PORTRAIT AGREEMENT & MODEL RELEASE: I have read and agree to the following statement: I commission Karmic Kreative Photography (KKP), the photographer, to photograph myself and/or family. I hereby grant KKP and her legal representatives and assigns, the irrevocable and unrestricted right to use and publish photographs of myself and/or family in which myself and/or family will be included for editorial, trade, advertising, and any other purpose and in any manner or medium; to alter the same without restriction; and to copyright the same. I hereby release KKP and her legal representatives and assigns from all claims and liability relating to said photographs. *

COPYRIGHT: As a client of KKP, I acknowledge and understand that the images taken by KKP, PHOTOGRAPHER; Michaela Ertle, are protected by Federal Copyright Laws. I understand it is ILLEGAL to copy or reproduce these photographs elsewhere without the PHOTOGRAPHER's permission, and violators of this Federal Law will be subject to its civil and criminal penalties. A limited PRINT RELEASE is available to purchase after the session is completed for individual files or entire session to print your portraits for your own personal use. The print release does not allow publication of your portraits (i.e. entering in contests), selling or altering your images without the PHOTOGRAPHER's permission. Reproduction includes, but is not limited to scanning, downloading, right-clicking, emailing, saving to hard drive, posting on websites or blogs, photocopying, obtaining screen shots, or printing in any manner. I agree to honor the copyright laws as stated in this agreement. *

All balances are due in full before sessions take place. A nonrefundable retainer fee of 50% down must be paid to book a session, and the remaining balance paid atleast 24 hours before the session date. If client has arranged a payment plan, the session will be scheduled after the final payment has been received. Clients are responsible for any additional charges by 3rd party for online payments.

If there are any costs/fees associated with the location the client has chosen for their session, the client will be resposible for those fees and they will be added to the session fee of the client prior to the session. This should be discussed with photographer prior to session. The photographer will arrange payment and location once the balance of the session fee is paid. Creative fee covers travel within 30 minutes of Local City:Phoenix,Las Vegas , Cleveland ,Akron,Canton,Alanta , Miami or NewYork City area unless decided by photographer. Any location outside of these limits will be subject to an additional charge of $1.00/mile as part of the agreement. *

If an illness or situation prevents a photo session from taking place, client may reschedule their session at least 24 hours prior to their shoot without penalty. Should client fail to give 24 hours notice, or decide to completely cancel the shoot, this session fee is forfeited and will not be refunded. Photographer reserves the right to reschedule due to illness, weather, equipment malfunction, or other circumstances beyond their control. Limit to 2 reschedules by client before session fee is forfeited or photographer can charge a $50 rescheduling fee to her discretion. *

Re-shoots due to uncooperative family members or unsatisfied clients will be at the discretion of the photographer and clients will be liable for added $50 fee for a separate day and session. There will be NO re-shoots for those due to tardiness or no shows. Refunds are not available once payments are made. Balance MAY be applied to a separate session at the discretion of the photographer, but no shows or rude/hostile communications are not applicable for re-shoots. Re-shoots and refunds will not be given for circumstances outside the photographer's control IE poor choices of clothing, make-up, hair or weather related issues, or by not following the recommendations of the photographer. Refunds and discounts will NOT be issued for makeup/hair services as they are a gratituity service provided by the photographer and do not effect the price of a session. Photographer holds no liability to the salon hired for hair and makeup and is not liable for mistakes made out of her control (IE scheduling conflicts, late for appointments, client unhappy with results, etc.) Although the session fee may be transferred to a seperate session of same value at the discretion of the photographer.

Prints, products and digitals are available to purchase after the session edits are completed and the online gallery is delivered. Print minimums are $75 and photographer is not liable for any shipping interference or product damage from the printing lab. Print, product and digital costs are liable to change at any time without notice. Online galleries will be available with your images and will expire after 30 days. If client requests gallery to be re-uploaded after the 30 day printing period, a fee of $15 will be charged for all re-uploaded galleries. Prints will be shipped to photographer and hand delivered to you unless distance requires otherwise. After six (6) months, all images will be purged from photographer’s hard-drive, except as needed for promotional purposes, to be determined by photographer at photographer’s sole discretion. Photographer is not responsible for loss or damage to the digital files due to circumstances beyond photographer’s control. *

Photographer is not responsible for the damage or loss of portraits, products, and/or digital files after delivery to client, including damage caused during transit by US mail. Client assumes all responsibility for the safety of all portraits upon receipt. If photographer experiences harassment or hostile behavior from clients or friends/family of clients before, during or after session, photographer holds the right to end a session and cease any further editing with no moneys returned or reshoots. Clients must agree on a mutual trust and respect to and with photographer. If photographer feels threatened at any time, photographer will forfeit olbigation to any owed work to the client.

The final post production and editing styles, effects, and overall look of the images are left to the discretion of the photographer. Your images will be delivered via an online gallery 30 days after the session date. Some session delivery times may vary depending on workload of the photographer or circumstances out of their control. Your gallery will expire after 30 days, so any orders of prints/products and digital downloads must be made within your 30 days. Any request to reupload galleries will be subject to a $15 fee for another 30 days. Sneak peeks may be posted online at the discretion of the photographer but are not required. Photographer has the final say on all images selected for the gallery and is not liable to refund or reshoot for clients unhappy with the images unless they do not meet the photographers usual standard. All final decisions for the chosen and culled images fall to KKP. Additional edits may be requested, but are subject to an edit fee of $10 per image for extra editing and special requests. Any additional editing or filters applied to the images by the CLIENT or parties that are NOT the photographer are copyright infringement and may result in legal action. This includes but is not limited to instagram filters, photoshop, overlays, editing out a watermark or sending the images to be professionally retouched without the consent of KKP.

By signing below you certify that You are at least 18 years of age. You have read this portrait agreement/contract and fully understand the contents thereof. You agree that you have the legal authority to grant these permissions and accept all responsibility for such. *

A non-refundable retainer fee/deposit of 50% of any session balance is due upon booking in order to reserve your Session. If paid by Paypal, client must also cover fees associated to the payment deducted by Paypal. All remaining Balances are due at least 24 hours prior to the session. No part of any order, including proofs will be delivered until the balance is paid in full. Your desired session is not reserved until the deposit is received full and clear. Therefore, the deposit is non-refundable. If you cancel with less than 48 notice, you forfeit your deposit and may not reschedule without a new deposit. Re-scheduling may occur to save your deposit if you give at least 48 hours notice and the session is rescheduled within 2 weeks of the original reserved date or if there is a family emergency or serious illness. I cannot always guarantee an available date two weeks out but will try my best to accommodate. Re-scheduling of the session due to bad weather may occur at photographers discretion only. Sessions that include (optional) professional hair and makeup and may include some props at photographers discretion. Hair and makeup services do not effect session fee. Therefor, not taking advantage does not discount the session *
