    Hello,

I have a website in which I want to incorporate fundraising capability which would likely require their name and a picture associated. Is it still HIPAA compliant if a form is given via jotform to obtain consent for their release of information to raise funding on behalf of their medical expenses? I would be then using another application to create their information and release it on my site.

    Ken.

    Hello Ken,

Thanks for reaching out to Jotform Support. If you use Jotform to uncover PHI(Protected Health Information) for fundraising, unfortunately, that is against the HIPAA Compliance regulations especially if you are a Covered Entity. We as a platform in that case are responsible for protecting the PHI submission data. Our Terms of Use clearly state that you may not use Jotform to collect, use, or disclose personal information protected from any of these activities under privacy laws.

Reach out again if you need any more help, or if I misunderstood your question.
