I have setup my form preferences to accept 1 unique submission based on email. But the warning/failure message is only returned to the user after the thank you splash page is on the screen and a confirmation email is sent to the user. If the email is not unique after submission can the thank you splash and email be prevented?

Unique submission feature uses IP address or save Cookie session.
Perhaps you must be refering to Unique Question ?

It was actually disabled
And it uses a custom error message that says "form is submitted already" when it is not yet.
I suggest you reset the form.. remove first the Unique quesion and restore the warning message. And then enable the form.
