Cancellation terms and conditions:
Dragonfly reserves the right to accept or reject any refund/credit applications if supporting documents are not provided or advance notice is not given as stated below. Refunds are based on the number of day(s) missed/cancelled. Any alternative arrangements arising from cancellations are at the discretion of Dragonfly. Refunds will only be given under the following circumstances:
Cancellations due to medical reasons (including Covid)
Dragonfly will charge an administrative fee equivalent to 30% of the program fee (non-discounted price) and refund the remaining if participants inform Dragonfly by WhatsApp before 7.00am on the program day(s) and submit a signed doctor’s sick note stating the reason they are unable to participate and date(s) to be missed within 5 days.
If a participant is a close contact of someone who has Covid, they are required to notify us and take an at-home RAT every morning of the program. They will be allowed to continue participation if they test negative, however if they test positive they will not be allowed to continue participation and the above medical cancellation terms will be applied.
Cancellations due to adverse weather
If Tropical Cyclone Warning Signal No. 3 or above, or Red Rainstorm Warning Signal or above, is issued by the Hong Kong Observatory before the start of the day, the program day is cancelled. Should these Warning Signals not be raised, however Dragonfly deems the weather to be unsuitable for the originally scheduled activities, we may decide to change to another activity, or move to a sheltered area, or cancel the program day, depending on the severity of the conditions.
If Dragonfly announces the cancellation of a program day for the above weather reasons, then parents can choose to accept a refund or course credit to be used for future Dragonfly camps. Refund: 30% of the non-discounted camp fee, pro-rata, will be retained to cover administrative costs and the remaining refunded. Course credit: The amount paid, pro-rata, will be offered as credit to be used on any Dragonfly camp within the next 12 months.
Other terms and conditions:
Program alteration
Dragonfly reserves the right to amend the program or actvities as needed should a program require alteration for reasons regarding safety, unforeseeable or unexpected conditions that affect a location or activity, or significant changes to expected participant numbers.
Replacement of participant
Due to operational needs, a participant who has completed registration cannot substitute anyone for himself/herself to attend a program.
Grouping of participant
Dragonfly cannot guarantee that it can accommodate individual requests for group re-arrangements. Dragonfly reserves the right to separate siblings or friends into different activity groups as it sees fit.
Safety equipment
Participants are required to wear and use activity specific sport and safety equipment. Participants should not remove these without the permission of the instructor. Equipment should not be misused in a manner that intentionally or accidentally harms someone else. Dragonfly reserves the right to expel participants who violate rules of safety from a program, and offenders may be liable for damages.
Insurance
During activities, participants will be covered by Dragonfly Limited’s insurance policies.
Confidentiality
All personal information provided by participants during the registration process will be used for our operational purposes only. Any images or testimonials taken of or provided by participants during or after the course may be used for Dragonfly’s marketing purposes.
Declaration:
Medical authorization
I have completed the medical questionnaire and provided supporting information to the best of my ability and recognize that Dragonfly will rely upon this information for any treatment. I know of no medical reasons why I/my child should not participate. If there are any changes to my/my child’s medical status, it is my responsibility to notify Dragonfly. In the event of an emergency or need for medication, Dragonfly will attempt to contact the parent/guardian to inform them of the situation at the earliest possible opportunity. I hereby authorize any medical treatment deemed necessary in the event of injury while participating in the activity. I authorize Dragonfly’s first aid trained staff to administer non-prescription anti-histamines (moderate allergic reactions), analgesics (pain) and antipyretics (fever). I agree to hold Dragonfly harmless for any and all costs or liabilities so incurred.
Assumption of risk and responsibility
I am aware that participation in the activities involves exposure to risks, dangers and hazards with the possibility of personal injury, death, property damage or loss. In recognition of the various risks relating to the activities engaged in, both foreseeable and unforeseeable, I confirm that I/my child is physically and mentally capable of participating in all activities and/or using equipment. My child’s/ my participation is voluntary and I will assume all risks and full responsibility, on behalf of all parties including myself, my child, and my child’s heirs and assigns, for (a) any and all losses incurred as a direct or indirect result of personal injury, accidents, or illness, and (b) any and all damage to or loss of personal property arising out of, relating to, or in connection with any activity.
Waiver and indemnity
In consideration for the opportunity of myself, my son or daughter to voluntarily participate in Dragonfly activities:
- I hereby to the fullest extent lawfully permitted waive and release and indemnify Dragonfly and their employees, agents and volunteers of any and all claims however arising whether in contract or for personal injury, property damage, and any losses whatsoever that may arise as a result of my/child’s participation.
- I hereby certify that I am a competent adult assuming these risks of my own free will being under no compulsion or duress and having had opportunity to take independent legal advice.
For participants aged below 18, Dragonfly requires signature by his/her custodian before any actions are taken.
