Pop-up Box for Terms and Conditions - code not working

Per the request at the very bottom of this thread:

I've tried using the code provided for a pop-up box for terms and conditions (obviously personalizing it for my link URL), but it doesn't work.  The text never turns into a link, it just remains static text.

Terms and conditions

I can get the text to link as a regular link that opens in a new tab, but we would like a pop-up box.  The lightbox isn't an option due to my content provider and the code interfering with the template.
