Vilz Concreting and Excavation Pty Ltd (hereafter "the Employer")  Meals and Rest Breaks Policy & Acknowledgement

Objective 

To set out the legal requirements relating to Meals and Rest Breaks and the    obligations of Employees and Employers.

Legal Requirements

Under the Building and Construction General On-site Award 2010 [MA000020] and National Employment Standards (NES) the following must be observed:-

Meal Breaks

1. Employees are entitled to an unpaid '30 minute' meal break after 5 hours of work.
2. This must be taken between 12:00 and 1:00 pm - unless otherwise agreed between the employee and employer.  

Rest Breaks

1. Employees are entitled to a paid '10 minute' rest break between 9:00 and 11:00am.
2. If employees are required to work at least 2 hours longer than the usual 8 hours, then employees are entitled to a further paid '20 minute' break immediately following the usual finishing time. 

Non-Compliance 

Non compliance with these legal requirements may result in fines and other penalties for the employer and disciplinary action for the employee.
