Rental Agreement - Bevans Legacy Auto Co.

This Vehicle Rental Agreement ("Agreement") is entered into between Bevans Legacy Auto Co LLC, hereinafter referred to as the "Owner" or "Company," and the individual or entity listed below, hereinafter referred to as the "Renter."

 

Liability Disclaimer

ALL VEHICLES ARE DEEMED SAFE, LEGALLY OPERABLE, AND MAINTAINED PRIOR TO DELIVERY.

Renter Responsibility for Vehicle Operation and Damages

The Renter acknowledges full responsibility for the operation of the vehicle during the rental period. The Owner shall not be held liable for any bodily injury, property damage, or loss arising from the Renter's operation of the vehicle, except as required by law. The Renter agrees to indemnify and hold harmless the Owner against any claims, liabilities, or expenses resulting from the use or misuse of the vehicle.

AS-IS CONDITION & RENTER RESPONSIBILITY

The vehicle is delivered to the Renter in safe, operable condition.
After delivery, the Renter is responsible for all minor maintenance and wear-and-tear issues, including but not limited to:
• tire pressure or flat tires
• bulbs, fuses, wipers
• battery issues
• fluids and oil levels (for rentals exceeding 14 days)
• cosmetic issues

Renter acknowledges that the Company is not responsible for minor maintenance, inconvenience costs, or small mechanical issues that occur during the rental period unless caused by a pre-existing condition known to the Company.

Damage from Negligence Clause

The Renter is responsible for all damage caused by misuse, neglect, failure to maintain fluid levels, failure to report warning lights, or continued operation of the vehicle after a mechanical issue arises.

Renter Maintenance Responsibility

If renting longer than 30 days, all repairs, maintenance, and mechanical issues—whether minor or major—are the financial responsibility of the Renter unless directly caused by Company negligence prior to rental.

Insurance Requirement 

Insurance Disclosure Notice:

The State of Tennessee requires that we inform you:

• Your personal automobile insurance policy may provide coverage while operating a rental vehicle, but not all policies do. You should contact your insurance provider to verify liability and comprehensive and collision coverage during the rental period.
• Bevans Legacy Auto Co requires that all renters carry insurance coverage that includes a collision damage waiver and liability protection. This can be purchased from Bonzah or another approved provider prior to rental.
• Bevans Legacy Auto Co is not an insurance company and is not responsible for claims or disputes involving third-party coverage, including Bonzah.

Failure to provide proof of required coverage will result in cancellation or delay of your rental without refund.

Insurance Requirement Clause

Mandatory Insurance Coverage

As a condition of renting or operating any vehicle from Bevans Legacy Auto Co, the Renter is required to purchase and maintain active insurance coverage through Bonzah, which includes a Collision Damage Waiver (CDW) and liability protection for the duration of the rental period.

The Renter agrees to:

• Purchase Bonzah coverage at the time of booking or prior to vehicle pickup
• Provide proof of purchase (policy number and confirmation) before the rental period begins

Acknowledge that failure to maintain this coverage or provide proof of such will result in cancellation of the reservation or refusal of vehicle delivery without refund.

Understand that Bevans Legacy Auto Co is not liable for damages, losses, or liability that occur if the Renter fails to activate or maintain proper coverage through Bonzah or another approved provider.

Insurance Coverage Acknowledgment

The Renter acknowledges that vehicle rental does not include insurance coverage by default. Renter has the option to purchase supplemental rental insurance coverage through Bonzah, a third-party provider. It is the responsibility of the Renter to review, understand, and accept the terms provided by Bonzah before purchase.

Waiver of Liability

If Renter chooses to purchase insurance coverage through Bonzah or any third-party insurance provider, Renter agrees to hold Bevans Legacy Auto Co. LLC harmless from any disputes, delays, or claim denials that may arise from the third-party insurance provider. It is the Renter's responsibility to understand what is and is not covered under said policy.

Fuel Policy:
Vehicle must be returned with the same fuel level it was received at. A $50 refueling fee will apply otherwise.

Mileage Policy:
Unlimited mileage unless otherwise stated in writing.

Return Condition:
Vehicle must be returned clean and undamaged. Excessive dirt, stains, or damage will result in cleaning/damage fees.

Damage and Refund Policy

In the event that the rental vehicle is returned with any form of damage—cosmetic, mechanical, or structural—whether reported or unreported, the renter forfeits any right to a rental refund, regardless of insurance coverage.

All rental payments are final once the rental period begins. No refunds will be issued if damage is discovered upon return or during the rental period. Any insurance claims must be processed independently, and do not entitle the renter to reimbursement of rental fees from Bevans Legacy Auto Co.

Late Payment & Repossession Clause

Late Payments

All rental and rent-to-own payments are due on or before the agreed due date, each Friday, unless otherwise discussed with financing manager. A late fee of $25 per day will apply to any payment not received by 12 PM CST on the following day (Saturday). 

Failure to Pay / Breach of Agreement

If the Renter fails to make payment, maintain required insurance, or otherwise violates this Agreement, Bevans Legacy Auto Co. reserves the right to immediately terminate the Agreement.

Repossession

Any missed payment, failure to maintain insurance, or breach of Agreement terms will result in immediate termination of this Agreement and repossession of the vehicle without prior notice, as permitted under Tennessee law.
The Renter is responsible for all repossession fees, administrative fees, towing costs, storage, and any outstanding balances.

Reporting of Non-Return

Vehicles not returned on time and without communication will be reported as stolen property to law enforcement after 24 hours.

Revisions to this Agreement

We may modify this Agreement at any time, with or without notice.

Renter Requirements:

• Valid driver’s license matching booking name
• Proof of insurance required before vehicle release

Permitted Use and Driver Eligibility
Only licensed drivers 25 years of age or older may operate the vehicle. The Renter agrees not to permit any unlicensed or unauthorized drivers to use the vehicle. The vehicle shall not be used for illegal purposes, off-road driving, towing, ride-sharing (unless expressly permitted), or subleasing.

Legal Disclaimers & Responsibilities:

• Renter is responsible for routine maintenance during rentals exceeding 30 days.
• Renter is liable for tolls, tickets, towing, and related fines.
• Renter assumes responsibility for theft, loss, or damage caused by negligence or misuse.
• Damage such as dents, scratches, or interior wear will be charged accordingly.
• Unreturned vehicles may be reported stolen. Legal action may be taken.
• Unpaid balances are subject to collection efforts and may affect credit.

Payment Terms and Timing

Deposits:

Deposits are non-refundable and serve as an administrative, setup, and incident coverage fee. The deposit is $75.00 and can range higher if your driving history and/or payment history with the company is not satisfactory. Deposit amounts are not returned and are not subject to refund except in cases of cancellation within 48 hours of booking.

Pickup and Return Timing Policy:

Pickup and Return Requirements:

• The vehicle must be returned at or before the same time it was originally picked up.
• Late returns beyond the original pickup time will incur an additional full day’s rental charge, regardless of how many hours (or minutes) late the vehicle is returned.
• For example, if a vehicle is picked up at 10:00 AM, it must be returned by 10:00 AM on the agreed return date to avoid late charges.
• Depending on schedule availability and prior approval, you can pay for early pickups before 7:00 AM or late returns after 10:00 PM. This is at the discretion of the owner. 

These charges ensure availability and scheduling for all customers.

Final Payment Policy

Payment for the rental is considered final and non-refundable once the vehicle is released to the renter. This applies regardless of whether the vehicle is returned early, damaged, or if the renter is unable to use the vehicle for the full duration

Acknowledgment of Agreement by Payment

By making any payment — including deposits, rental fees, administrative fees, or other related charges — the Renter acknowledges that they have read, understood, and agreed to all terms and conditions of this Rental Agreement.

 
Payment constitutes full acceptance of this Agreement and its provisions, including but not limited to: refund policies, late return fees, insurance requirements, liability, and dispute resolution terms.

 
The Renter further agrees that initiating payment through any method (credit/debit card, ACH, PayPal, or other electronic means) serves as an electronic acknowledgment and binding acceptance of this Agreement under the Tennessee Uniform Electronic Transactions Act (T.C.A. § 47-10-101 et seq.).

No Expectation of Refunds or Credits Clause

All payments made under this Agreement are non-refundable.
No repair issues, mechanical failures, or dissatisfaction with vehicle condition will qualify for payment refunds, adjustments, or credits.

GPS Tracking Disclosure

The vehicle contains a GPS tracking device used for security, asset protection, and recovery in case of breach.
Renter acknowledges and consents to continuous GPS monitoring.

Additional Legal Terms: 

1. Indemnification: Renter agrees to indemnify, defend, and hold harmless Bevans Legacy Auto Co. its officers, agents, and employees from any and all claims, damages, losses, liabilities, and expenses (including attorney’s fees) arising from the use or operation of the rented vehicle by the Renter or any authorized or unauthorized driver.
2. Insurance Responsibility: Renter must carry active insurance covering liability, collision, and comprehensive damage.
3. Accident Reporting: All accidents must be reported to Bevans Legacy Auto Co. LLC and law enforcement immediately.
4. Unauthorized Drivers: Only the renter listed may drive the vehicle.
   Prohibited Use: No racing, off-roading, towing, intoxicated driving, or illegal activity.
5. Maintenance Responsibility: Renter is responsible for basic upkeep during long-term rentals (30+ days).
6. Hold Harmless Clause: Bevans Legacy Auto Co. LLC is not liable for indirect or consequential damages.
7. Dispute Resolution: Any disputes will be resolved via binding arbitration in Davidson County, TN.
8. Additional Insured: Bevans Legacy Auto Co. LLC must be listed as “additional insured” on the renter’s insurance policy when applicable.
