This contract between The Nerdy Bird and the client shall not become effective until it is signed, electronically or otherwise, and the $25 retainer due has been paid. At the time the contract takes effect, The Nerdy Bird shall reserve the date and time agreed upon and not make any other reservations or accept other clients for said date and time. For this reason, in the event the client cancels this contract for any reason, all initial monies paid shall be retained by The Nerdy Bird to offset its loss of business. The remaining balance is due at the time of the session.
The photos included in the online gallery are up to the photographer's discretion. The photos chosen and edited will reflect the best captures from the event/session. Due to the nature of hand editing, the turnaround time for a complete mini session gallery ranges from 1 day to 1 week. After the online gallery has been posted, the client has 3 months to choose which digital images, prints and items they would like to purchase. After 3 months, the online gallery will expire and there will be a $15 reactivation fee. Turnaround time for prints is 1-2 weeks after the client has made their selections. During this time, photographer will finalize edits and make sure every image is perfect before it is sent to the professional lab. Additional editing is available at additional expense to be determined by photographer. Unedited/Raw photos will not be released to the client for any reason.
Re-shoots are determined at the discretion of the photographer. Re-shoots will not be given for poor choices of clothing, make-up, hair or weather related issues. Due to the nature of photography, and the fact that images, once sent, cannot be returned; The Nerdy Bird has a strict no refunds policy. Once a transaction is completed, it is then considered non-refundable.
Photographer is not responsible for loss of any photos due to an electronic failure, such as but not limited to, camera malfunction, external hard drive and/or computer failure. If such an occurrence happens, it will be handled on a case by case basis. Photographer is not responsible for the damage of portraits after delivery to client, including damage caused during transit by US mail. Client assumes all responsibility for the safety of all portraits upon receipt.
The Nerdy Bird has a strict policy when it comes to photographer harrassment. In the case of an intimate family or child session, there will be one warning for inappropriate behavior. If the harrassment persists, photographer will promptly leave or ask client to leave and no refunds will be given. Photos taken up until that point will be edited as normal.
