Liability Waiver & Release Form
Liability Waiver & Release Form MUST be completed by all clients and submitted to The 1 Fitness & Performance, LLC prior to participating in any activities or purchase of fitness/training programs. If client is under the age of 18, this form must be completed by their parent or legal guardian.

In consideration for the rights and privileges associated with participation in weightlifting, aerobics, personal training, cross-fit, circuit training, athletic, strength, agility, speed, and/or performance training (hereby referred to as “the Activity”) under the guidance of The 1 Fitness & Performance, LLC, the Client acknowledges and agrees to be bound by the following:
INDEMNIFICATION OF RISK: Participation in (“the Activity”) or other rigorous exercises, including but not limited to preparation for and participating in (“the Activity”), involves risks of serious injury, including permanent disability, death, and other losses, both to the Client and their property. The Client understands that these injuries and losses might result not only from their actions, but the actions, inactions or negligence of others.

ASSUMPTION OF THE RISK: The Client is responsible for their safety while participating in (“the Activity”) and that such responsibility includes participating in (“the Activity”) only when physically and psychologically prepared to participate safely. The Client assumes all risks connected with responsibility for any injury or loss connected with the Client's participation in (“the Activity”).

WAIVER: The Client hereby waives, releases and holds harmless The 1 Fitness & Performance, LLC and each of this organization’s members, managers, employees, agents, coaches, trainers, volunteers, doctors, event organizers or sponsors, if any (hereby referred to as “Releasees”) from all claims, or any organizations on the Client’s behalf, for any liability, injury, loss or damage in any way connected with participation in (“the Activity”), except where caused by the gross negligence or willful or wanton misconduct of any of the ("Releasees"). This Waiver and Release also applies to any spouse, relatives, personal representative, heirs, beneficiaries, next of kin or assigns who might pursue any legal action or claim on the Client’s behalf.

INSURANCES: It is the Client’s sole responsibility to maintain adequate medical insurance and understand that The 1 Fitness & Performance, LLC is not responsible for and will not be providing this coverage.

PHYSICAL ABILITY: The Client will be participating in (“the Activity”) under the guidance of The 1 Fitness & Performance LLC. The Client agrees that they have been examined by a licensed medical physician prior to participation in (“the Activity”) and is aware of no physical limitations or adverse health risks associated with participating in (“the Activity”). If the Client later becomes aware of any physical limitation or adverse health risks associated with participation in (“the Activity”), the Client will immediately cease participation and notify The 1 Fitness & Performance, LLC of said condition.

USE OF PHOTOGRAPHS/VIDEOS CONTAINING MY LIKENESS: Throughout participation in (“the Activity”), photographs and/or videos will be taken which may include the Client engaging in the performance of (“the Activity”). The Client authorizes and allows any such photograph(s) and/or video(s) to be used by The 1 Fitness & Performance, LLC for any lawful purpose including, but not limited to, marketing, sales and merchandising.
