  • State law requires real estate licensees acting as agents of landlords or tenants of real estate property to provide information about the types of real estate services being offered or the nature of rights and obligations the relationship creates.This disclosure should help the parties make informed decisions about the relationship with the broker and agents.

  • Limited Landlord's Agent

    The agent for the landlord shall comply with the following: 

    • Agent may not disclose any confidential information of the landlord to any party unless required by law.
    • Agent may be required to disclose to a tenant otherwise undisclosed adverse material facts about the property.
    • Agent shall present all written communication, offers, and counteroffers by the principal parties in a timely manner.
    • Agent shall exercise reasonable skill and care that is to the best interest of the landlord.

    A written agreement is required to create a landlord’s agency relationship

  • Limited Tenant's Agent

    The agent for the tenant shall comply with the following:

    • Agent shall not disclose any personal or confidential information of the tenant without the consent of tenant unless such disclosure is required by law.
    • Agent may disclose to the other party any material information related to the tenant's capacity to enter into an agreement.
    • Agent shall present all written communication, offers, and counteroffers by the principal parties in a timely manner.
    • Agent shall exercise reasonable skill and care that is to the best interest of the tenant.

    It should be noted that a written agreement is not necessary to create an agency agreement between the tenant and said agent.

  • Limited Dual Agent

    An agent who works for both the tenant and landlord shall comply with the following standards of requisites:

    • Agent shall not disclose to the landlord that tenant is willing to consider paying more than the price offered.
    • Agent shall not disclose to the tenant that the landlord is willing to consider a lower price for its asking price.
    • Agent shall act in favor towards the benefit of only one party
    • Agent shall exercise reasonable skill and care for both parties

    It is necessary that the disclosure and consent is given by both parties as to dual agency.
