Kokoro™ is a private group and it is expected that all discussions and content are confidential. You are free to discuss anything with AJ Coaching and AJ Watson and know that your personal information will not be shared.
There are three exceptions to the above confidentiality agreement.
When disclosure is required to prevent clear and imminent danger to yourself & others
When legal requirements demand that confidential material be revealed
You agree to inform AJ Coaching if you come under the care of any health care professional such as a therapist, psychologist, counsellor, psychiatrist or related professional during the course of your membership. If you are under this type of medical treatment, you must obtain written permission from your practitioner stating they consent for you to remain subscribed. This is to ensure the included content does not impact their services and treatment.
The Kokoro™ Facebook group has a code of conduct, which includes confidentiality (refer to the groups for details), that must be followed by all members.
AJ Coaching is not responsible for the actions of members.
The subscriber agrees to indemnify, defend, and protect AJ Coaching from and against all lawsuits and costs of every kind pertaining to the subscriber’s health including reasonable legal or medical fees due to any act or failure to act by the subscriber based upon the content and advice.
NO MODIFICATION UNLESS IN WRITING
No modification of this Agreement shall be valid unless in writing and agreed upon by both Parties.
The currently acceptable payment method is Paypal. Once payment is received the subscriber is provided with instructions and the link to the Kokoro™ group. At this point, the subscriber may click to request to join. It can take up to 48 hours for the payment to be confirmed and the membership to be accepted.
You can cancel anytime via PayPal. You will retain membership until the end of your paid subscription period.
Any issues with your PayPal account should be taken up with PayPal.
AJ Coaching does not warrant or guarantee any specific level of performance or results. Example of results obtained for other clients of AJ Coaching may be used as a marketing tool and shown to the subscriber for demonstrative purposes only and must not be construed by the subscriber as indicating any promised results or level of results.
The subscriber (you) is aware that coaching is in no way to be construed as psychological counselling or any type of therapy. Coaching results are not guaranteed. The subscriber must enter into the coaching units with the full understanding that they are responsible for creating their own results. The subscriber is aware that their coaching is dependent on their level of commitment and communication throughout the process.
AJ Coaching does not offer refunds for subscriptions. In the event of cancellation, the subscriber will stay enrolled in the group until the end of their paid time period.
In any case that a refund is disputed, the client will be expected to provide proof that they have completed every action step and task to 100% of their capability consistently. There must be evidence to prove this.
In the event that full payment is not met, access to the Kokoro™ group will be removed.
Your Kokoro™ membership will continue until terminated. To use the Kokoro™ - The Mental Detox System service you must have Internet access and an Internet-ready device and provide us with one payment method.
“Payment Method” means a current, valid, accepted method of payment, as may be updated from time to time, and which may include payment through your account with a third party. Unless you cancel your membership before your billing date, you authorise us to charge the membership fee for the next billing cycle to your Payment Method (see “Cancellation” below).
Billing & Cancellation
Billing Cycle. The membership fee for the Kokoro™ service and any other charges you may incur in connection with your use of the service, such as taxes and possible transaction fees, will be charged to your Payment Method every 30 days. In some cases, your payment date may change, for example if your Payment Method has not successfully settled or if your paid membership began on a day not contained in a given month. We may authorise your Payment Method in anticipation of membership or service-related charges through various methods, including authorising it for up to approximately one month of service as soon as you register.
Payment Methods. To use the Kokoro™ service you must provide one or more Payment Methods. You authorise us to charge any Payment Method associated with your account in case your primary Payment Method is declined or no longer available to us for payment of your subscription fee. You remain responsible for any uncollected amounts. If payment is not successfully settled, due to expiration, insufficient funds, or otherwise, and you do not cancel your account, we may suspend your access to the service until we have successfully charged a valid Payment Method. For some Payment Methods, the issuer may charge you certain fees, such as foreign transaction fees or other fees relating to the processing of your Payment Method. Local tax charges may vary depending on the Payment Method used. Check with your Payment Method service provider for details.
Updating your Payment Methods. You can update your Payment Methods by contacting AJ Coaching at email@example.com. We may also update your Payment Methods using information provided by the payment service providers. Following any update, you authorise us to continue to charge the applicable Payment Method(s).
Cancellation. You can cancel your Kokoro™ membership at any time, and you will continue to have access to the Kokoro™ service through the end of your billing period. To the extent permitted by the applicable law, payments are non-refundable and we do not provide refunds or credits for any partial membership periods. To cancel, please contact AJ Coaching at firstname.lastname@example.org. If you cancel your membership, your account will automatically close at the end of your current billing period.
Changes to the Price and Subscription Plans. We may change our subscription plans and the price of our Kokoro™ service from time to time; however, any price changes or changes to your subscription plans will apply no earlier than 30 days following notice to you.
Kokoro™ - The Mental Detox System Service
The Kokoro™ service and any content viewed through the service are for your personal and non-commercial use only and may not be shared with anyone else.
The Kokoro™ service is regularly updated. In addition, we continually test various aspects of our service, including our website, user interfaces, promotional features and availability of Kokoro™.
You also agree not to: circumvent, remove, alter, deactivate, degrade or thwart any of the content protections in the Kokoro™ service; use any robot, spider, scraper or other automated means to access the Kokoro™ service; decompile, reverse engineer or disassemble any software or other products or processes accessible through the Kokoro™ service; insert any code or product or manipulate the content of the Kokoro™ service in any way; or use any data mining, data gathering or extraction method.
The quality of the display of the Kokoro™ content may vary from device to device and may be affected by a variety of factors, such as your location, the bandwidth available through and/or speed of your Internet connection.
The member who created the Kokoro™ account and whose Payment Method is charged (the “Account Owner”) has access and control over the Kokoro™ account and is responsible for any activity that occurs through the Kokoro™ account. You are responsible for updating and maintaining the accuracy of the information you provide to us relating to your account. We can terminate your account or place your account on hold in order to protect you, Kokoro™, AJ Coaching or our partners from identity theft or other fraudulent activity
Warranties & Limitations on Liability
The Kokoro™ service is provided “as is” and without warranty or condition. In particular, our service may not be uninterrupted or error-free. You waive all special, indirect and consequential damages against us. These terms will not limit any non-waivable warranties or consumer protection rights that you may be entitled to under the laws of Australia.
Electronic Communications. We will send you information relating to your account (e.g. payment authorisations, invoices, changes in Payment Method, confirmation messages, notices) in electronic form only, for example via emails to your email address provided during registration.
