Please read and by signing and dating below, you agree to these terms
PREAMBLE: I, the above named person and/or persons, hereafter referred to as “adopter,” hereby agree that the above described animal (hereafter referred to as “the animal”) is being adopted by me from Cause For Paws of NC (“CFP”) solely as a pet for myself and/or my immediate family.
After adoption, the animal’s health and care are adopter’s sole and full responsibility. Adopter agrees to release Cause for Paws of North Carolina, and its individual members, board members, and volunteers, jointly and severally, from all claims for personal injury and/or property damage to adopter or others. Adopter hereby declares that no representation about the nature of the adopted dog or cat, nor any representation regarding the nature and extent of legal liability or of responsibility have induced the adopter to sign this contract. In consideration of an adoption fee in the amount of $195, adopter acknowledges and further agrees to the following provisions.
PROPER CARE: Adopter agrees that he/she will not sell, give away or otherwise dispose of the animal to any person(s), dealer, retailer, auction, institute or any other entity for any reason. If at a later date Adopter is unable or unwilling to keep this pet, Adopter agrees to first contact Cause For Paws of North Carolina and give them the option to reclaim said pet at no charge. Adopter further agrees to the following: • Adopter will provide the care and attention necessary to ensure the animal’s health and well-being, including providing adequate food and water. • The pet will stay primarily indoors and will have shelter when outside. • To provide the animal with daily exercise, a collar for dogs with rabies tag, identification and any necessary license tags. • Provide the animal with all emergency and routine medical care, including an annual examination by a licensed veterinarian, vaccinations, and/or boosters; heartworm prevention and any other care that may be recommended by the animals veterinarian.
CONDUCT OF ANIMAL: Cause For Paws of North Carolina makes no explicit or implicit guarantees in reference to the temperament of the animal. Adopter understands that no one can predict how the animal will react in a new situation. Therefore, adopter will exercise prudence and caution in introducing this dog/cat into the new situation until the animal has become fully adjusted to its new environment and adopter has had an opportunity to become familiar with this animal’s unique personality. Adopter assumes full responsibility for the conduct of the animal, and for any damage to persons or property.
HEALTH OF THE ANIMAL: Cause for Paws of North Carolina makes no explicit or implicit guarantees in reference to the health of the animal. The animal is adopted “as is” and the adopter assumes all responsibility for treatment of any and all existing conditions or any other physical, medical or temperament changes that may occur in the future. Cause For Paws of North Carolina cannot guarantee the health of any animal and shall not be held responsible for any medical expenses which may be incurred, hereby expressly excluding any implied or express warranties of merchantability or fitness for any particular purpose, including, without limitation, any warranties regarding health, temperament or whether the animal is housebroken.
ADOPTION FEE: Adopter understands and agrees with the following • The adoption fee of $195 shall be refunded to the Adopter ONLY IF BOTH of the following occur within two weeks or 14 days after the date of this agreement: o CFP receives written notice from Adopter requesting a refund and agreeing to surrender ownership of the animal to CFP, without qualification, AND o Adopter returns the animal to CFP, at Adopters expense, in the same or similar condition in which it was as the effective date of this agreement. • The adoption fee of $195 is non-refundable 14 days after the date of this agreement without exception. If either of the conditions details in the paragraphs above are not satisfied within the required 14 day period, as specified above, the $195 adoption fee will not be refunded to Adopter for any reson. • The adoption fee includes: spay/neuter of the animal at a CFP approved veterinary office only, up-to-date shots as of the date of this agreement, and a microchip. • If adopter chooses to have the animal spayed/neutered by a non-CFP approved veterinary office, CFP will not pay adopter for the expense of the spay/neuter procedure. Any out-of-pocket costs incurred by adopter for a spay/neuter procedure at a non-CFP approved veterinary office are the sole obligation and liability of the individual adopter.
SPAY/NEUTER DEPOSIT: Adopter understands and agrees with the following • If CFP allows adopter to take ownership and possession of an animal prior to the animal being spayed/neutered, an additional $100 spay/neuter deposit is also required. • If a spay/neuter deposit was provided of $100, in addition the $195 adoption fee, the $100 spay/neuter deposit will be refunded upon proof of spay or neuter with 6 months of the date on this agreement. After the length of 6 months from the date of this contract, CFP will consider the $100 deposit as a donation. • If adopter chooses to have the animal spayed/neutered at a CFP approved veterinary office, adopter will not incur additional expenses for the spay/neuter procedure. The costs of the procedure will be paid for by CFP per this adoption agreement, as part of the $195 adoption fee. • Adopter agrees that CFP is not responsible for any complications or medical emergencies that may occur through the course of the spay/neuter procedure performed by a CFP approved veterinary hospital, with or without negligence on the part of the CFP approved veterinary hospital that performs the procedure. Should such complications arise, adopter agrees CFP bears no liability. • Adopter may elect to have the animal spayed/neutered at a non-CFP approved veterinary office. However, should the adopter choose to do so, additional expenses will be incurred by adopter for the procedure, those expenses are not included in the $195 adoption fee, and adopter will not be reimbursed by CFP for such expenses. Any out-of-pocket costs incurred by adopter for a spay/neuter procedure at a non-CFP approved veterinary office are the sole obligation and liability of the individual adopter. • Proof of spay must be mailed to CFP postmarked within six months of the date of this agreement. • If such proof is not sent to CFP, is not sufficient proof as defined above, or is not sent within the required six month timeframe, adopter agrees to forfeit the $100 deposit as no longer refundable. • If proof of spay/neuter is sufficient, as defined above, and received by CFP within the required six month window, CFP agrees to refund the $100 spay/neuter deposit to adopter within six months after receipt of such proof.
REPOSSESSION: Adopter understands that in the event he/she does not follow the terms of this Agreement or adopter neglects or abuses the animal, Cause For Paws of North Carolina or another animal authority has the right to take possession of the pet. The adopter agrees to pay Cause For Paws of North Carolina any and all expenses, including court costs and reasonable attorney’s fees, in enforcing the terms and provision of this contract. Adopter also understands that in the event he/she gives false information or does not follow the terms of this contract, Cause for Paws of North Carolina may reclaim the animal and start legal proceedings against adopter at adopter’s expense, and may assess damages in the amount of $1,000, plus legal fees, against adopter.
RELEASE: The Release Statement below releases Cause For Paws of North Carolina from any and all liabilities with respect to this animal’s behavior, actions, health or performance. PLEAE READ ITS TERMS CAREFULLY and make sure you FULLY understand before signing. By signing this agreement, Adopter forfeits any right to sue.
Adopter of the animal identified at the top of this Agreement, agrees, understands and promises to forever release, discharge, indemnify and hold harmless Cause For Paws of North Carolina and any of its agents or representatives, board members, volunteers, or any other person associated with this rescue, their heirs, administrators, executors, successors and assigns from any and all claims, damages, costs, expenses, loss of services, actions and causes of action arising out of bodily injuries, mental anguish or property damage or any other occurrence from the present time on, caused by the adoption of this animal. This includes, but is not limited to, any and all loss, damage, fees and expenses (including legal or medical fees) by reason of liability imposed by law or otherwise due to bodily injuries or death to any person(s), or animal, including the adoptive owners. This also includes any damage to property arising out of or in consequence of the placement of this animal. Adopter’s aforementioned release and indemnification remains fully effective no matter how such injuries, death or damage to property may be caused, whether or not the same may have been caused by, or may be alleged to have been caused by, negligence of the aforementioned parties or any of their agents or representatives, or any other person connected with Cause For Paws of North Carolina.
Adopter, the undersigned, assumes sole responsibility for all manner of actions and causes of actions, suits, debts, accounts, bonds, covenants, contracts, agreements, judgments, claims and demands whatsoever arising out of possession and/or the placement of this animal.
Adopter also understands that Cause For Paws of North Carolina will not be responsible for any medical care or costs thereof required for this animal from this day forth. All expenses resulting from or in any injury or illness and all care will be adopter’s sole responsibility.
In addition, adopter hereby agree that Cause For Paws of North Carolina, its agents or representatives, board members or any other person associated with this rescue, their heirs and assigns, successors and executors, will not and cannot be held responsible for the conduct, behavior, health or disposition of this animal. Adopter understands that unconfirmed and unverifiable information may have been voluntarily provided to this rescue by the animal’s former owner, if known, and/or the shelter from which the animal was rescued. However, adopter understands that Cause For Paws of North Carolina has undertaken no investigation into the truth or falsity of such information nor with regard to the history or physical condition of the animal. Cause For Paws of North Carolina, and any other agents or representatives, board members, executors, successors, agents and assigns, make neither warranty nor guarantee, expressed or implied, as to the physical, medical, mental or behavioral condition of this animal, its background or its suitability or compatibility.
Adopter shall assume all responsibility for damages, suits, debts and actions that arise from ownership of this animal. Adopter understands and agrees that adopter hereby gives up any right to take any legal action whatsoever against Cause For Paws of North Carolina, it's agent or representatives, board members, heirs, administrators, executors, successors and assigns. Adopter therefore hereby releases Cause For Paws of North Carolina, and all of its heirs, administrators, executors, successors and assigns, board members, and any other agents or representatives from any and all liability and responsibility with regard to this adoption, which adopter undertake voluntarily and with full knowledge of the above release and its implications.
By signing I certify that I have read and understand the terms of this Pet Adoption Agreement and Release Statement and that I understand that by voluntarily signing this agreement that I am entering into a legal and binding contract with Cause For Paws of North Carolina. I understand that this is an adoption contract and not a contract for the sale of this pet. I further certify that this contract and the application I submitted to Cause For Paws of North Carolina constitute the entire contract for the adoption of this pet, and no prior oral representations or agreements are of any force and effect unless incorporated herein.
