Use and Property Occupancy
The property under lease is designated for residential use only and can only be inhabited by the individuals registered. If the number of occupants exceeds the specified limit, the Lessor/Landlord should be notified.
Assignment and Subleasing
The Tenant is prohibited from assigning or subleasing any portion of the Property without prior consent from the Landlord.
Rent Payments
Upon the commencement of this agreement, the Tenant is responsible for paying the first month's rent in advance, along with a security deposit. Monthly rent must be paid in full on the specified schedule each month without requiring notice from the Landlord. The Tenant may choose to pay in installments, provided there are no defaults under the Lease agreement terms.
Abandonment
If the Tenant leaves the Premises during the Lease term, the Landlord may, at their discretion, enter the Premises through legal means without incurring any liability to the Tenant and may opt to terminate the Lease.
Necessary Expenses
The Lessee/Tenant may seek reimbursement for expenses incurred for property repairs during their stay, provided that the Landlord is notified in advance. These necessary expenses may include, but are not limited to, repairs such as those related to the roof, windows, walls, or any essential maintenance to preserve the leased property, caused by normal wear and tear, force majeure, Acts of God, or damages resulting from civil disturbances not caused by the Lessee/Tenant.
Legal Proceedings
Any legal actions arising from or related to this Agreement must be filed with the appropriate courts in New York City, with all other possible venues expressly waived by the parties. In case of an action due to a breach of this Agreement's terms and conditions, the aggrieved party is entitled to attorney's fees equal to twenty percent (20%) of the awarded sum, but not less than $20,000.00, plus the costs of the suit and expenses related to litigation as determined by the court.
Property Improvements
Any improvements or constructions made to the Leased Property by the Lessee/Tenant before or during the Lease Agreement's term become part of the Landlord's real property.
Pets
The Lessee/Tenant may not keep any pets on the Premises without the prior consent of the Lessor/Landlord. The Lessee/Tenant is responsible for maintaining the cleanliness of the Premises and for any damage caused by their pet during the Lease Agreement's duration.
