    I,  {printName} (“Releasor”), voluntarily sign this Release of Liability & Assumption of Risk Agreement in favor of Daniel Strat, Lennie Strat & 5161 Classic LLC

    (“Releasee”) in consideration for the opportunity to use the Property Owner’s facility located at 5161 Classic Drive, Tobyhanna, PA 18466.

    HEREBY RELEASE, DISCHARGE, AND COVENANT NOT TO SUE RELEASEE, their respective administrators, directors, agents, officers, members, volunteers, and employees, other participants, any sponsors, advertisers, and, if applicable, owner and lessors of premises on which the Activity takes place FROM ALL LIABILITY, CLAIMS, DEMANDS, LOSSES, OR DAMAGES ON MY ACCOUNT CAUSED OR ALLEGED TO BE CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE "RELEASEES" OR OTHERWISE, AND I FURTHER AGREE that if, despite this RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT I, or anyone on my behalf, makes a claim against any of the Releasees, I WILL INDEMNIFY, SAVE, AND HOLD HARMLESS EACH OF THE RELEASEES from any litigation expenses, attorney fees, loss, liability, damage, or cost which may incur as the result of such claim. I HAVE READ THIS AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT AND HAVE SIGNED IT FREELY AND WITHOUT INDUCEMENT OR ASSURANCE OF ANY NATURE AND INTEND IT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW AND AGREE THAT IN THE EVENT THAT ANY OF THE PROVISIONS OF THIS AGREEMENT ARE HELD TO BE INVALID OR UNENFORCEABLE IN A COURT OF LAW, IN WHOLE OR IN PART, ALL OTHER PROVISIONS WILL NEVERTHELESS CONTINUE TO BE VALID AND ENFORCEABLE WITH THE INVALID AND UNENFORCEABLE PARTS SEVERED FROM THE REMAINDER OF THIS AGREEMENT.

    I, the undersigned, acknowledge that I have carefully read this release of liability/assumption of risk and understand its contents. I am aware that by signing this release, I am waiving certain legal rights, including the right to sue the Property Owner for any reason.

  • HOUSE RULES FOR GUESTS

  • To ensure your stay is safe, comfortable and enjoyable, all guests must comply with all House Rules and safety measures during their stay.

    • AMENITIES

    a) Only use appliances for their intended uses.

    b) Keep the property and all furnishings in good order.

    c) BARBEQUE GRILL

    1. Turn off the propane tank after use.

    2. Put out fire after use of coal burning grill.

    d) WOOD BURNING FIRE PIT

    1. Do not move unit anywhere other than its original location.

    2. Don’t use flammable fluids (gasoline, lighter fluid, etc to light fire.

    3. Make sure to keep children away from the fire.

    4. Put out fire after use.

    e) FIREPLACES

    1. The fireplace in the living room is a vented propane gas firebox. Please do not throw any paper or other combustible materials into the fireplace.

    2. The fireplace in the Sunroom is a ventless propane fireplace. Please limit the use to no more than 3 hours at a time.

    3. Keep children away from fireplaces.

    4. Use remote control to turn on the fireplaces.

    f) SWIMMING POOL

    1. No lifeguard is on duty. SWIM AT YOUR OWN RISK.

    2. To ensure your security and faster response time in case of emergencies, the swimming pool must not be used after 10:00pm.

    3. Children are only allowed in the pool with adult supervision. The door to the pool and the sliding glass doors must be locked at all times, especially at night.

    4. No breakable glassware or wine/beer bottles are permitted in the pool area.

    5. Please bring life jackets/vests especially for kids - must wear before jumping in the pool.

     

    • COMPLIANCE

    a) Breach of these House Rules is a breach of the Rental Agreement.

    b) The Owner/ Authorized agents reserve the right to terminate permission to occupy and to evict from the Property, Guests or Visitors who refuse to follow these House Rules or who cause a nuisance.

     

    • DAMAGE AND BREAKAGES

    Damages and breakages must be reported to the agent/owner as soon as possible. We understand that accidents happen. But we do ask that you please let us know when they do. Chances are we can fix them as effortlessly as possible which also means better chances of having your full security deposit returned too.

    • GARBAGE AND RECYCLING

    a) Guests are to dispose of garbage and recycling in the allocated bins located on the deck. Make sure lids are snapped shut to keep animals out.

    b) At departure, please deposit all trash from the house and the deck to the large green totes located at the front of the house, and bring to the curb on Sunday evening assuming your stay falls on a Sunday.

     

    • GATHERINGS OR FUNCTIONS

    The Property is not a “party house” and any such activities are strictly prohibited without prior consent (this means no inviting other guests other than pre-registered guests)

     

    • GUEST PASSES

    If you would like to use the communal amenities at PCP (Pocono Country Place) outside the home, personal passes are in the Guest Manual. You will need this in order to use PCP’s community beach/pool/tennis courts, etc. Please make sure to return all passes before departure or there will be a charge.

     

    • HOUSEKEEPING

    There is no daily housekeeping service. While linens and bath towels are included in the unit, daily maid service is not included in the rental rate. We do not permit towels or linens to be taken from the residence.

     

    • ILLICIT DRUGS IS PROHIBITED AT ALL TIMES!

    Guest agrees not to possess, use or sell any illicit or illegal drugs.

     

    • NOISE

    a) Guests and Visitors must minimize noise level to not disturb residents from neighboring properties especially between 10pm-9am, and during arrival and departure at any time throughout the occupancy;

    b) Offensive noise is prohibited and may result in termination of permission to occupy the Property, loss of rental paid, and/or extra charges may be deducted from the security deposit. Pocono Country Place / Public Safety strictly enforces this regulation and will charge a fine for requiring their visit to the property to investigate and resolve. This charge is the sole responsibility of the Guest and will be deducted from the Refundable Damage Deposit accordingly.

     

    • PARKING

    Parking is limited to 4 vehicles. Vehicles are to be parked in the driveway only. Street parking is not permitted. Any illegally parked cars are subject to towing; applicable fines/towing are the sole responsibility of the vehicle owner.

     

    • PETS

    Pets are not permitted at this property.

     

    • SECURITY

    a) To ensure full safety of our guest’s belongings, please close and lock all windows and doors especially when absent from property.

    b) Turn off all electronics, fireplaces, oven and stove when not in use or when absent from property.

     

    • SEPTIC

    Feminine products should not be flushed at anytime. If it is found that feminine products have been flushed and have clogged the septic system, the Guest will be charged up to $500.00 to resolve the problem.

     

    • SMOKING

    Smoking is NOT allowed inside the property including the pool area. Smoking is allowed outside only and all remnants (butts, matches, etc must be appropriately extinguished and discarded to avoid an excessive cleaning fee in preparation for our next guests.

     

    • VISITORS

    No visitors other than registered guests are allowed. a) The maximum number of Guests permitted at the property must not exceed a maximum of 12 persons.

    b) People other than those listed in the Guest party as set forth on the rental agreement, may not stay overnight in the property. Any other person on the property is the sole responsibility of the Guest. Guests are not allowed to exceed the occupancy limit (12) without Owner pre-approval.

  • The Property Owner or Authorized Agents are not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. The Property Owner or Authorized Agents are not responsible for the loss of personal belongings or valuable of the guest. By accepting this reservation, it is agreed that all guest are expressly assuming the risk of any harm or loss of valuables for their use of the premises or others whom they invite to use the premises.
