I can't log in, says I am suspended

    The account wrobelcpa8273  was suspended due to violation to JotForm Terms of Use.

    Scams. You agree that you will not use JotForm or any form(s) you create using JotForm for scamming purposes to attract, lure, or illegally obtain payment of any sort from others by unjustifiable means such as posting a jotform as a money-making program on a classified ads site as an example of that. Any account reported or found doing so will be immediately suspended.   

    Phishing. You agree that Company may terminate your JotForm Service immediately if a form's purpose is found to be deceptively obtaining: sensitive credit card information, social security numbers, user login credentials, or other sensitive personal information. All these activities are considered as Phishing and any account along with the violating forms will be suspended immediately.

    Collecting Sensitive Information. You may not use the JotForm to collect certain types of sensitive information, including but not limited to credit card information and any type of login credentials. You may collect some sensitive information such as social security numbers or driver’s license numbers, but you are required to use best security practices of JotForm including SSL and Encrypted Forms features. You are solely responsible for compliance with any data protection and privacy laws and rules applicable to the sensitive information.

    We can only request for reactivation of the account after you agree and comply that we remove the form/s that violate the Terms.

    I don’t understand where we are in violation of any of this. Can you be more specific as to what part of our form is in violation? I’d be happy to fix it if I knew what the problem was.

    Hello Michelle,

    We apologize for this. 

    The cause of the suspension was due to the field asking for social security number from your New Client Application Form (http://www.jotform.us/form/73455731838162).

    While the collection of social security number is not completely forbidden, some States have imposed restrictions on a business soliciting the SSN, online form builders, including JotForm, have been used for identity theft in the past. We go to great lengths to prevent this. That is why our Terms  will mention SSNs are considered as a Phishing activity. 

    Therefore, when you do request SSN,  the chances are that our automated phishing detector will flag the form(s)  and suspend the account.  If this happens you'll have to contact support to whitelist the form and reactivate the account, explaining the purposes of the form(s).

    These are some examples of businesses that require a Social Security number for legitimate purposes:

    • Insurance companies
    • Credit card companies, lenders, and any other company receiving a credit application from you
    • The three main credit reporting agencies: TransUnion, Equifax, and Experian
    • Any company that sells products or services that require notification to the IRS, including:
      - Investment advisors
      - Banks
      - Real estate purchases
      - Financial transactions over $10,000, such as automobile purchases; and other financial transactions.

    Moreover, you need to know that since we do store the information in your account, anyone with access to it would also have access to social security numbers. So, in the event of a security breach of your account this could be an issue.

    Thus, it is imperative to exercise necessary measures for proper collection of information, so for us to be able to whitelist your form:

    1. Embed the form using  SSL method (http://www.jotform.com/help/63-How-can-I-receive-SSL-Submissions)

    2. Add a sort agreement and/or an e-signature field to the form, so your customers will agree to provide their SSN along with personal info.

    In conclusion:  If your purpose is not to collect SSN from the general public, but from your own customers; if your business is among the list above and if you follow the recommendations; then all this will surely make your forms not be considered as guilty of phishing activities.

    Thank you for that clarification. This form is only used to collect
    information from our own clients. We are an accounting firm, and they have
    to give us their SSN one way or another. This form has greatly streamlined
    our new client setup process. We do not have the URL embedded on any
    webpage; if we do, we will certainly encrypt it. Currently we are only
    sending our clients the direct link via email, or else we are using the
    form ourselves to fill out the information as we meet with them. So what is
    the best course of action here? I could add the Terms of Use and a
    signature block, but that isn't applicable when we are using the form
    ourselves in-house to transfer information they gave us during a
    meeting..... but will this suffice? Otherwise, we are going to have to find
    another provider to use this kind of form.

    You could setup a condition that shows the signature and terms widgets for your customers and hides it for internal registrations.

    This is recommended. But, in your case it would be acceptable to omit the terms and signature fields if you so wish.

    However, it is absolutely mandatory to enable encryption and use SSL forms. This ensures your clients data is secure when stored and while it is in transit.
