EA Mutual Acquisitions LLC , a Florida Limited Liability Company herein “Advocate”. WHEREAS the Owner has an interest in a certain Timeshare Property with a certain Resort Company and has incurred or is otherwise responsible for payment of an Owner’s promissory note, secured interest (Mortgage) or payable agreement and assessments or other charges thereby (“Owner-Obligation”) and WHEREAS the Advocate is a consumer advocacy company engaging with certain governmental agencies, timeshare realtors, attorneys, advocacy groups and credit counselors to attempt to settle or otherwise resolve “Owner-Obligations”. WHEREAS Owner wishes to hire Advocate and Advocate wishes to be hired on a“best efforts basis” (to act with reasonable diligence and good faith according to industry standards) to provide a settlement or otherwise resolve of some or all of the Owner-Obligation herein (“Offer of Release”); NOW THEREFORE IN CONSIDERATION of the promises and covenants contained herein the Parties (Owner and Advocate) agree as follows: 1. The Whereas Clauses are incorporated by reference and made a part hereto.2. Owner hereby appoints Advocate and Advocate hereby accepts appointment.3. Owner name:4. Owner address:5. The fixed compensation paid to Advocate for services hereunder shall be $3725.00 per deed , if coupon code is provided with a mail-out promotion code (COUPON CODE APPLIED). Moreover, which fees are earned upon receipt and the compensation shall be paid as follows credit card or PayPal services upon request, or escrow services. .Certain fees which may include but not be limited to deed back cancellation,deed recording, and other transfer assessments that may be payable to the Resort. These fees will be the Client’s responsibility,separate and apart from the Advocate’s compensation.10. Advocate does not guarantee any particular outcome.11. Advocate’s services may include, but not be limited to:a) assisting Owner in communicating with Resort [as owner] to obtain an offer of release by working with all of the various departments which may include but not be limited to:Resort’s Customer Service Department, Loss Mitigation, Resort “in-house” settlement programs; Financial Services Department,and/or Legal Department [when and if necessary] ) engage with certain governmental agencies, timeshare realtors, attorneys, advocacy groups and credit counselors to attempt to settle or otherwise resolve “Owner-Obligations”.c) escalating the cancellation by using a State licensed Attorney to work through the Resort’s legal department.d) relying on Owner’s disclosure of facts,e) advise Owner of necessity additional services or service providers,f) evaluate Owner’s analysis of the case and advise as to various options available by reviewing letters,emails, and other documents of Owner and Resort,g) respond to the requests of the Note Holder; Lending Institution, Vacation Ownership Resort; Third Party Lender; Etc.,h) provide guidance and procedural information regarding filing and serving documents directly with the lending institution such as a Note Holder; Lending Institution,Vacation Ownership Resort; Third Party Lender; Etc.12. Owner will execute the EA MUTUAL ACQUISITIONS POWER OF ATTORNEY made a part here of and will otherwise cooperate with Advocate in all areas required for Advocate to perform its duties hereunder.13.Owner will provide all documents requested or required by Advocate within 30 days of said requestor requirement by Advocate.14. The term of this Agreement is for 24 months from the time of execution and payment of compensation.15.Advocate is not a law firm and is not providing any legal advice.16. This Agreement represents the entire Agreement of the parties hereto relating to the subject matter hereof, and any prior agreements, promises, negotiations, or representations, whether oral or written, not expressly set for thin this Agreement are of no force and effect.This Agreement may be modified only by a writing signed by the Parties hereto.17. This Agreement shall be governed and construed in accordance with the laws of the State of Florida and the Venue for enforcement of this Agreement shall be Orange County,Florida.18. Nothing herein shall induce or otherwise suggest that Owner change or alter their existing owner- obligation with Resort as herein stated above. Owner hereby acknowledges their owner obligation; and independent of Advocate, have elected to retain Advocate to obtain an offer of release.19. Aside from past experience and hard work, Advocate makes no representation of having any“unique” or otherwise special methodologies and/or contacts with Resort.20.Should Advocate choose to hire outside legal counsel [on behalf of owner]; said counsel to represent Owner not Advocate in all matters pertaining hereto.21. Nothing herein shall prevent Owner from communicating directly with Resort.22. During the term of this Agreement and in negotiation of said return, release and/or cancellation and termination of their Clients’ “Owner-Obligations” the Timeshare Property may be subject to a foreclosure action and judgment by the Resort. The Parties agree that should such foreclosure judgment take place then such judgment would act as securing a return, release and/or cancellation and termination of the Clients’ “Owner-Obligations”, if said foreclosure judgment is only against the Timeshare Property and not the Client, individually,irrespective of credit affects to Client. IN WITNESS WHEREOF, the parties have executed this agreement by clicking I agree to terms and conditions.
