AGREEMENT TERMS
PLEASE NOTE! - SESSIONS DO NOT ALWAYS TAKE UP THE FULL 30 MINS! SOMETIMES IT TAKES LESS TIME TO CAPTURE PHOTOS IF PARTICIPANTS ARE COOPERATING WELL!
NO COMPOSITES WILL BE DONE FOR CHILDREN UNDER 3 YEARS OLD. They aren't old enough to follow direction on posing for a composite.
ANY DAMAGE DONE TO STUDIO AND/OR OUTDOOR PROPS, WILL BE PAID AT THE EXPENSE OF THE CLIENT! UNTIL DAMAGE IS PAID FOR, PHOTOS WILL NOT BE GIVEN!
SINCE PHOTOGRAPHER PICKS THE BEST PHOTOS OF YOUR SESSION, PHOTOGRAPHER IS NOT OBLIGATED TO GIVE YOU MORE IMAGES IF THERE ARE CERTAIN IMAGES YOU DO NOT LIKE!
PAYMENT:
All payments are due in full BEFORE SESSION STARTS. Orders will not be processed until payment in full is received. DATE IS NOT BOOKED UNLESS YOU HAVE SIGNED THE CONTRACT AND HAVE PAID YOUR RETAINER FEE. WITHOUT CONTRACT SIGNED, PHOTOSHOOT WILL NOT GO ON. WITHOUT RETAINER FEE, NO DATE IS SET.
MINI PHOTOSHOOT PORTRAIT SESSION:
Client is guaranteed up to A HALF HOUR of shoot time for a portrait of individuals discussed before session time and date. PLEASE NOTE: IF YOU NEED ADDITIONAL TIME - THERE WILL BE A $20 FEE FOR EVERY 15 MINUTES OVER YOUR SCHEDULED TIME. Any individuals not discussed to partake in this session will have an added fee of 10$. Portraits with two or more individuals may require additional time and the aid of an assistant. If you are late, this cuts into your time! If you are more then 10 minutes late, we will not be able to take your photos unless there is an open time that follows your photoshoot appointment. It is not gaurenteed if you are late that your photos will be taken. Please arrive 5 minutes early so you do not run into this problem.
SESSION PROOFS:
Client will receive 1 proof photo within 5 days after their shoot of their portrait session IF full balance is PAID IN FULL. Photographer retains the right to edit the photographs and omit any image. Please allow 1-2 weeks for photos to be edited and placed in your online gallery. You will be notified once you gallery is completed and given a link. You have up to 1 week to download your gallery before it expires. A gallery that expires will have an added charge of $10 to be placed into a new album if you do not download your gallery on time.
COPYRIGHT & PENALTY:
Sweet Moments Photography retains all copyrights to all images created during client’s session. It is illegal to copy, scan, download, print, share, alter, or otherwise steal any image created by Sweet Moments Photography during client’s photo session. This applies to "sneak peek" images, images posted in an online proofing gallery, blog, Facebook, or hard copy images. If client steals images via any method listed above, or any other method, client will be invoiced for the cost of EACH digital image client has stolen, at photographer’s current price per digital file, if failed to pay, legal action will be taken. - NO RAW IMAGES WILL EVER BE GIVEN OUT. ALL PHOTOS WILL BE IN THE CORRECT FORMAT AND EDITED! THE IMAGES GIVEN WILL BE THE BEST PHOTOS TAKEN AND ARE AT THE DISCRETION OF THE PHOTOGRAPHER.
CANCELLATION/POSTPONEMENT:
Client understands that by entering into this agreement, Photographer is foregoing other photographic jobs. In the event of a cancellation or postponement of the portrait session/agreement by Client, the retainer fees paid are non-refundable. Retainer fees are non transferable.
WEATHER:
If it is not possible for a session to take place on a scheduled day due to weather, Photographer and Client will reschedule on an agreed date at the earliest date possible, with no additional charge.
COOPERATION/NO SHOWS:
Photographer is not responsible if Client and/or key individuals fail to appear or cooperate during portrait sessions, or for missed images due to details not revealed to Photographer. If Client and/or key individuals fail to appear to a scheduled portrait session, the retainer fee is non-refundable. The session can be rescheduled at the original portrait session fee, including an additional 50% retainer fee.
RESHOOTS:
In the unlikely event that Client is completely dissatisfied with the final results based solely on personal preference, Photographer will reshoot at a 25% discount from the original session fee. Client is then able to order prints from the second portrait session only. In the unlikely event that the finished product from a portrait session is unusable due to technical problems, (camera failure or exposure problems), Photographer will reshoot at no additional charge.
COPYRIGHT:
All images are copyrighted to and remain the property of Amanda Korhonen also known as Amanda Perez - Sweet Moments Photograph.
CLIENT’S USAGE:
Client is obtaining prints for personal use only, and shall not sell said prints or authorize any reproductions by parties other than Photographer. Prints for publication (such as editorial, public relations or advertising use) require prior written consent from Photographer. A credit line which reads “Amanda Perez or Sweet Moments Photography” in type no smaller than that of the related text must appear adjacent to or within all permitted published photographs.
MODEL RELEASE:
Client grants to Photographer and her legal representatives and assigns, the irrevocable and unrestricted right to use and publish photographs of Client, Client’s child/ren, and any adults listed in this contract or in which Client may be included for editorial, trade, advertising and other purposes, and in any other manner and medium; to alter the same without restriction; and to copyright the same. Client hereby releases Photographer and her legal representatives and assigns from all claims and liability relating to said photographs.
EXHIBITION:
Client grants Photographer permission to display selected images resulting from this assignment as an example of Photographer’s work and for entrance into photographic competitions and releases all claims to profits that may arise from use of images.
ARCHIVE:
After one (1) month, all images will be purged from photographer’s hard-drive, except as needed for promotional purposes, to be determined by photographer at photographer’s sole discretion. Photographer is not responsible for loss or damage to the digital files due to circumstances beyond photographer’s control. If more copies are requested - there will be an additonal fee of $50.00.
LIMIT OF LIABILITY:
I take the utmost care with respect to the exposure, retouching, and transportation of digital captures, proofs and prints. However, in the unlikely event that all the originals are lost, stolen, damaged or destroyed within or beyond Photographer’s control, Photographer’s liability is limited to the refund of all payments received, or a reshoot can be scheduled at no additional cost. The limit of liability for partial loss or damage of originals shall be a prorated amount of the total amount, based on the percentage of originals lost or damaged. In the unlikely event that Photographer is injured or becomes too ill to attend the portrait session, Photographer will make every effort to reschedule to the earliest possible date. If the situation should occur, and the portrait session must take place on the scheduled date, Photographer will make every effort to secure a replacement photographer. If the situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received.
PRINT LIFE:
Client is aware that color dyes and inks in prints may fade or discolor over time due to the inherent qualities of dyes and inks, and Client releases Photographer from any liability for claims whatsoever based upon the fading or discoloration due to the inherent qualities. If client is going elsewhere for printing, client releases photographer of any mishappenings from going elsewhere - in other words - photographer is NOT responsible for you going to print elsewhere and not receiving the quality that would be provided from said photographer.
CHANGES TO THIS AGREEMENT:
There may be additional charges if changes are made to this agreement. Client may increase the period of Photographer’s service on the portrait date, provided Photographer is available during the time requested. Added expenses resulting from such change, including additional service cost, digital capture costs, and change-related fees will be added on to the final balance and will be paid in full by Client prior to delivery of the proofs. Client may not decrease the period of Photographer’s service on the portrait date. If the period of Photographer’s service is cut short by reason of fire, casualty, death, act of God or other cause beyond the control of the parties, Photographer shall still receive the total fees discussed.
PORTRAIT FEES:
Portrait fees include an initial telephone, Facebook Messenger or in-person consultation with Photographer, a half hour session (more time may be required for groups), and a proof/s containing the photographs from our session. Additional travel fees are required for shoot locations outside of the Greater Milwaukee Area.
SESSION REQUESTS:
No cameras/camcorders/any type of recording device (this includes cell phone cameras) are allowed during the session unless prior arrangement has been made between client and photographer, including a written agreement. The photographer will not continue if there are other cameras or video taping during the session.
Session starts at the agreed upon time. It is strongly encouraged that client arrives 5-10 minutes prior to the start of session. This allows for any last-minute feeding, changing, and relaxing before session begins.
Please do not bring any children or adults not being photographed to the session.
Please make sure hair is combed and face is clean and free of runny noses or eyes.
If you or your child are sick, PLEASE reschedule. I rather have a reschedule then someone else becoming sick or you - your child/ren not being well for photos.
Please avoid eating or drinking red or orange food or drinks before session, as red and orange tend to leave a stain on the face.
NOTE FROM PHOTOGRAPHER:
I work very hard to create images that reflect you and your family, while keeping in line with my artistic vision and creativity. I know you will want to share them and include a sneak-peek for that very reason. However, I ask that you simply link back (or tag) to my blog/website/facebook page instead of right-clicking, saving, and sharing the image via your own page. I hope that you will respect not only my hard work, but the time, money, and dedication that I have put into training and equipment to capture these images for you. Please do not steal them.
YOUR FEES:
As discussed - ($60.00 grand total for the mini portrait package up to 5 people. No additional people can be added unless you pay $10 extra per each person) - $20.00 retainer fee payment has already been received thus leaving the remainer balance of $40.00. Please keep in mind that if you cancel this session without rescheduling, this retainer fee is non refundable nor transferable. This payment is due in full before the session starts on scheduled date. This session is for a mini portrait which include 6 digital images, up to a half hour long session, 1 collage or facebook cover photo, an online gallery. NO USB/SD CARD IS GIVEN! An SD card or USB stick must be provided by you if you should wish to put them on one with an added charge of $10.00. Print release will be in your online gallery, all photos are also downloaded to Facebook for easy sharing (by you signing this, you agree to public pictures being released on Facebook), location of photoshoot will be at Jackson park right on Forest Home Avenue. You will see a little bridge and the shoot will be right next to it. I will make sure I post something to be seen so we can be found easily. This might be subject to change if a better location is found. But I will keep you notified if anything should change. If you are late, please note that this will cut into your time. Any addtional time will be charged 20$ per every 15 mins that will be due before you leave or before photos are released.
