Birth Photography Contract

A note from A Blissful Birth:
Thank you for allowing me to photograph your upcoming birth! Hiring a birth photographer allows your support team to focus on you and baby during labor while ensuring those precious moments are photographed. Birth and labor are very unpredictable. I will shoot your birth as it unfolds, in a photojournalistic style. It is my goal to document your birth discretely and unobtrusively.

Client’s birth package includes:

Consultation
On call time From 37 weeks until birth
Unlimited time at your birth until 1-2 hours after birth
Professionally edited images
All high resolution digital images
Print Release

Terms: From hereon “photographer” refers to A BLISSFUL BIRTH Tranita Excellent Turner and “client” refers to the signers of this contract.

Copyrights and Model Release: The photographs produced by A BLISSFUL BIRTH are protected by Federal Copyright Law (all rights reserved) and may not be reproduced in any manner without A BLISSFUL BIRTH explicit written permission. If displayed on social networking sites, photos must say, “Photos by A BLISSFUL BIRTH” somewhere visible on the photo or on the information tab below each single photo. It is a breach of this agreement to alter the photographs in any way (cropping, altering color, etc). Upon gallery distribution limited copyright ownership of the resulting images will be transferred to the client under the following conditions:

1.) The photographic images are the property of client for personal use and for the purpose of the reproduction and giving of photographs to friends and relatives. 2) The client must obtain written permission from and compensate A BLISSFUL BIRTH prior to the client or the client’s friends and relatives publishing or selling the photographs for profit. The client hereby grants A BLISSFUL BIRTH and its legal representatives and assigns, the irrevocable and unrestricted right to use and publish photographs of the client or in which the client may be included, for editorial, trade, advertising and any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same. The client hereby releases A BLISSFUL BIRTH and its legal representatives and assigns from all claims and liability relation to said photographs.

Use of images online: A BLISSFUL BIRTH will never use an image of a sensitive nature without your consent. The client will have opportunity to view photos before being published online. It is the goal of A BLISSFUL BIRTH to document your birth discretely and unobtrusively.

Cancellation & Backup Policies: No refund is given for voluntary cancellations.

It is the photographer’s top priority to provide the services described here. If failure to attend the birth or send a back-up is due to the photographer’s error, the fee will be refunded. If it is due to circumstances beyond anyone’s control (e.g. an extremely rapid birth process), the client fails to call the photographer, or if the client chooses after 36 weeks of pregnancy not to utilize birth photography services, the full fee becomes non-refundable.

In the event of pregnancy loss, A BLISSFUL BIRTH will work with clients on a case-by-case basis.

Coverage: Coverage begins at active labor and continues until up to 2 hours after birth. A BLISSFUL BIRTH will be on-call 24 hours a day from 37 weeks gestation until delivery. The client is responsible for contacting A BLISSFUL BIRTH during labor. Fees are not refundable if the client fails to notify A BLISSFUL BIRTH when the client is in labor. It may take up to 2 hours for the photographer to join you. Every reasonable effort will be made to photograph requested images, but no specific image can be promised. Images determined by the photographer to be substandard or duplicated may be edited out. A BLISSFUL BIRTH will use her professional judgment and sole discretion to select which photos to deliver.

Birth Facility Guidelines: In regards to birth photography, A BLISSFUL BIRTH is limited by the guidelines of the hospital policies. Client agrees to accept the technical results of their imposition on the photographer. A BLISSFUL BIRTH agrees to work with the medical staff to photograph the birth entirely. In case of a c-section, it is up to the doctors and hospital staff to allow A BLISSFUL BIRTH into the operating room. If the photographer is not allowed into the operating room, he/she will photograph as much as possible before and after the birth. No refund, full or partial, is given due to a c-section or hospital transfer. A BLISSFUL BIRTH does not assume any medical responsibility and is not a medical professional.

Payments: $200 deposit is required to hold client’s due date on A BLISSFUL BIRTH’s calendar. This deposit is non-refundable. Full payment of birth package is due by 37 weeks gestation.

If client does not pay the birth package balance in full by due date

Client will not receive products, images or a sneak peek until balance is paid

Delivery of images: Client will receive digital images via digital download 14 business days after giving birth or after birth balance is paid in full (whichever is later). Client will receive album (if purchased) within 14 business days after images and spreads are approved. The images will include black and white as well as color images. It is the photographer’s artistic choice to determine which images are black and white and which are color.
