This agreement contains the entire understanding between the Photographer and the Client. It supersedes all prior and simultaneous agreements between the parties. The only way to add or change this agreement is to do so in writing, signed by all the parties.
The bride and groom (hereafter Clients) hereby agree that Marilize Coetzee Photography (hereafter the Photogapher) will photograph said wedding date and shall be the exclusive stills/print photographer retained to provide the photography at the above-described event. It is further agreed that still/print photography, in any form or manner, by another contracted, paid or compensated individual or business entity, shall be prohibited and shall be deemed a breach of this contract, with the exception of a Photo Booth photographer (See Photo Booth Photography).Any such breach of contract will release the Photographer from any further responsibility under this Agreement, and any monies paid by Clients will be retained by the Photographer as liquidated damages. Notwithstanding, capturing, selling, and/or reproduction of still/print photography from the aforementioned event by any vendors on behalf of Clients is strictly forbidden and shall be deemed a breach of this contract. It is agreed that any such breach of contract will release Studio from further responsibility under this Agreement, and monies paid by Clients will be retained by Studio as liquidated damages.
The parties agree to a pre-event consultation before the Wedding Day in order to finalise the actual shooting times, locations, and Client’s request list (in writing) for specific photographs. The Client will be responsible for, or have someone designated, to identify people of whom specific photographs are desired.
Serious injuries or death of any of the signing parties to this agreement or an immediate family member will cause this agreement to be void, with documentation from a physician, funeral director, etc. In the event of photographer's sudden illness preventing appearance or performing contract, the client has the option of allowing the Photographer to transfer this contract to another photographer or allow the client to contract with another photographer. All fees except retainer will be returned.
Booking fee and final payment
To assure the appearance of the Photographer for said date and time, Clients agree to pay a retainer (hereafter booking fee Fee) of 30% of the package (or as agreed) upon the signing of this Agreement and is applied toward the grand total. This booking fee is non-refundable should the client cancel for whatever reason.
Payment of the balance is due 2 weeks prior to event date. Make payments to Marilize Coetzee Acc number – 62338466213, FNB, Branch Code – 201510. The Clients agree that the Photographer may withhold the final products & services from the Client until the entire balance of all fees is paid in full.
Marilize Coetzee Photography offers a money back guarantee on all packages including an engagement session. If you after your engagement / pre-wedding session feel that we are not a good match, I will refundyour booking fee in full.
After completion of the digital edits, the Client will have 3 days (72 hours) to inform the photographer that they do not like the images or do not like the way the Photographer works. I do recommend that the engagement is done at least 3 -6 months before the wedding date for ease of mind.
Packages not including an engagement session and destination weddings will unfortunately not qualify for this guarantee.
Products:- All products included in my packages are professional and high quality and I have faith in them. I guarantee thatany faulty product will be fixed or replaced. Please advise the Photographer of any problems within 5 working days of receipt for prompt correction.
Retainers and Cancellations
Upon receipt of the Booking Fee, the Photographer agrees to reserve the time and date agreed upon and will make no other commitments for date and time. Should the wedding be rescheduled or postponed, the Booking Fee paid may be applied towards a new date based on the Photographers availability. If the Photographer is not available on the rescheduled day, or if the wedding is cancelled, the total Booking Fee will be kept as a cancellation fee. Should the event be postponed as a result acts of God such as weather-related emergencies, serious illness or injury of either part or any other cause not under the direct control of either party to this contract, neither party will be held to the terms of this agreement. When the event is rescheduled, the client agrees to give the Photographer first opportunity to provide photography services under the same terms and conditions. Should the Photographer be unavailable for the rescheduled date, a full refund is due, less the booking fee.
Photo Booth Photography
Photo Booth Photography is permitted at contracted wedding however, with this guideline. Contracted photo booth photographer will operate photo booth only and is not permitted to document or photograph any other aspect of said wedding.
Negatives (Digital Files)
The photographs, digital negatives or prints produced by the Photographer are protected by International Copyright Law (all rights reserved) and the Photographer retains the copyright to all photos and images produced. The Client may receive a copy of the digital photographs in an online album or disc if it has been agreed upon. If so, the Client may use any images they like for sharing and enjoyment of friends and relatives.
The images may have slight colour variations from device to devise as not all monitors are calibrated to professional standards. All images are edited on a calibrated screen to ensure that prints are correct.
However, the Client must obtain written permission from the Photographer prior to the Client or their friends and relatives changing, publishing or selling the photographs for profit. Images will not be edited in a style different from the photographer's normal style, special requests may be submitted and will be considered by the Photographer to establish if it might harm the Photographers Brand. No filters or emojis/frames/characters/writing may be added to images uploaded to social media - if you cannot help it, please note that this was not done by your photographer. This must please be conveyed to parents and other family members as well as friends of the bride and groom.
Only the final product will be provided, no RAW images or unedited images will be provided. The images will be presented in the edit that compliments the images the best (colour or black and white) The images will be in high resolution – longest edge will be 20 cm. If larger digital images is required it needs to be requested within 3 months of the event date, thereafter only the images in the online album will be available ( for 10 years)
The Photographer shall keep all negatives and/or digital files for its own personal use if required. After 18 months from date of event, even if Clients have not obtained their entire package, their entire package will be considered final (inclusive of album) and files may be destroyed.
Meals for the photographer and assistants at the above-described event will be provided. The photographer will be seated with easy access to the dancefloor. If seated in different area or area difficult to get out of the photographer will not be held liable for special moments not captured.
Photo Use | Model Release
The Client hereby grants to the Photographer and its legal representatives and assigns, the irrevocable and unrestricted right to use and publish photographs of the Client and family or friends, or in which the Client and family or friend may be included, for editorial, trade, advertising, stock, commercial and any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same. The Client hereby releases the Photographer and his legal representatives and assigns from all claims and liability relating to said photographs.
The client may submit images as is for competitions. If any other supplier (venue/dress) designer wishes to use the images for marketing or in a blog/magazine feature, they need to get the correct size images from the photographer as well as credit the photographer in the correct manner.
Specific Photographs and Liability
1. The Photographer will make every effort to assure Client satisfaction according to accepted industry standards. Any artistic interpretations by the Photographer will be deemed acceptable and correct. Due to the changing and fluid nature of special events, the Photographer does not guarantee the production of any specific image(s). Events outside of the Photographers control, such as weather, the late arrival of Client or subjects, missing persons, short timelines, venue restrictions, guest interference, intoxicated individuals, etc. may preclude the creation of some images. The Photographer assumes no liability for failure to comply with the terms of the Agreement due to events outside of the Photographers control. Both parties agree to cheerful cooperation and communication for the best possible result within the definition of this assignment. The Photographer recommends the Client designate an ‘event guide’ to point out important individuals for informal or candid photographs to the Photographer (see above) during the Wedding Day.

3. Although every possible care will be taken to produce photographs of all important and special moments during the wedding, the Photographer cannot place an unconditional guarantee on the above. The Photographer will not be held responsible for any ruined photographs due to guests’ (or any other) flashes, or any other ruined photographs due to any other cause in or outside of the Photographer’s control.
4. The Photographer may not be held liable for or subject to damages for failure to provide any proofs or prints due to an accident, or any other unavoidable action mentioned or unmentioned by any individual, other service agency or third party necessary in performing the function set forth in this agreement.
5. Clients hereby agree that the Photographers liability for damages pursuant to this Agreement is limited in amount to the total value of the Booking Fee actually paid by Clients pursuant to this Agreement.
4. Although every possible care will be taken to produce photographs of all important and special moments during the wedding, the Photographer cannot place an unconditional guarantee on the above. The Photographer will not be held responsible for any ruined photographs due to guests’ (or any other) flashes; or any other ruined photographs due to any other cause in or outside of the Photographer’s control.
Shooting Time / Additions
The photography schedule and selected methodology are designed to accomplish the goals and wishes of the Client in a manner enjoyed by all parties. The Client and the Photographer agree that cheerful co-operation and punctuality by all members are therefore essential to that purpose. Shooting commences at the scheduled start time agreed by both parties. Should additional photography and/or travel time, that is not included in the agreed package, be requested by the Client, it will be charged out at R 1800 per hour and R 4.50 per km.
Co-operation of Guests and Other Service Providers
The Client is responsible for the conduct of their guests. Co- ordination with other service providers is necessary to complete all the photography as scheduled. The Client should share the photography schedule with other service providers to make sure that there are no conflicts with times. In addition, events during the wedding day should be planned to make the best use of time for all vendors.
The Photographer will not tolerate verbally or physically abusive behavior. The photographer understands that it is a celebration, but intoxicated individuals will not be photographed, even if it is the bride or groom. Nor will the Photographer share its time or compete with guest photographers for the attention of the couple. Unchecked guest conduct that interferes with photography will seriously affect the quality of the photographs taken and decrease the number of photos that will be delivered.
If a videographer is hired for the day, an additional 30 min needs to be added to the couple session to make time for the videographer to get the necessary footage without interfering with the photography schedule. They are welcome to continue shooting while the photographer is shooting, but not take over the entire shooting time.
The Photographer and artist with whom Clients entrusts photography too retains the judgment to remove any image(s) from the proofs that it deems bad or irrelevant. Permits, Location Fees, and Expenses
Clients will be responsible for obtaining any and all permits and/or pay any fees or commissions required by any venue, person or location being utilized for the wedding or any sessions included herein this contract. This will include, but not limited to houses of worship, parks, reception venues or event coordinators. Any additional expenses beyond what is outlined in the previous paragraphs and specifics of this contract, including, but not limited to, travel, lodging, admittance and parking fees, will be the responsibility of the Clients.
Venue | House Rules
The Photographer is limited by the guidelines of ceremony officials or reception site management. Client agrees to accept the technical results of their imposition on the Photographer. Negotiation with the officials for moderation of guidelines is the Client’s responsibility; the Photographer will offer technical recommendations only.
The Client agrees that no images, including previews (if any), will be delivered until the Outstanding Balance is paid in full or contract is received. Digital processing takes approximately 6 weeks and prints/reproductions/enlargements 2 - 3 weeks after approval by the couple, and possibly longer when print-processing and bindery schedules are heavy.
A digital gallery will be given to the Client so the Client can share images with family and friends. A digital gallery will be uploaded upon the completion of the digital images and the album will remain online for 10 years. If needed for any reason a password can be added to the album, but only people who receive the password from you will be able to view the images ( in the case of privacy of small children or glam images if requested )
The photographer will supply all other wedding vendors with digital images for social media use, these might be watermarked or not (photographers discretion will be used). If you for some reason wish that I do not supply them with images, please note it on the wedding day questionnaire.
Wedding day Questionnaire and other information
The Photographer will supply the client with a wedding day questionnaire 2-3 months before the wedding date. On this, the Client will supply all relevant information regarding the wedding day, family dynamics, family portraits as well as important happenings on the wedding day.
If this is not received back from the client, the photographer will not be liable for any family portraits missed or special detail not captured.
Additional requests and family portraits not requested on the questionnaire will be considered if the photography timeline permits or will be attended to at the reception if time allows. Please inform all family members to provide you with family portrait requests before you submit the questionnaire to avoid unpleasant moments during the formal shooting time.
If any provision of this agreement is held to be invalid or unenforceable under the law, the validity of this agreement as a whole shall not be affected, and the other provisions of the agreement shall remain in full force and effect.
Agreement: This contract is the ENTIRE agreement of the parties. No other terms or conditions are expressed or implied. Any additions, corrections or modifications to this contract must be in writing and signed by the Clients and the Photographer. Oral modifications are not enforceable at any time.
The Photographer agrees to the above contract or agreement with Clients named above and will perform contracted services.
