  • Client Agreement Form

  • Hello! Just a quick note before you go through this form. This agreement is mainly about professional standards of behaviour so we agree on what is or is not appropriate and how we should interact before meeting and also on set. Despite how boring and dry this form is, I really am fun and cheery in person! Promise!

  • Model is understood to be Dane Halo for the purposes of this agreement.

    bookings@danehalo.com

*If this form is filled out for a duo shoot, please assume all boundaries apply to all models participating unless otherwise stated in writing. In this instance, "Model" should be replaced with "Models" throughout this agreement. Of course, any rates further along in the form will not apply and will be as agreed upon in private; typically such photoshoots are $200 individual (while one remains off set) and $350 for duos (to be split), hourly.

This agreement is between the Model and the Client as detailed below:

  • Every session fee includes access to:

    - Artful Nudes*

    - Curated Wardrobe/Lingerie**

    - Hair Styling

    - Professional Makeup Application

    - Travel (if within 60 miles of South San Francisco or *limited availability* Sacramento); any location outside of these limits may be subject to an additional charge of $.56/mile as part of the agreement.

*must be discussed and agreed upon ahead of time.
**I reserve the right to request compensation for baggage/handling fees if traveling. Most times, requested clothing is not used, so I am left hauling these items around for no reason. Feel free to provide clothing. I am tall, so while I wear a size M typically, a L is often best for length. Please ensure clothing is laundered, so no straight-off-the-rack thrifted clothing please!

  • *must be discussed and agreed upon ahead of time.

  • Please credit Model as follows:

    Facebook: @Dane Halo
    ModelMayhem: www.modelmayhem.com/1393247

Model always credits Clients - please do the same when possible out of professional respect!

  • Partial Agreement: This agreement exists in order to protect the business practices of both Model and Client ahead of the photoshoot, and to add to this agreement may be done in writing, signed by all the parties at least 48 hours before the photoshoot. Any additional contract may not have verbiage that contradicts any part of this agreement. If the parties wish to waive one provision of this agreement, it does not mean that any other provision is also waived.

  • If you develop any of the following, you agree to let me know before the shoot:

    - new or worsening cough
    - shortness of breath or difficulty breathing
    - temperature equal to or over 38°C
    - feeling feverish
    - chills
    - fatigue or weakness
    - muscle or body aches
    - new loss of smell or taste
    - headache
    - gastrointestinal symptoms (abdominal pain, diarrhea, vomiting)
    - feeling very unwell
    - your children develop abdominal symptoms and skin changes or rashes

  •

Pertinent Information is enclosed in the "Read More" boxes; this contract will assume Client is aware of all information therein.

    A. Session Fees

Client agrees to pay Model a non-refundable booking fee at the time of booking to secure their appointment date and time. This amount applies toward your session with balance due at the beginning of the session. Any agreements you wish Model to sign must be completed at the beginning of the photoshoot.

    Universal Tax-Inclusive Non-Commercial Rate (Effective January 1, 2025)

    2 hours ($350) minimum
    3 hours ($500)
    4 hours ($600)
    5 hours ($700)
    6 hours ($800)
    7 hours ($900
    8 hours ($1000)

Two hour minimum for all photoshoots unless otherwise agreed ahead of time. If I am scheduled to be nearby your location immediately before/after your requested time, I will do my very best to accommodate!

Each additional photographer on set incurs a further $20/hr fee. Additional people on set create new circumstances that the Model must pay attention to, thus creating distractions that lower her ability to perform at the top of her game. This cost exists to discourage (but not eliminate) multiple photographer sets. Consider hiring me and then splitting that time evenly among the photographers at no extra cost with closed (one photographer) sets. This cost also only covers NON-commercial releases. If commercial use is the intent, please have the other photographer(s) contact fill out this form also. Commercial releases will only ever be granted to those who have filled out this form and discussed with me their intent.

  • The session fee is all-inclusive, covering: taxes, makeup, hair, wardrobe*, art nudes, food, and Model's time spent on administrative tasks arranging the photoshoot and any necessary travel/car rentals/gas. In this way, grossing $150 hourly often becomes ~$20 hourly, net.

This rate is universal and applies to all photoshoots besides commercial jobs (aside from discounts applied to 4 hour+ bookings).

*wardrobe must be arranged ahead of any travel, otherwise Model cannot guarantee to have any particular pieces Client desires.

  • B. Etiquette

Consent must be requested and freely given for Client to be within arm's reach of Model. Each time Client wishes to approach Model, consent must be requested and freely given. Consent may be revoked at any given time. Please be respectful. I prefer not to be touched or adjusted!

  • C. Billable Time, Overtime Fees & Being Late

Each session has a designated amount of time and it is blocked off in Model's calendar to give Client undivided attention and make sure Model arrives prepared for the photoshoot session. Client agrees to ensure all paperwork (and payment) is completed at the beginning of the booked time.

Should Model be late, a pro-rated portion of her fee may be withheld at a rate of $35 per ten minutes. If Model is kept past the agreed upon shoot time, Client agrees to pay at the pro-rated amount of $35 per ten minutes.

  • If there is available time on the back end of the photoshoot to make up for lost time and it is agreeable to continue for all parties, this option is available also.

Please note that reasonable breaks, set changes, clothing changes and location changes are included in billable time.

  • D. Location Costs & Fees

If there are any costs/fees associated with the location the Client has chosen for their session, the Client, will be responsible for those fees. Model will not guarantee or arrange payment on any location. Part of your fee includes travel within 60 miles of South San Francisco, CA, Elk Grove (South Sacramento), CA *OR* Caledon, Ontario; any location outside of these limits as per Google Maps will be subject to an additional charge of $.56/mile as part of the agreement AFTER the first 60 miles.

If you help me secure another photoshoot in your area with an approved individual, I waive these fees as a thank-you.

  • These are "home bases" where I will often be! I am happy to travel to 'red' areas, and am always extremely grateful for tips in these cases to help with gasoline and my time inevitably spent in traffic.

  • E. Rescheduling & Cancellations

If an illness or situation prevents a LOCAL photo session from taking place, client may reschedule their session at least 48 hours prior to their shoot without penalty. Should client fail to give 48 hours notice, or decide to completely cancel the shoot, the full session fee is expected as it is unlikely Model can find another photographer to work with in your stead. If Model is traveling, Client agrees to communicate cancellations/reschedule notice prior to 7 days before the photoshoot in which case there will be no penalty. Within 7 days of the shoot taking place, the photographer will be required to pay 50% of the total fee expected for the photoshoot. Within 48 hours, the photographer is expected to pay the full fee. Model may offer this as a credit for future photoshoots at her discretion.

  • If flights are required for an exclusive trip (one booking only), Model will make necessary travel arrangements and will submit receipts for reimbursement. Reimbursement will be required BEFORE travel. (I've been unfairly flaked on and stuck with travel I could not cancel, so this is non-negotiable. My reputation would be a deserved ruin if I abused this trust.)

Model reserves the right to reschedule due to illness, weather, or other circumstances beyond their control. Model agrees to do her best to find a last-minute replacement, and if none can be found, to pay a portion of Client's costs (receipts must be available) IF the photoshoot is planned to take place within 48 hours of her attempt to reach Client by phone/email. In this and only this case, the retainer will be refunded.*

*Please note that in 16 years and 5000+ projects, Model has only cancelled/rescheduled six projects, so this is exceedingly rare.

  • F. Payment

All payments are due in full at the beginning of the photoshoot unless payment arrangements have been made. Model will consider accepting Canon photography gear and/or lighting equipment as a form of payment if discussed and agreed upon ahead of time. I take Zelle, Venmo, cash, credit, and debit (processed through Square). Fees are tax inclusive.

  • G. Model Release

Model will sign releases so long as it is understood and agreed upon that images must NOT be made available for sale/licensing/in any measure to those affiliated with pornographic websites. All sales of digital copies of images must be discussed with Model. Model agrees that copyright is naturally owned by the Client in all circumstances besides when she may request to purchase such a copyright and Client agrees (has not yet happened).

MODEL'S LEGAL NAME IS USED TO SIGN LEGAL DOCUMENTS. THIS IS TO REMAIN 100% CONFIDENTIAL IN ALL MANNERS. Client agrees to never refer to Model by that name in person, online, or in any other way, ever. Please forget it exists. Any/all personal information MUST remain confidential, even between photographers and other models with whom I have previously worked. This is a safety measure to protect Model from multiple stalkers. Thank you.

  • H. Liability

Model is not responsible for any injuries inflicted upon any participating parties. Client(s) will be responsible for themselves and release Model from any claims against their person or their business.

  • I. Limits

Client agrees to discuss and gain approval of props before photoshoot. This includes wardrobe. Model does not work with items that are associated with cultures outside of her own (Japanese swords/Indigenous headdresses, etc.). Model is a propmaker and will happily design and make interesting items so long as it is discussed and agreed upon ahead of time.

Model never consents to images revealing labia, and should any photos exposing labia be discovered, Client agrees to immediately delete such files from all storage devices on which it may be found.

While Model supports safe handling of firearms, she is both untrained and clumsy; two things that do not lend themselves to safe gun handling. I also do not support the sexualization of deadly weapons and therefore do not pose with firearms. Please do not have firearms (loaded or unloaded) in the room/immediate vicinity for our photoshoot.

  • J. Cameras

Wherever there is the expectation of privacy (bathroom/changeroom) it is expected that there be no cameras at any time unless invited in. Hidden cameras are a no-no and will result in a lawsuit. Yes, this has happened once, but it won't happen again. All cameras must be brought to Model's attention upon entry to the location if not immediately visible.

  • K. Weather & Temperature

This should go without saying, but when temperatures and weather are not suitable for the human body to withstand long periods of time spent in states of undress, Model will not spend long periods of time in states of undress.

I have posed nude in desert wastelands, salt basins, glacial waterfalls, howling winds, and blizzards through the years, so I am not against these shoots at all, however they require a long time to prepare for and a long time to recover from. They carry significant health risks and can lead to complications that require me to take time off from other shoots, so they must be approached carefully. In situations where I am traveling, it is always appreciated that the Client brings warm clothing/blankets and perhaps a thermos of something warm. I will insist upon breaks when I absolutely need them, however I always do my best to get exactly what we need in a quick timeframe when in physical discomfort.

I do welcome discomfort for short periods of time in cold and heat, however I have a playful but genuine rule that if I am expected to be nude in nature on especially cold/hot days, I will expect my Client to be barefoot in order for them to be as fully present in the realities of the elements as I am.

  • No provision of this contract is intended or shall be construed to provide or create any third party beneficiary right or any other similar right of any kind to any person or entity which is not a contracting party to this contract. Any provision of this contract which is held by a court of competent jurisdiction to be illegal, invalid or unenforceable in such jurisdiction shall, as to that jurisdiction, be ineffective to the extent of such illegality, invalidity or unenforceability and shall otherwise be enforced to the maximum extent permitted by law, all without affecting the remaining provisions of this Agreement or affecting the legality, validity or enforceability of such provision in any other jurisdiction.

IN NO EVENT WILL THE MODEL, ITS AFFILIATES, AGENTS, LICENSORS, SUPPLIERS, OR THEIR RESPECTIVE DIRECTORS, OFFICERS OR EMPLOYEES BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL, PUNITIVE, EXEMPLARY, AGGRAVATED, ECONOMIC OR CONSEQUENTIAL DAMAGES, HOWSOEVER CAUSED, INCLUDING BUT NOT LIMITED TO: DAMAGES FOR LOSS OF USE FROM KNOWLEDGE LEARNED OR EMPLOYMENT, LOST PROFITS OR LOST SAVINGS, EVEN IF THE EMPLOYER OR ANY OF ITS LAWFUL AGENTS OR EMPLOYEES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR CLAIM. IN NO EVENT WILL THE EMPLOYER AND COMPANY, ITS AFFILIATES, AGENTS, LICENSORS, SUPPLIERS, OR THEIR RESPECTIVE DIRECTORS, OFFICERS OR EMPLOYEES, BE LIABLE FOR DAMAGES OR LOSSES RESULTING FROM: DATA CORRUPTION, TRANSMISSION ERRORS OR PROBLEMS OF LEARNED KNOWLEDGE, PERSONAL INJURY; THIRD-PARTY CONTENT, PRODUCTS OR SERVICES; DAMAGES OR LOSSES CAUSED BY THE EMPLOYEE.

  • For Your Consideration:

    1. Behind-The-Scenes Video/Photos

I love and appreciate any behind-the-scenes photos you'd like to share, but please ask before using cameras/camcorders/any type of recording device (this includes cell phone cameras) during the session unless prior arrangement has been made between Client and Model, including a written agreement. The Model will not continue if there are other cameras or video taping during the session, that had not been spoken about and/or agreed upon by all parties.

     2. Food & Water

Oh man, I can't tell you how much I appreciate food being made available, particularly on shoots that run 3+ hours long. I have no food sensitivities or restrictions, but I'll leave the olives for you. :) I prefer to snack on healthy things that are high in protein and healthy fats to help me stay energized. Veggie sticks, pepperoni sticks, whatever works! My favourite snackies? Pistachios and jerky!!! While I am grateful for canned water (I love every kind/flavor, so not picky), I prefer not to drink from plastic bottles and will in most situations forego them for environmental reasons. Thank you!

    3. Never Expected, ALWAYS Deeply Appreciated...

Consulting, mentoring, managing an event and so on is all extra work not included in my rates. I always GREATLY appreciate a tip when my advice and hard work leads to new perspectives/methods that will serve a photographer well going forward (or if you just appreciated my efforts to help you create imagery!)

  • A note on booking fees:

All payment handling is handled and encrypted by your chosen third party. I do not have access to your information.

Payment of $100 booking fee is agreement to all terms stated. To facilitate connecing the payment with a shoot date, ensure the note on the payment includes related info (date/email, something of the sort). Thank you!
