Important information before starting

Some assets that you consider to be your own may not be owned by you and cannot pass under your will. You should take this into account when making your will.

Any assets that are owned by a trust or a company will not pass under your will.

Your superannuation is controlled by the trustee of the superfund trust and will pass according to the trust terms.

Any joint assets including joint bank accounts and any jointly owned property or shares will pass to the surviving joint owner. To be clear, no part of a joint asset will pass under your will regardless of what your will says.

If you have requirements relating to superannuation or joint assets then you should speak with a lawyer separately about these issues.

It is possible to end joint ownership and control what happens with any trust/company assets when you die, however you must do this while you are alive. We can help you with this planning. This however is not included as part of will preparation unless you ask us to do this as their are additional costs. We can provide a quote.

Leaving to all children

Later in this process you will be asked what gifts you may wish to leave to your children. It is important at this point to keep a couple of things in mind.

In the event that you decide to leave to all of your children including children who are as yet unborn then you need to be aware that you will be unable to leave in unequal shares to your children.

If you wish to decide the appropriate percentage for each child then you cannot leave to children as yet unborn. To provide for those unborn children you must update your will if future children are born. You cannot allocate a percentage to an unborn child.

If you wish to leave to unborn children then you can do this by leaving to all children in equal shares. It is of course in order to leave to future children if you leave to all children in equal shares and you are in a relationship as this allows these future children to be identified.

It is also necessary to appreciate the risk of leaving to all children if you are not in a committed relationship, particularly if you are male. It is possible that you may have children of whom you are not aware and we suggest if you are a single male that you do not leave to future children. If you are single and wish to leave to unborn children then it will be necessary to get the assistance of a lawyer.

If you are in a relationship then you may leave to unborn children and this risk will be managed by only leaving only to future children of your current relationship. If this is not acceptable then it will be necessary to get the assistance of a lawyer.
