The "I agree to terms & conditions.*" check box does not appear when I access my form on my Nexus 5 Android phone. The "Required" and label link is there but without the check box the form cannot be submitted.
It is there when I test the form with the new design tool but not on my phone?

I was able to reproduce the issue with missing check box on the Terms & Conditions widget when I checked the form using mobile browser.
Now it has been escalated to our Development Team. We will get back to you once it is fixed.

Unfortunately, we have not received any update form our back end team yet. Upon checking the bug report status, I found that one of our developer is already looking into this issue. We will get back to us as soon as this is fixed.

Yes - we updated the widget a while back to fix your issue (Terms and conditions widget not displaying on mobile browsers) - but we still needed to fully test it.
