRAINING that might result in a Certificate and/or additional rating.*

24) Night Flights. It is the Pilot’s sole responsibility to comply with all FARs concerning night currency.*

25) Operations. The Pilot will only utilize aircraft in which Pilot has received a checkout and for which the Pilot’s records with Blue River indicate such checkout. Pilots are encouraged to inspect their Blue River records periodically. The Pilot will not conduct commercial operations including flight training in a Blue River aircraft. The Pilot will fly from the left seat ONLY, unless approved to fly right seat by a Blue River Certified Flight Instructor. The Pilot will not allow anyone else to fly the aircraft. As a Student Pilot, carrying of passengers is strictly PROHIBITED. Student Pilots in the solo phase of instruction must have a current sign off from their instructor and observe all weather and wind limitations in the sign off.*

26) Flight Instruction. Unless otherwise approved by Blue River, ONLY Blue River Flight Instructors are authorized to provide flightinstruction in Blue River aircraft.*

27) Flight Instruction Time. Determination of Instruction time given is the sole discretion of the Blue River Instructor. Instruction time begins at the scheduled time for the flight lesson unless prior arrangements are made with the instructor.*

28) Aircraft Malfunctions. If, during the course of a training flight, the aircraft suffers a malfunction, making it unsafe or un-airworthy for either continued flight or the planned operation (night, IFR, etc.), it will be the responsibility of Blue River to provide an aircraft or other means of transportation, and pilot to return the Pilot and/or passengers to the Palmer Airport. Blue River will not be responsible for incidental travel or other expenses incurred by the Pilot. The Pilot will be responsible for charges incurred prior to the malfunction.*

29) Adverse Weather. It is the Pilot’s responsibility to ensure that current and forecast weather conditions will allow the flight to be completed safely. If weather conditions prevent a safe return to the Palmer Airport, it is the Pilot’s responsibility to remain with the aircraft until it is safe to return. Blue River is not responsible for incidental travel expenses or other charges incurred by the Pilot. At the Pilot’s discretion, Blue River will assume responsibility for returning the aircraft. If this occurs, the Pilot will be liable for aircraft and pilot time incurred by Blue River in returning the aircraft to the Palmer Airport in addition to the rental charges for the aircraft.*

30) Off-site Fuel Purchases. Blue River aircraft rent “wet”. Fuel purchased off site will be reimbursed at current cost of fuel at Palmer Airport. Call the Blue River Office at 907-414-0371 to get the current reimbursement rate.*

31) Maintenance: Any maintenance related items that could interfere with the safety of a flight, and squawks found, must be immediately reported to Blue River Staff. Any maintenance related action required away from home base requires prior authorization from Blue River management.*

32) Emergencies: Pilot agrees to report all accidents, both major and minor immediately along with any names and addresses of witnesses and involved parties in accordance with the Blue River Emergency Response Manual. Pilot will not allow the aircraft to be moved unless expressly authorized to do so by Blue River or authorities. Pilot will do all that is possible to protect the aircraft from further loss or damage. In the event of an emergency, the Pilot should immediately contact local authorities, and Blue River, in accordance with NTSB requirements.*

33) US Citizenship Verification: All Pilot's pursuing a certificate or rating at Blue River must provide proof of US Citizenship with either the official copy of their birth certificate or a valid passport, regardless if they already have a TSA citizenship endorsement from previous training. If the Pilot is not a US Citizen, they must comply with the Flight Training Security Program. If documentation is not provided, Blue River will not provide flight training to the Pilot.*

34) Standard Operating Procedures: Pilot has been provided the most recent Blue River Aviation Standard Operating Procedures and agrees to comply with all written instructions, including but not limited to, Approved Airports, Weather Minimums, Hangar/Ramp Procedures.*

35) Authority to Dispatch Flights: All Blue River staff have the right to withhold dispatch if they have reason to believe that the flight will be in violation of Blue River's procedures and/or will interfere with the safety standards at Blue River. If the customer does not believe that the flight will interfere with safety, they must seek authorization from the Chief Flight Instructor for the aircraft to be released.*

36) Unless otherwise authorized, all flights will operate in accordance to the Blue River Aviation Standard Operating Procedures.*

37) Entire Agreement: This agreement supersedes any prior negotiations and agreements between the parties regarding the same issues addressed herein, and constitutes the entire agreement of the parties. Blue River Aviation. Palmer, Alaska.www.blueriveraviation.com. 907.414.0371*

38) Renter agrees to pay BLUE RIVER AVIATION for aircraft recovery charges, any damage or loss to a rental aircraft, including but not limited to loss of use, due to Renters negligence or misuse or any other cause occurring during the period the aircraft is in the possession and care of the Renter. If the Renter has rental aircraft insurance, BLUE RIVER AVIATION will collect any sums due directly from the insurance carrier.*

39) Amendment: This Agreement may be amended by Blue River as required.*

40) Certification: Pilot certifies that all information supplied to Blue River is true and correct.*

I hereby affirm that I am aware that flying and activities associated with flying have inherent and unforeseeable risk which may result in serious injury or death. I understand and agree that neither my instructors nor Blue River Aviation LLC, nor any of their respective employees, officers, agents, contractors, or assigns, (hereafter referred to as “Released Parties”) may be held liable or responsible in any way for any injury, death, or other damages to me, my family, estate, heirs or assigns that may occur as a result of my participation in flying aircraft, flying in aircraft, flight instruction, aircraft rental, aircraft operations, ramp operations, or any associated activities involved with these activities, (hereafter referred to as “Flight Activities”), or as a result of the negligence of any party, including Releases Parties, weather passive or active. In consideration of being allowed to participate in Flight Activities, I hereby personally assume all risks of Flight Activities, weather foreseen or unforeseen, that may befall me while I am participating in these activities. I further release, exempt, and hold harmless the Released Partied from any claim or lawsuit by me, my family, estate, heirs, or assigns, arising out of my participation in Flight Activities including both claims arising during any course of training or after I receive my pilot certification(s). I also understand the Flight Activities are physically demanding and that I must seek the ongoing care of a licensed and authorized aviation medical examiner and that I will not hold Released Parties responsible for events resulting from my physical condition, limitations, or incapacitation. I further state that I am of lawful age and legally competent to sign this liability release or that I have acquired the written consent of my parent or guardian. I understand the terms herein are contractual and not merely recital, and that I have signed this document of my own free act with the knowledge that I hereby waive my legal rights. I further agree if any provision of this Agreement is found to be unenforceable or invalid. That provision may be severed from this agreement; however, the remainder of this agreement shall then be constructed as though the unenforceable provision had never been contained therein. I, BY THIS INSTRUMENT AGREE TO EXEMPT AND RELEASE MY INSTRUCTORS,BLUE RIVER AVIATION LLC AND ALL RELATED ENTITIES AS DEFINED ABOVE FROM ALL LIABILITY OR REPONSIBILITY WHATSOEVER FOR PERSONAL INJURY, PROPERTY DAMAGE OR WRONGFUL DEATH HOWEVER CAUSED, INCLUDING, BUT NOT LIMITED TO , THE NEGLIGENCE OF THE RELEASED PARTIES, WHETHER PASSIVE OR ACTIVE. I HAVE FULLY INFORMED MYSELF OF THE CONTENTS OF THIS LIABILITY RELEASE AND ASSUMPTION OF RISK AGREEMENT BY READING IT BEFORE I SIGNED IT ON BEHALF OF MYSELF AND MY HEIRS*
