    1. Session Fees & Scheduling

    Upon choosing Brittany Deere as your photographer, you (the client) agrees to fill out a contract and pay photographer HALF of the session fee. This fee is a non-refundable retainer fee. This retainer secures your spot in the books. The remaining balance of your session fee is due at your session! If you would like to pay your session fee in full up front, you may do so, but please know that any monies paid before your session is not refundable should you fail to reschedule your session 72hrs prior to the session day, cancel your session completely, or simply not show up. Brittany Deere can take payments via invoice that will be sent to you through square, or the CashApp ($BrittanyDeere), or can collect your payment in the form of cash or a check made out to Brittany Deere. One more friendly reminder that the retainer fee is non refundable, even in the case that you cancel and/or reschedule your session.

    2. The Session

    Your session will take place at a location we choose together on the date and time we choose mutually. Some locations will require a travel fee. If the location chosen requires a fee to shoot there, you, the client are responsible for covering that fee. Please make sure that children are feed/changed and have had a nap before your session if possible so that we know they will be happy and less fussy! Please arrive at least 10min early to assure that we start on time, if for any reason you are running behind, it cuts into your session time shortening the length of the session. If the client has not shown up after 15 minutes of the session start time, the photographers has the right to leave and the retainer fee is not refundable. Should you choose to reschedule the session, a NEW non refundable retainer is required.

    3. Rescheduling

    If an illness or situation prevents a photo session from taking place, client may reschedule their session ONCE with 72 hours notice prior to the day of their session without penalty. This allows the photographer enough time to book someone in your place. Should client fail to give 72 hours notice, or decide to completely cancel the session, all monies paid up to that point is forfeited and will not be refunded, and a NEW retainer fee will be required if client decides to reschedule for a different date and/or time. If client needs to rechedule for a second time, all monies paid up to that point is non refundable, and this applies to all future reschedules. I try my best to fit everyone in my schedule, so once your session is secured and in my books I have to turn other clients away for that specific date/time. This is why it is important to keep your scheduled date and time if at all possible! The Photographer reserves the right to reschedule due to illness, weather, equipment malfunction, or other circumstances beyond their control. Should the photographer need to cancel a session due to illness and the session cannot be rescheduled, a refund will be granted.

    4. No-Shows/cooperation

    The photographer is not responsible if client and/or key individuals fail to appear or cooperate during session. Photographers camera is the only camera allowed at the session because of distractions. Photographer also has the right to leave after 15min if the client has still not shown up to the session, and no refund will be issued. You are more than welcome to reschedule another session at full price after a no-show.

    5. Re-shoots / Refunds
    Re-shoots are determined at the discretion of the photographer. Re-shoots and refunds will not be given for poor choices of clothing, make-up, hair, weather related issues, children not cooporating, upset with personal appearance, or by not following the recommendations of the photographer. Once sesson has taken place and services have been given, refunds are not available. If for any reason the client is unhappy with their photos, a refund is not available since services have already been completed. However, the client has the option to receive one(1) mini session at no charge. This mini session is a 30min session and does not come with any digital images. Digital images from this session can be purchased at $20/ea or in sets of three for $50.

    6. Delivery/editing

    Brittany Deere Photography does NOT release any unedited images. Clients will only recieve fully edited images from the session. If for any reason the client needs an additional edit done to one or more images from their session, an additional $15 is required PER IMAGE thats needing ANY additional editing. Please remember that Brittany Deere is not a magician. She will not make you look like someone you are not and will not do any body altering. Your images will be finished anywhere from 1-2 weeks. Once the photographer is finished with your images, they will be uploaded to a gallery via pixiset and the link will be sent to you by email, text, or fb message. From there, you will choose the number of images you receive with your session that Brittany Deere has set in place. Once you have chosen your set number of images, you have the option to purchase aditional images for $20 each, sets of three for $50, or $175 for all should you want to purchase all additional images in your gallery. *Prices on digitals can change without notice* Galleries will be up for ten days. Enough time for you to look through and choose your images as well as order others. After ten days, the gallery will be taken down. If you need more time to look through your images, a fee of $50 is required to put the gallery back up for an additional 5 days.

    7. Archive
    All images will be purged after you have received your gallery and have dowloaded the images you have chosen. Some images will be kept as needed for promotional purposes, to be determined by photographer at photographer’s sole discretion.

    8. Damage
    Photographer is not responsible for the loss or damage of products/digital files/portraits etc. after delivery to client, including damage caused during transit by US mail. Client assumes all responsibility for the safety of all portraits/digitals upon receipt.

    9. Model Release
    I hereby give to Brittany Deere Photography the absolute and irrevocable right and permission with respect to the photographs that she has taken of myself and/or my minor child in which she may be included with others: a) To copyright the same in the photographer’s name or any other name that he/she may select; b) To use, re-use, publish and re-publish the same in whole or in part, separately or in conjunction with other photographs, in any medium now or hereafter known, and for any purpose whatsoever, including (but not by way of limitation) illustration, promotion, advertising and trade, and I hereby release and discharge photographer from all and any claims and demands ensuing from or in connection with the use of the photographs, including any and all claims for libel and invasion of privacy.

    10. Liability
    Photographer is not responsible for any injuries inflicted upon any participating parties. Client(s) will be responsible for their children and for themselves and release photographer from any claims against their person or their business.

    11. Copyright & Penalty
    Brittany Deere Photography retains all copyrights to all images created during client’s session. Cpyright and printing rights are two different things. The images that are being provided to you are licensed to you for any reasonable personal, including but not limited to: printing, emailing, and web publishing. Your license does not include use that results in financial gain, including but not limited to: advertising, stock photography, print sale profits, or resale of nature. Your purchase of the original files releases Brittany Deere Photography of any obligation to maintain copies of any digital file, image, or photograph. You hereby grant Brittany Deere Photography the right to use and publish images and photographs taken at your photography session to further promote its service, including portfolio, website, display, advertisement, and editorial use. Brittany Deere Photography agrees to limit the use of these images and photographs to promotional use only. Brittany Deere Photography may revoke this license at any time and for any reason. It is illegal to copy, scan, download, print, share, edit, alter, or otherwise steal any image created by Brittany Deere Photography during client’s photo session. This applies to "sneak peek" images, images posted in an Online proofing gallery, blog, Instagram, Facebook, hard copy images, etc. If client, or friend/family member of client steals images and or alters them via any method listed above, or any other method, client will be invoiced for the cost of EACH digital image the client has stolen, at photographer’s current price per digital file.

    12. Social Media
    I work very hard to create images that reflect you and your family, while keeping in line with my artistic vision and creativity. I know you will want to share them and include a sneak-peek for that very reason. However, if you are posting any of the digital files to social media (Facebook, Twitter, Pinterest, Instagram, etc.) you must give visible credit to Brittany Deere Photography. Please do not crop, alter, or edit the images in any way before publishing on the Internet (this includes the filters on instagram). Instead of right-clicking, saving, and sharing the image via your own page, please simply share the image (post) from my FB page by clicking the "share" button. I hope that you will respect not only my hard work, but the time, money, and dedication that I have put into training and equipment to capture these images for you and your family. Please do not steal them. If you purchase any hires files, the same thing applies to them as well, please do not alter, or edit them in any way before printing/sharing, and always give credit to Brittany Deere Photography.

    13. Session Requests
    No cameras/videos/any type of recording device (this includes cell phone cameras) are allowed during the session unless prior arrangement has been made between client and photographer, including a written agreement. The photographer will not continue if there are other cameras or video taping during the session. It causes distractions therefore taking the babies/ toddlers/ kids attention away from the photographer. Please do not bring any children or person(s) not being photographed to the session. Please make sure you arrive with a clean face, and clean combed hair. Please avoid eating or drinking red, blue, or orange food or drinks before session, as these colors tend to leave a stain on the face.

    Please understand that your Session starts at the agreed upon time. It is strongly encouraged that client arrives 10 minutes prior to the start of session. This allows for any last-minute needs, contract signing, and relaxing before session begins. Showing up late cuts into session time, which we cannot get back. We cannot freely reschedule if the client does not make it on time, we simply will just have a shorter session time, therefore a refund will not be issued. However, you are more than welcome to schedule another session at regular price.
