  • Introduction

    The Australasian College for Emergency Medicine (ACEM; the College), through its various activities, creates and contributes to a wide range of policies, research, publications, seminars and documents. Thus, the College has a real interest in protecting and appropriately managing its intellectual property, whether that be through registered trademarks, copyright or otherwise. The College also has an obligation to ensure that all confidential information it holds is appropriately stored and managed.

    Before completing this agreement, please ensure you have read the Intellectual Property Policy (COR64) and Privacy Policy (COR200).

  • I acknowledge that:

    1. I have read and understood the College’s current Intellectual Property Policy (COR64) and Privacy Policy (COR200), and acknowledge that these are from time to time updated by the College.
    2. I may have access to or become aware of confidential information belonging to the College or its associated personnel during the course of my position/duties/role within the Australasian College for Emergency Medicine (ACEM), whether as a member of any College entity(ies), as the holder of any College office(s) or position(s), or otherwise.
    3. ‘Confidential Information’ includes:

    (a) personal information relating to the College, its members (as defined in the Constitution and associated regulations), FACEM Training Program trainees, non-specialist program candidates, specialist international medical graduates and staff; and

    (b) information relating to ACEM’s activities, functions, business, finances and records of whatsoever nature that are not specifically approved for publication, or anything derived from or pertaining to that information.

    It does not include information which is already in, or which subsequently falls into, the public domain (other than as a result of wrongful disclosure or a breach of confidentiality).

     

    I agree that:

    1. I will not reveal, disclose, amend, use or reproduce any confidential information or provide it to any other party, except in the proper course of my position/duties/role or as required by law, and only after the confidential nature of that information has been sufficiently imparted to the recipient.
    2. I shall immediately notify the College upon becoming aware of any suspected or actual breach of confidentiality, or where disclosure may be required by law.
    3. Upon the conclusion of a position/duties/role within ACEM, I shall destroy or return to the College all confidential information and any materials in which confidential information may be contained.
    4. The ownership of all intellectual property rights (including copyright and those rights in the confidential information) in all existing materials, and those materials created for, arising from or derived from ACEM (including materials which I have created in my College role) are immediately assigned to and vest in the College, and that I shall execute all required documentation to give effect to this assignment.
    5. I will provide the services and support in connection with ACEM in a professional and timely manner, and will comply with all reasonable requirements or directions of the College outlined in the Constitution, and all applicable College regulations, Charters, policies, Terms of Reference and other documents pertaining to the relevant position/duties/role.
