Amenity Release Waiver

In consideration of the Company in allowing me to use its facilities and other amenities (“Amenities”), I hereby execute this Amenity Release Waiver ( “Waiver”) agreeing and acknowledging herein the following:

1. I understand and acknowledge the existence, contagious nature, and impact of the coronavirus (COVID-19) in the country as well as globally.
   
   
2. I understand and acknowledge that as declared by the World Health Organization (WHO), a person may be exposed and infected with COVID-19 from the spread of respiratory droplets when an infected person coughs, sneezes, or speaks, as well as by touching a contaminated surface and thereafter touching their eyes, mouth or nose.
   
   
3. I understand, acknowledge, and knowingly assume the risk in traveling to and from the facility and the use of the Amenities poses a risk of exposure to COVID-19 as well as other viruses that are hazardous to one's health that may lead to serious illness, injury, or death.
   
   
4. In case I exhibit any symptoms relative to COVID-19 (i.e. flu, dry cough, fatigue, headache, loss of taste or smell), have been exposed to a person infected or is being observed to be infected with COVID-19, I will not use the Amenities and isolate myself from the public for 14-days. I will proceed with the recommended quarantine guidelines, including compliance with the necessary tests for COVID-19 infection.
   
   
5. I understand that the Company reserves the right to restrict or revoke our right to use the Amenities at any time for any reason that the Company may deem appropriate. 
   
   
6. In the event that I use the Amenities, I will, at all times, practice the appropriate distancing, sanitary, and health care protocols such as covering my nose and mouth when coughing and sneezing, washing my hands frequently, and disinfect areas that I will touch, in accordance with the governmental guidelines.
   
   
7. I hereby release, waive, and forever discharge, defend, covenant not to sue, and fully indemnify the Company to the full extent allowed by law, its affiliates, officers, members, directors, agents, and employees from any form of claim, cost, liability, cause of action, and liabilities out of or related to any loss, personal injury, damages or death related to COVID-19 or other infectious diseases of whatever kind and nature, known or unknown, anticipated or unanticipated arising from or in any way related to the use of the Amenities.
   
   
8. In the event that any of the portions of the waiver hereto is deemed to be invalid or unenforceable by any competent court, such invalidity shall affect only the said provision and the remaining provisions hereto shall remain valid and enforceable.
   
   
9. This Waiver shall be construed in accordance with the laws of the State of California, to the exclusion of other state laws and jurisdiction.

By signing this Waiver, I certify that I have read and fully understand the contents provided hereto. I am signing this document voluntarily as my own free act and deed without any oral representations or inducements.
