Client Agreement Contract
This agreement is entered between Events By Tremika LLC (“Service Provider”) and the undersigned client (“Client”) for the purpose of event design and/or decoration services. By signing this agreement, the Client acknowledges and agrees to the following terms:
Booking & Retainer:
A non-refundable retainer of 50% is required at the time of booking. The retainer secures the event date and will be applied to the remaining balance. No date will be held without a retainer.
Remaining Balance:
The remaining balance is due no later than 7 days before the event date. Failure to pay may result in cancellation of services.
Cancellations & Refunds:
Cancellations must be made in writing. Retainers are non-refundable. If the event is canceled after full payment, a partial refund may be issued minus all labor, rental, or purchased items already secured.
Design Changes:
Minor changes are accepted up to 10 days before the event. Major changes may incur additional fees and must be approved by Events By Tremika LLC.
Venue Access & Setup:
Client must ensure proper access to the venue at the agreed-upon setup time. Delays not caused by Events By Tremika LLC may affect setup completion time, overall design execution, and may result in additional fees.
Damages & Liability:
Client is responsible for all damages to rented items. Events By Tremika LLC is not liable for any accidents, injuries, or damages once setup is complete and event is underway.
Travel Fee:
A travel fee applies for all events outside of the Louisville Metro area. Fees are based on mileage from Louisville, KY:
Zone 1 (0–15 miles) – $25
Zone 2 (16–30 miles) – $50
Zone 3 (31–45 miles) – $75
Zone 4 (46–60 miles) – $100
Over 60 miles – custom quote provided.
The travel fee will be added to your invoice before booking confirmation and included in the 50% retainer + final balance due.
Photos, Videos & Promotion:
Client grants Events By Tremika LLC permission to use photographs and record event setups for marketing purposes. This includes TikToks, Reels, and any user-generated content captured at the event or using our photo booth services. We may repost or share tagged content on our social media platforms unless otherwise requested in writing before your event.
Late Payment Policy:
A $25/day late fee applies to balances not paid by the due date.
Failure to complete final payment at least 72 hours before the event may result in cancellation with retainer forfeited.
Outdoor Decor Disclaimer:
Events By Tremika LLC is not responsible for balloon damage caused by weather conditions including heat, wind, rain, or direct sunlight after setup is complete. Outdoor setups are accepted at the client’s own risk.
Force Majeure Clause:
Events By Tremika LLC shall not be held responsible for delays or failure to perform services due to circumstances beyond reasonable control, including but not limited to severe weather, venue restrictions, emergencies, accidents, or acts of God.
Client Responsibilities:
- Client is responsible for securing venue approval for decorations/setup.
- Client must ensure setup area is clean and accessible upon arrival.
- Client is responsible for monitoring children around balloon installations and rental items.
- Client agrees not to move or alter installations after setup is complete.
