  • Thank you for completing our client intake package. This information is essential to ensure the accurate preparation of your tax returns.

    For new clients, we may request access to prior-year tax transcripts to verify information, compare filings, and assess any prior-year obligations.

    For returning clients, even though we may have some information on file, we ask that all information be reviewed and resubmitted to ensure our records are fully accurate and up to date. You will have the option to indicate if certain sections have not changed since your prior filing, in which case re-entry may not be required.

    IRS compliance is critical to our process. Our team works diligently to ensure accuracy and to identify all credits and deductions you are legally entitled to claim.

    • You must click “SUBMIT” at the end of the form to transmit your information
    • Closing your browser before submitting will result in loss of information

    To comply with federal and state identity theft protection requirements, a valid government-issued photo ID will be required during your engagement.

  • This agreement outlines the terms of our engagement and the responsibilities of both parties. By signing, you acknowledge that you have read, understand, and agree to the conditions below.

     

    OUR RESPONSIBILITIES

    Legendary Tax Professionals will prepare your federal, state, and local income tax returns using the information you provide.

    • We do not audit or independently verify the information submitted
    • We may request clarification if information is incomplete or inconsistent
    • We are not responsible for discovering fraud or irregularities
    • We will work to identify all allowable credits and deductions
    • Additional bookkeeping or services may result in additional fees

    YOUR RESPONSIBILITIES

    You agree to:

    • Provide complete, accurate, and truthful information
    • Respond promptly to requests for clarification
    • Retain records supporting income, expenses, credits, and deductions
    • Review all returns carefully before signing for IRS transmission
    • Not knowingly provide false or misleading information

    You understand that you are ultimately responsible for your tax returns, even after preparation.

    PENALTIES, EXAMINATIONS AND NOTICES

    Tax authorities may impose penalties for issues including, but not limited to:

    • Understated income
    • Late filing
    • Underpayment of estimated taxes
    • Insufficient withholding

    Returns may be selected for examination by federal or state authorities. Any adjustments are subject to appeal rights. Optional audit protection may be available at an additional cost.

    PRIVACY & CONFIDENTIALITY

    We protect your privacy in accordance with professional standards and applicable laws.

    • Nonpublic personal information is collected only as provided or authorized by you
    • Information is shared only with employees or third parties necessary to provide services
    • All parties are contractually required to protect confidentiality
    • We maintain physical, electronic, and procedural safeguards
    • Records are retained as required by professional and legal guidelines


    FEES

    Fees are based on the time required, forms completed, and services rendered. Fees are not dependent on refund amounts and are due regardless of whether a refund is issued.


    DISPUTE RESOLUTION

    If a dispute arises out of or relates to this contract or engagement letter, or the obligations of the parties therein, and if the dispute cannot be settled through negotiation, the parties agree first to try in good faith to settle the dispute by mediation administered by the American Arbitration Association under its commercial Mediation Rules before resorting to arbitration, litigation, or some other dispute resolution procedure.

     
    ACKNOWLEDGMENT & AGREEMENT

    By signing this form, you confirm that:

    • The information provided is true, complete, and accurate to the best of your knowledge
    • You understand this information is submitted to federal and state tax authorities
    • You understand that providing false information may result in penalties
    • You understand that Legendary Tax Professionals is responsible only for errors or omissions on our part, not tax due, interest, or penalties resulting from client-provided information
    • These terms apply to the current and future years unless otherwise stated

  • Audit Maintenance Pro Enrollment Agreement

  • By completing and submitting this Form, the Client acknowledges and agrees to the automatic enrollment in Audit Maintenance Pro (“the Service”). The Service provides limited assistance related to IRS or state tax notices, audits, or examination correspondence, including general guidance, document preparation review, and response support. The Service does not include representation before the IRS or state taxing authorities, legal services, or any services beyond those expressly described herein.

    A one-time, non-refundable fee of $79.99 will be assessed and added to the Client’s invoice for the tax preparation services rendered. Enrollment in the Service is automatic for all Clients unless a written opt-out request is submitted and acknowledged prior to the commencement of tax return preparation.

    By proceeding with the tax preparation process, the Client affirms that they have read, understood, and voluntarily consent to the terms of this Audit Maintenance Pro Enrollment Agreement. The Client further agrees that their electronic or physical signature on this form constitutes a legally binding acknowledgment and acceptance of these terms.

  • Refund Loan Disclaimer

  • The maximum amount for a Refund Advance Loan is $7500. If approved for a Refund Advance Loan greater than $1,000, you will be charged interest. The amount of interest you are charged depends on how many days it takes to repay the advance from your tax refund. In other words if your tax refund is processed and deposited by the IRS or State quickly, you’ll pay less than if your tax refund takes longer to be released. Interest charges are capped at 60 days. So, the charges to you will stop at 60 days if your refund is delayed.

  • If you apply for a refund advance loan, the deposit method you choose for the refund advance will be the same method used for your refund deposit. The method can't be changed in the event the loan application is denied.

    Please ensure that your bank information is correct. Once transmitted, your banking information can't be changed by your tax preparer or the refund bank. Any returned payment due to incorrect bank information, will be issued as a paper check, incur a $50 overnight mailing fee, and result in a delay of your refund being disbursed.

  • If your total income is less than the standard deduction, whether or not you have dependents, your filing status will be SINGLE to account for due diligence. This will not impact your refund amount.

  • Earned Income Credit

    You may not claim the Earned Income Credit if you have not lived with the child for over half the year, even if you have supported the child.

    TIEBREAKER RULES: To determine which person can treat the child as a qualifying child, the following tiebreaker rules apply:

    If only one of the persons is the child’s parent, the child is treated as the qualifying child of the parent.
    If the parents do not file a joint return together but both parents claim the child as a qualifying child, the IRS will treat the child as the qualifying child of the parent with whom the child lived with for the longer period of time during the year. If the child lived with each parent for the same amount of time, the IRS will treat the child as the qualifying child of the parent who had the higher adjusted gross income (AGI) for the year.


    If no parent can claim the child as a qualifying child, the child is treated as the qualifying child of the person who had the highest AGI for the year.


    If a parent can claim the child as a qualifying child but no parent does claim the child, the child is treated as the qualifying child of the person who had the highest AGI for the year, but only if that person’s AGI is higher than the highest AGI of any of the child’s parents who can claim the child.

  • Authorization, Consent & Payment Agreement

  • By signing below, I authorize Legendary Tax Professionals and its authorized representatives to act on my behalf for the purpose of preparing and filing my tax return for the applicable tax year.

    IRS Offset & Refund Authorization

    I grant express written permission for my tax preparer to contact the IRS Offset Line and inquire about the status of my refund, including any federal or state offsets that may apply to my account. I understand that this authorization is limited to obtaining information related to refund processing and offsets and will remain valid for the duration of my tax preparation engagement unless otherwise revoked.

    Consent to Use & Disclosure of Tax Return Information

    Federal law requires your consent before your tax return information may be used or disclosed for purposes other than preparing and filing your return.
    • I understand I am not required to provide this consent to receive tax preparation services
    • My consent is valid for one (1) year from the date of signature unless otherwise specified
    • Legendary Tax Professionals may use my tax return information to determine eligibility for Electronic Refund Disbursement Services and/or loan products
    • If I elect to use these services, I authorize the disclosure of my tax return information to the applicable financial institution or service provider (including Refund Advantage, where applicable) for evaluation and processing
    I understand that if I do not authorize disclosure, I may still have my tax return prepared and filed, but I will not be eligible for refund advance or bank product services.
    If I believe my tax information has been improperly disclosed, I may contact the Treasury Inspector General for Tax Administration (TIGTA) at 1-800-366-4484 or complaints@tigta.treas.gov.

    Payment & Refund Responsibility

    I understand that Legendary Tax Professionals is not responsible for delays caused by incorrect or incomplete information I provide, including errors related to names, Social Security numbers, dates of birth, or income figures.
    • I am responsible for all information submitted
    • Changes to my tax figures after filing may require an amendment at an additional fee
    • If my refund is subject to offsets (child support, student loans, government debts, etc.), preparation fees may be required upfront
    • If my refund is fully offset and fees are unpaid, I authorize Legendary Tax Professionals to draft the balance from the bank account on file
    Legendary Tax Professionals is not responsible for IRS processing delays, banking delays, system errors, or refund disbursement timing and does not reimburse bank fees under any circumstances.

    Clerical & Banking Errors

    In the event of a verified clerical or banking error that results in an incorrect deposit, I authorize Legendary Tax Professionals to debit my account to correct and reverse the error.

    Mutual Non-Disparagement

    Both parties agree to refrain from false, defamatory, or disparaging statements regarding the other. Any violation of this provision by the client will result in a $1,000 penalty per occurrence, payable to Legendary Tax Professionals.

    Acknowledgment

    By signing below, I confirm that:
    *The information provided is true and complete to the best of my knowledge
    *I understand my rights regarding the use and disclosure of my tax return information
    *I accept responsibility for my tax return and any resulting tax liabilities
    *I have read, understand, and agree to all terms above

  • Abandonment of Services
    If the client fails to provide required information, documentation, signatures, or responses necessary to complete tax preparation services, or otherwise ceases communication for a period of three (3) consecutive days, the engagement may be deemed abandoned at the sole discretion of the preparer.

    In the event services are deemed abandoned, the client acknowledges and agrees that an abandonment fee of $200.00 shall become immediately due and payable. This fee compensates for time spent, administrative work performed, professional review, reserved capacity, and opportunity costs incurred by the preparer.

    The client understands that no tax return will be filed, transmitted, or finalized until all outstanding balances are paid in full.

    Any unpaid balance resulting from abandonment may be subject to standard collection efforts as permitted by law, including invoicing, formal payment demands, referral to a collections agency, or legal remedies. The client agrees to be responsible for any reasonable costs incurred in the collection of unpaid balances, to the extent allowed by law.

    This abandonment provision applies regardless of whether the client ultimately chooses to complete services elsewhere.
