Pets Western Service Agreement Terms and Conditions
For the purpose of this Agreement, Pets Western’s representatives, employees, independent contractors, and owners will be referred to as “Pets Western” or will be identified by name. Pet owners who are customers of Pets Western’s services will be referred to as “Client.”
1. Client agrees and understands that Pets Western, Ryan Stroup, or Simon Stroup, are authorized to seek and obtain medical services for Client’s pet(s) at the closest Veterinarian or Veterinary Hospital and Client will reimburse Pets Western for any monetary expenditures incurred for aforementioned medical services.
2. Client agrees and understands that this Agreement gives Pets Western and its representatives authorization to enter the Client’s listed address as needed to perform agreed upon services.
3. Pets Western agrees to provide pet sitting, dog walking, daycare, visits, transportation, and other applicable pet care services in a reliable, caring, and trustworthy manner. In consideration of the services and as a condition thereof, the client expressly waives and releases Pets Western from any and all claims against the company, its owners, employees, independent contractors, and representatives, except those arising from negligence or willful misconduct on the part of Pets Western. Client shall hold harmless and indemnify Pets Western against any and all costs, expenses, losses, liabilities, and claims arising out of or relating to any acts of the Client's pet(s) except if arising out of the negligence or intentional misconduct on the part of Pets Western.
4. Client is responsible for supplying the necessary equipment and supplies needed for the care of their pet(s). These items include but are not limited to a collar or harness, leash, pet food, medications, litter boxes, cat litter, and cleaning supplies. Client authorizes any purchase of necessary products for the satisfactory performance of duties. Costs of any and all purchases and related service fees will be reimbursed to Pets Western within 15 days.
5. If Client cannot be contacted in the event of a malfunction of the lock, keys, or automatic door opener, Client authorizes Pets Western to hire a locksmith and agrees to promptly reimburse Pets Western for any and all costs incurred.
6. Client agrees to properly secure the home prior to leaving the premises.
7. Pets Western reserves the right to charge a cancellation fee of 100% of the agreed upon payment for services cancelled within less than 24 hours’ notice prior to the scheduled service.
8. Client authorizes Pets Western to use pet(s) names, pictures, video and audio recordings, and likeness on websites, social media, print, video, and other marketing materials for promotional purposes.
9. Client represents and warrants that pet(s) are currently vaccinated in accordance with all local, state and federal laws and regulations.
10. Client agrees and understands that Pets Western will continue its services until Client contacts Pets Western with confirmation of Client’s return.
11. Client agrees and understands that payment of any and all additional services not set forth in this service agreement are due upon Client’s return.
12. Client agrees and understands that Client must contact Pets Western immediately upon return or Client will incur additional charges not to exceed $50.00.
13. Client agrees and understands that Client will pay 100% of service charges upon completion of agreed upon services.
14. Payment for all subsequent services will be paid in full on first visit unless otherwise agreed upon.
15. Client accepts responsibility for all medical expenses and other damages resulting from any injury caused by the Client’s pet(s) to a Pets Western representative, employee, independent contractor, or owner, or other persons or animals.
16. Client agrees to indemnify, hold harmless, and defend Pets Western in the event of any claim by any persons injured or otherwise damaged by Client’s pet(s) or property.
17. Pets Western reserves the right to terminate this Agreement at any time if the Pets Western representative, employee, independent contractor, or owner in their sole discretion, determines that the Client’s pet(s) poses a danger to the health or safety of itself, other pets, other people, or Pets Western. If concerns prohibit Pets Western from caring for the pet, Pets Western will attempt to contact the Client to arrange alternative care. In the event that the Client is unable to be contacted, Client agrees to and understands that further care for Client’s pet(s) will be determined at the sole discretion of Pets Western.
18. Pets Western is not liable for any loss or damage in the event of a burglary or other crime that should occur while under this contract.
19. In the case of an emergency, inclement weather or a natural disaster, the Client authorizes Pets Western to use reasonable judgment for the care and well being of Client’s pet(s) and residence. Pets Western will make reasonable efforts to maintain service during these conditions but reserves the right to adjust the schedule of service based on the sole discretion of Pets Western.
20. Client agrees and understands that in the event of inclement weather or natural disaster, Pets Western will use their best discretion in caring for Clients pet(s) and premises but cannot be held responsible for said care and discretion.
21. Client agrees and understands that in the event of injury, illness, or personal emergency, Client will authorize Pets Western to arrange for another, equally qualified Pet Sitter to fulfill the responsibilities set forth in this contract.
22. Client agrees and understands that the Client is responsible for any injury caused by Client’s pet(s) or condition of Clients premises.
23. Client agrees Pets Western is not responsible for any damages beyond control of Pets Western.
24. Client understands Pets Western shall exercise all precautions against sickness, injury, escape, loss, accidents, or death of Client’s pet(s). Pets Western is not responsible for sickness, injury, escape, loss, accidents, or death of Client’s pet(s) unless caused through negligence or willful misconduct on the part of Pets Western.
25. Client understands and agrees to an additional holiday charge of $25.00. Holidays include New Years Eve, New Year's Day, Memorial Day, Independence Day, Labor Day, Thanksgiving, Christmas Eve, and Christmas Day.
26. Client agrees that dogs and cats must have an ID tag, rabies vaccination certificate, and city or county license.
27. Client understands and agrees that Pets Western charges at a daily rate. One day includes any portion of one day. If any stay extends beyond midnight the client will be charged for a full day.
28. If any provision of this Agreement is held to be invalid or unenforceable in whole or in part, the remaining provisions shall not be affected and shall continue to be valid and enforceable as though the unenforceable parts had not been included in this Agreement.
29. This Agreement may be terminated by the Client for any reason, with or without cause, by giving 10 days written notice of termination.
30. This Agreement may be terminated by Pets Western at any time and for any reason, with or without cause.
31. The terms and conditions of this Agreement shall be governed and construed in accordance with the laws of the State of Colorado, not including its conflicts of law provisions.
