what about American companies collecting EU user data in addition to US and the rest of the worlds data? Are we supposed to be moving everything to EU or breaking up the forms to have separate versions for EU?

What you need is an unambiguous consent from the European user. So, it is a good idea to have a separate form for European users and let them know that their data will be transferred to the US in a clear way.

I know that you were inquiring as to breaking up your forms or not between US and EU but since your question is partially related I'd like go ahead and inform you anyway that we've now released our solution to Safe Harbor Invalidation.
