Please complete this registration form for the NM Slaughter House and acknowledge the following volunteer terms and conditions of service

This agreement is entered into by NM Slaughter House and

1.   NM Slaughter House 's Trade Secrets
In the performance of Volunteer 's job duties with NM Slaughter House, Volunteer will be exposed to NM Slaughter House Confidential Information. "Confidential Information" means information or material that is commercially valuable to NM Slaughter House and not generally known or readily ascertainable in the industry. This includes, but is not limited to:
(a)  technical information concerning NM Slaughter House 's products and services, including product know-how, formulas, designs, devices, diagrams, software code, test results, processes, inventions, research projects and product development, technical memoranda and correspondence;
(b)  information concerning NM Slaughter House 's business, including cost information, profits, sales information, accounting and unpublished financial information, business plans, markets and marketing methods, customer lists and customer information, purchasing techniques, supplier lists and supplier information and advertising strategies;
(c)  information concerning NM Slaughter House 's Volunteers, including salaries, strengths, weaknesses and skills;
(d)  information submitted by NM Slaughter House 's customers, suppliers, Volunteers, consultants or co-venture partners with NM Slaughter House for study, evaluation or use; and
(e)  any other information not generally known to the public which, if misused or disclosed, could reasonably be expected to adversely affect NM Slaughter House 's business.

2. Nondisclosure of Trade Secrets
Volunteer shall keep NM Slaughter House 's Confidential Information, whether or not prepared or developed by Volunteer, in the strictest confidence. Volunteer will not disclose such information to anyone outside NM Slaughter House without NM Slaughter House 's prior written consent. Nor will Volunteer make use of any Confidential Information for Volunteer's own purposes or the benefit of anyone other than NM Slaughter House.
However, Volunteer shall have no obligation to treat as confidential any information which:
(a)  was in Volunteer's possession or known to Volunteer, without an obligation to keep it confidential, before such information was disclosed to Volunteer by NM Slaughter House;
(b)  is or becomes public knowledge through a source other than Volunteer and through no fault of Volunteer; or
(c)  is or becomes lawfully available to Volunteer from a source other than NM Slaughter House.

3.   Confidential Information of Others
Volunteer will not disclose to NM Slaughter House, use in NM Slaughter House 's business, or cause NM Slaughter House to use, any trade secret of others. 

4.   Return of Materials
When Volunteer's employment with NM Slaughter House ends, for whatever reason, Volunteer will promptly deliver to NM Slaughter House all originals and copies of all documents, records, software programs, media and other materials containing any Confidential Information. Volunteer will also return to NM Slaughter House all equipment, files, software programs and other personal property belonging to NM Slaughter House.

5.   Confidentiality Obligation Survives Employment
Volunteer's obligation to maintain the confidentiality and security of Confidential Information remains even after Volunteer's employment with NM Slaughter House ends and continues for so long as such Confidential Information remains a trade secret.

6.   General Provisions
(a)  Relationships: Nothing contained in this Agreement shall be deemed to make Volunteer a partner or joint venturer of NM Slaughter House for any purpose.
(b)  Severability: If a court finds any provision of this Agreement invalid or unenforceable, the remainder of this Agreement shall be interpreted so as best to effect the intent of NM Slaughter House and Volunteer.
(c)  Integration: This Agreement expresses the complete understanding of the parties with respect to the subject matter and supersedes all prior proposals, agreements, representations and understandings. This Agreement may not be amended except in a writing signed by both NM Slaughter House and Volunteer.
(d)  Waiver: The failure to exercise any right provided in this Agreement shall not be a waiver of prior or subsequent rights.
(e)  Injunctive Relief: Any misappropriation of any of the Confidential Information in violation of this Agreement may cause NM Slaughter House irreparable harm, the amount of which may be difficult to ascertain, and therefore Volunteer agrees that NM Slaughter House shall have the right to apply to a court of competent jurisdiction for an order enjoining any such further misappropriation and for such other relief as NM Slaughter House deems appropriate. This right is to be in addition to the remedies otherwise available to NM Slaughter House .
(f)   Indemnity: Volunteer agrees to indemnify NM Slaughter House against any and all losses, damages, claims or expenses incurred or suffered by NM Slaughter House as a result of Volunteer's breach of this Agreement.
(g)  Attorney Fees and Expenses: In a dispute arising out of or related to this Agreement, the prevailing party shall have the right to collect from the other party its reasonable attorney fees and costs and necessary expenditures.
(h)  Governing Law: This Agreement shall be governed in accordance with the laws of the State of New Mexico.
(i)   Jurisdiction: Volunteer consents to the exclusive jurisdiction and venue of the federal and state courts located in New Mexico in any action arising out of or relating to this Agreement. Volunteer waives any other venue to which Volunteer might be entitled by domicile or otherwise.
(j)   Successors & Assigns: This Agreement shall bind each party's heirs, successors and assigns. NM Slaughter House may assign this Agreement to any party at any time. Volunteer shall not assign any of his or her rights or obligations under this Agreement without NM Slaughter House 's prior written consent. Any assignment or transfer in violation of this section shall be void.

7.   Signatures
Volunteer has carefully read all of this Agreement and agrees that all of the restrictions set forth are fair and reasonably required to protect NM Slaughter House 's interests. Volunteer has received a copy of this Agreement as signed by the parties.
Volunteer:

Registrant Volunteer Terms and Conditions of Service I agree to voluntarily provide personal information that will be collected, used and maintained by The NM Slaughter House Registry staff in implementing the NM Slaughter House registry. I agree to provide volunteer services as needed and as assigned in accordance with NM Slaughter House. I understand that as a NM Slaughter House volunteer, I agree to present myself in a professional manner at all times. This includes NEVER showing up to volunteer while under the influence of drugs, alcohol, or any other mind altering substance. I acknowledge that showing up under the influence of drugs or alcohol or any other mind altering substance is a breach of this contract and will result in the volunteer potentially having to pay the amount set out in the “Damages” section.

I further understand and agree to: Perform my volunteer services and responsibilities under the terms, conditions and general direction of NM Slaughter House, and as approved or supervised by an appropriate and designated official of NM Slaughter House be assigned to serve in potentially dangerous and uncomfortable situations. Be responsible for any actions that are not directly related to the performance of my volunteer services assignment. Maintain current and professional licensure, certification or registration as applicable. Notify the NM Slaughter House. registry staff to other public or private entities as necessary for the administration of the registry. Abide by all applicable state of New Mexico laws, regulations, rules policies, procedures and protocols concerning standards of conduct and conflicts of interest. Abide by the New Mexico Department of Health NM Slaughter House Policy and Procedures manual. I understand that either party NM Slaughter House or me as a registered volunteer may terminate my registration and/or volunteer assignment at any time. I acknowledge that I may be asked to leave The NM Slaughter House at any time for any reason and I will have no remedy. If I have been asked to leave, I must exit the premises immediately after gathering my possessions. I acknowledge that I have no right to work with or be part of The NM Slaughter House. 

 Waiver: The volunteer agrees to waive any claims it may have against The NM Slaughter House arising out of their volunteer services, including but not limited to, any claim for personal injury or other wise. The volunteer acknowledges that he/she is volunteering at their OWN RISK with potential danger or even death. Horse play and messing around in a manner not related to the duties laid out for the volunteer are not permitted, aknd in the event an injury arises from horse play, the volunteer cannot hold The NM Slaughter House liable for any injury. 

Consent to use and disclose personal information: I understand that the information I provide with this registration will be used by NM Slaughter House to determine the status of my credentials including; confirmation that my license (if needed) is current, valid and free of any restrictions. By registering and agreeing to these NM Slaughter House Volunteer Terms and Conditions, I agree to have the status of my credentials verified by national, federal and New Mexico licensing and credentialing authorities. I also understand that the information I provide will be used only by NM Slaughter House registry staff to verify my credentials and to assign and emergency credentialing level neither designates or grants clinical privileges nor authorizes me to provide healthcare services without proper authorization and supervision. I further understand that during an emergency or disaster the information I provide will be used by The NM Slaughter House staff, and I authorize The NM Slaughter House to use such information. 

Acknowledgement of Volunteer Selection Process: I understand that the process of being selected as and NM Slaughter House volunteer to render volunteer services for a specific position is based upon an evaluation of the information I provided with my NM Slaughter House registration in conjunction with the NM Slaughter House mission requirements. I understand that if selected I will be contacted by the NM Slaughter House registry staff and I will be given the choice whether or not to volunteer my services for that specific position. I understand and agree that if I register on the NM Slaughter House registry, no guarantee or assurance is provided that I will be requested in for a specific position. Similarly, I understand and agree that registering on the NM Slaughter House registry in no way obligates me to participate or agree to my position and that I may decline to participate for whatever reason I choose. 

Statement of Physical and mental competence and assumption of the risk: I acknowledge that by registering on the NM Slaughter House registry I am representing that I am of sound physical and mental capacity and capable of performing volunteer services in and emergency or disaster. I acknowledge that emergency or disaster settings may pose significant psychological and physical hardships and risks to those volunteering services and that there are often a lack of the normal amenities of daily life accommodations for persons with disabilities. In volunteering my services, I agree to accept such conditions and risks as may occur in any emergency or disaster to which I am assigned.

Agreement to perform volunteer services without compensation: By registering on the NM Slaughter House registry, I agree that I am not an employee of NM Slaughter House, I agree to participate as a volunteer without compensation or payment for my services. I agree that no matter the amount of time I contribute, my time is all volunteer. I acknowledge that I have the ability to refuse to partake in any activity at any time, and that each activity I partake in, agreement to perform volunteer services without compensation: By registering on the NM Slaughter House registry, I agree that I am not an employee of NM Slaughter House, I agree to participate as a volunteer without compensation or payment for my services. I agree that no matter the amount of time I contribute, my time is all volunteer. I acknowledge that I have the ability to refuse to partake in any activity at any time, and that each activity I partake in, whether acting, building etc. is volunteer and based on my own decision to participate for no compensation. 

Agreement not to defame, slander, or disparage: I, the Volunteer, agree that during my volunteering at The NM Slaughter House before, during and after my departure, I shall not, through any form of communication with the press, public, clients, potential clients, or media, disparage the organization in any way. I understand that forms of communication include but are not limited to social media websites, public forums, suppliers, vendors, clients, interviews, text messages, or record statements. I understand that disparagement includes but is not limited to critiques, derogatory statements, ridicule, slander, rumors, jokes or insults at the expense of the company, management, senior personnel, products or services. I acknowledge that if I am terminated and prevented from working with The NM Slaughter House, I must not create any falsities about The NM Slaughter House, or I will be in breach of this contract. If I am found to be in breach of this contract I acknowledge that I am liable for liquidated damages as described in the “Liquidated Damages” section. I acknowledge that speaking or writing lies or exaggerations about The NM Slaughter House in any medium would have an impact on the reputation, business, and goodwill of The NM Slaughter House, thus would be slander and/or defamation. I acknowledge this does not impede my free speech since this form seeks solely to prevent any falsities about The NM Slaughter House.

Confidentiality: I agree that I will not share any of the building designs, set designs, skits, monologues, special effects designs, or any other creative aspect related to the events of The NM Slaughter House with any other persons, organizations, or businesses. If I am terminated from volunteering with The NM Slaughter House or I choose to leave while the events/haunted attraction activities are still occurring at The NM Slaughter House, I agree that I will not participate in the building of any other haunted house attractions, nor will I act, or partake in any other volunteer work with any other haunted house or similar attractions for the Halloween season or for three months after the events of The NM Slaughter House events have concluded (3 months after October 31 of that year). I acknowledge that this agreement is to protect any trade secrets or other creative advantages I will learn about while volunteering at The NM Slaughter House. 

Damages: The parties agree that in the event that the volunteer breaches the contract, damages will be difficult to calculate. To avoid cost and effort to attempt to calculate such damages, the parties agree that in the event of a breach a reasonable forecast of resulting damage is $1,000, which the VOLUNTEER shall pay to The NM Slaughter House within 20 days of confirmation of such breach.

General Provisions: (a) Severability: If a court finds any provision of this Agreement invalid or unenforceable, the remainder of this Agreement shall be interpreted so as best to affect the intent of NM Slaughter House and Volunteer. (b) Integration: This Agreement expresses the complete understanding of the parties with respect to the subject matter and supersedes all prior proposals, agreements, representations and understandings. This Agreement may not be amended except in a writing signed by both NM Slaughter House and Volunteer. (c) Waiver: The failure to exercise any right provided in this Agreement shall not be a waiver of prior or subsequent rights. Pledge to provide accurate information: By registering and agreeing to these Volunteer Terms and Conditions of Service, I agree that the information I provide and the representations I make with the NM Slaughter House registration will be truthful, complete, accurate and free of any attempt to mislead. I understand that I may return to the NM Slaughter House registry website and modify my personal information (profile) at any time and I agree to keep such information up to date and current. I agree to protect the confidentiality and to abide by all security provisions of the NM Slaughter House registry website.

SIGNATURES: By signing and dating on these volunteer terms and conditions of service, I affirm that I understand its contents and that I have been given the opportunity to ask questions about any part of the document which I may not understand. 

I also understand and agree that the programming is a non-guild production and there will be no residual or any other type of payment due in connection with my performance.

I agree that NM Slaughter House. Shall be the exclusive owner of all copyright and other rights in and to the programming and performance and will be able to use them forever and throughout the world and to license others to use them in any manner NM Slaughter House. wish and in any and all media now known or hereafter discovered or developed.

I further irrevocably agree that NM Slaughter House. may use and license others to use the performance or excerpts therefrom, and my name, voice likeness and any biographical facts which may have been provided to NM Slaughter House Inc. in the programming and in any related or derivative versions and/or uses of the programming including without limitation any serializations, translations, and/or adaptations thereof and in the advertising, marketing and promotion of the programming, NM Slaughter House. Film, I confirm that to the best of my knowledge, any statements made by me during the performance will be true and will not violate or infringe upon any third parties rights.

I hereby agree not to sue and I hereby irrevocably and unconditionally release, waive and forever discharge, NM Slaughter House. Its past, present and future parents, subsidiaries (weather or not wholly-owned), affiliates, divisions, agents, representatives, employees, successors, and assigns jointly and individually (hereinafter collectively referred to as (NM Slaughter House. and any production company affiliated The NM Slaughter House. film from any and all manner of liabilities, claims and demands of any kind or nature whatsoever, in law or equity, where known or unknown, which I or my assigns, agents and/or representatives) ever had, now have, or in the future may against the NM Slaughter House Inc. including but not limited to claims arising out of or related to the uses described here in the event the programming the performance and/or my decision to perform the event. I further agree that I shall be liable for any attorney’s fees and costs incurred by the NM Slaughter House. in connection with any claim or lawsuit brought in violation of this release. In no event shall I have the right to enjoin the development, production or distribution or exploitation of the programming. NM Slaughter House. May transfer and assign this release or any and all of its rights or privileges hereunder to any entity or individual without restrictions. This release shall be binding on all of my successors-in-interest and heirs. This release sets forth the entire agreement between us with respect to the subject matter hereof and may not be altered or amended except in writing signed by both parties. This release shall be governed by the laws of the State of New Mexico. The parties here agree to submit to jurisdiction in the state of New Mexico.

All Volunteers will be required to comply to the following rules of The NM Slaughter House, if you wish to remain Dead here!

Keep your health above all, stay hydrated and healthy. (sit down if dizzy, get some air away from fog machines and keep your water bottle with you)

Personal feelings will always be withheld when dealing with NM Slaughter House business. (Absolutely NO slander on Social media, customers, phone calls, emails, ect.)

Attend all planned programs and participate fully to the best of your ability.
Follow room rules established before the event begins, you are responsible for knowing the rules. (Make sure you ask)

Be in the pre-assigned zones or areas to set good examples for your newbies.
Treat props and your zone with respect and care. Limit damage and misconduct. Help other members to have a slaughterific experience by making attempt to include the newbies in activities. Respect myself, my slaughter family members, the venue, and the slaughter name at all times.

• Arrive in a timely manner and dressed accordingly to the event

• Participate in slaughter family gatherings prior to the event

• Explain the rules and expectations to my recruits well in advance to the event, if a member needs to leave early, a committee member will be contacted and authorize an escort.
• Avoid compromising situations and behave with dignity. (No butt grabbing)

• Recognize that my actions not only represent myself but the entire slaughter attraction.

• Seek help if I am unsure I am making the strongest decision.

• Recognize that other family members should be accountable for following the same guidelines.

New and returning volunteers must qualify to become part of the inner circle group annually: fulfilling the 15-day requirement to receive NM Slaughter House T-shirt and free admission for LIFE!!

Live up to your highest expectations, so you will be proud of whom you are and the work you have accomplished.
No clothing or accessories with profanity or profane symbols will be worn to or at the NM Slaughter House.

You are to be CLEAN and presentable when you report for NM Slaughter House.

NM Slaughter House costumes are NOT to be taken home for any reason

You will clean up after yourself in your work area/room/ make-up room and remove all candy wrappers, water bottles, etc.

No use of cell phones/texting devices is allowed when guest /groups are in the house. This does not mean in your room- IN THE HOUSE AT ALL!

ABSOLUTELY NO SMOKING ON PROPERTY! You must be 25 feet away from curb of property.  You will not throw cigarette butts on the ground out back- extinguish butt and throw away!

You will remain in your room until relieved for a break or in the event of an emergency/problem/ or escorting a guest out who ask for an exit.

Do Not Touch the Props, Decorations, nor allow the guest to do so.
You will remain in Character around guest at all times
No Profanity will be tolerated around guest!

YOU WILL PERMANENTLY BE DISCHARGED AND BANNED FOREVER FROM THE NM SLAUGHTER HOUSE IF THESE TWO RULES ARE BROKEN!!

1. ABSOLUTELY NO PHYSICAL OR VERBAL ABUSE WILL BE TOLERATED!!
2. ABSOLUTELY NO THEFT!!

THOSE WHO ARE UNABLE TO CONDUCT THEMSELVES WITH IN THE GUIDLINES LISTED ABOVE:

1. Will be asked to explain their actions to the immediate supervisor in charge.
2. Will possibly be excluded from participation in the future.
3. The immediate supervisor in charge will notify parents/guardians to confirm appropriate actions.

If you can’t make it, or will be late call an immediate supervisor also give 24 hour notice if possible.

Why do people go through Haunted Houses?
The Illusion: That you are entering the unknown, the macabre, and that you have the
expectation of being scared.
The fact: That you do not know when it will happen, but you know it will happen.
The reality: you know it will be safe, that you will come out safe: But for split seconds of time you should doubt this intensely!

Why do people work in a Haunted House?
Your Job is to see that all of the above happens!!
