TERMS & CONDITIONS
1. Accuracy: All information you provide in this application, your CV, and any supporting documents must be accurate, complete, and truthful. A material misrepresentation or omission is a ground for disqualification, withdrawal of an offer, or termination in accordance with company policy and applicable law if discovered after hiring.
2. Privacy and use of your information: JCV & Associates Project Management and Development Inc (JCVA) collects the information in this form for one purpose: to assess your suitability for employment. We collect your identity and contact details, work experience, licensure, declarations, references, and your expected salary if you choose to state it; your current compensation and payslip are collected only with your separate consent. We do not collect your age, birthdate, religion, civil status, health information, or government ID numbers at application stage; information of that kind that is required by law is collected at onboarding if you are hired, under a separate consent. The legal bases are those under the Data Privacy Act of 2012 (RA 10173): steps prior to entering a contract for application data, and your specific consent for compensation data, references, and post-offer checks.
3. Who sees your application: Your application is seen by the People & Culture Unit, the hiring manager, and the approving officers for the role. Compensation information you consent to provide is restricted to the People & Culture Unit and offer approvers and is not shown to interviewers.
4. References and verification: With your consent, JCVA will contact the references you name and verify your employment history and licensure. If you reach offer stage and have consented, JCVA will request your latest payslip to verify your disclosed compensation. Background checks (NBI or police clearance) and a pre-employment medical examination, including a drug test where the role is covered by RA 9165, are requested only after a conditional offer. If hired, statutory onboarding documents, including your government ID numbers and BIR Form 2316 from your previous employer for tax consolidation, are collected at onboarding under a legal obligation and a separate employment-stage notice.
5. Retention: If you are hired, your application becomes part of your employment record. If you are not hired, we keep your application for twelve (12) months from submission so we may consider you for other roles (if you consented to the talent pool), then delete it securely. You may request earlier deletion at any time.
6. Your rights: You may access, correct, or ask for deletion of your data, object to processing, and withdraw any consent at any time by writing to the Data Protection Officer at hr@jcvassociates.ph. Withdrawing a required consent means we can no longer process your application. You may also complain to the National Privacy Commission. Nothing in these terms waives or limits any right you hold under the Data Privacy Act.
7. Equal opportunity: JCVA is an equal opportunity employer. Hiring decisions are based on qualifications, demonstrated competence, and fit to the role's requirements, without regard to race, color, religion, sex, sexual orientation, gender identity, national origin, age, disability, civil status, or any other status protected by law.
8. Communication: JCVA will contact you about this application using the contact details you provide. Keep them current; we are not responsible for missed communications sent to the details on file.
9. No guarantee of employment: Submitting an application does not create an employment relationship or guarantee an interview or offer. Any employment will be governed by a separate employment contract.
10. Confidentiality: Information you receive about JCVA, its clients, or its projects during the application process is confidential.
11. Changes: JCVA may update these terms. Material changes apply to applications submitted after the change is posted; they do not retroactively expand what we may do with data you have already submitted without fresh consent.
