Covid-19 Aqua Park Assumption of Risk
and Release of Liability Form

In consideration of being allowed to access and utilize the facilities of the Aqua Park, the undersigned Participant, or the parent/guardian(s) if the Participant is a minor, hereby agree to the fullest extent permitted by law to the following:

WAIVER

The Participant or his/her parent(s)/guardian(s) waive all claims against the Aqua Park in participation or conduct of any activity within the premises or the use of its facilities; 

RISK ASSUMPTION

The Participant or the Participant's Parents or Guardians understand that there are inherent risks involved in participating in the activities or the use of the facilities or equipment of the Aqua Park, such as but not limited to, the transmission of communicable diseases like COVID-19. In this regard, the Participant or the Participant's Parents/Guardians assume the risks involved in participating in the Activities and in using the facilities of the Aqua Park, including the hazards which may result in an accident, injury, or death caused by negligence whether by the Aqua Park or the participants in the premises. 

INDEMNIFY, RELEASE, AND HOLD HARMLESS

The Participant or the Participant's Parents or Guardians hereby indemnify, release, and hold harmless the Aqua Park, its owners, officials, affiliates, operators, employees, agents, or representatives, from any and all claims, liability, loss, injury, damage, expenses, or death by which the Participant or the parents/guardians may suffer, arising out of the Participant's involvement to any of the activities or use of any of the Aqua Park's equipment or facilities, or from which may have resulted from negligence, except which would be construed as gross negligence, incompetence, or reckless imprudence. 

PARTICIPANT'S DECLARATION AND RESPONSIBILITY

Participant or the parent(s)/legal guardian(s) hereby acknowledge that Participant's participation in the Activities or the use of the Aqua Park's facilities and equipment is voluntary.

Participant or the parent(s)/legal guardian(s) hereby declare that Participant has no physical disability or mental condition that may render his or her inability to participate in the Activities hosted by or conducted in the Aqua Park or in any case of which is against any medical advice.

Participant or the parent(s)/legal guardian(s) hereby acknowledge that the Aqua Park is not fully guided; the conduct of any activity in the venue shall render risk on the Participant. Briefing and orientation shall be conducted prior to the beginning of the activity. The Aqua Park may at anytime exercise the right to prohibit visitors or participants who may show an unwillingness to follow guidelines and/or policies set forth by them.

The Participant or his/her parent(s)/legal guardian(s) understands hereby his/her obligation to comply with the rules and regulations of the Aqua Park for the prevention of any risk of injury. Further, the Participiant or his/her parent(s)/legal guardian(s) further understand that it shall be their responsibility to inspect the equipment and facilities prior to any participation by the Participant.

It shall be the responsibility of the Participant or the parent/legal guardian to address the hazard he or she may find in the premises of the Aqua Park, or notify the Aqua Park in case he or she finds the unusual hazards by which he or she cannot address himself/herself, that may affect the enjoyment of the participants. 

RULES AND REGULATIONS

While in the water, it is necessary that the following shall be abided by the participant:

1. Before entering the facility, each one shall undergo a triage (temperature check and self-assessment) whether or not one is suspected to be infected with COVID-19;
2. No swimming under or beneath the features of the Aqua Park;
3. Make sure to look around first before you jump on the water;
4. When diving, make sure that you are diving on the water with sufficient depth;
5. Minors up to 12 years old must be accompanied by a parent or guardian in order to use Aqua Park;
6. Minors up to 12 years old must wear at all times a personal flotation device;
7. Sandals, slippers, or shoes are not allowed in the water;
8. Always exercise proper etiquette and always show good manners and right conduct;
9. Drinking near the pool is not allowed;
10. Anyone who appears to be under the influence of alcohol or drugs are not allowed;
11. People with open wounds are not allowed;
    Always store your valuables in the designated lockers;
12. If a lifeguard is unavailable, you may swim at your own risk;
13. In case a participant has been requested to leave the vicinity due to any of the violations in the Aqua Park's rules and regulations, no refunds shall be allowed.
