Submit original and one copy to Director, Mississippi Emergency Management Agency, One MEMA Drive, Pearl, Mississippi 39208.

All copies must be signed and dated.

Additional sheets may be used If necessary.

Upon approval, the Agency will return one copy with your transport permit.

All permit fees should be made payable by CHECK to the Mississippi Emergency Management Agency.

Please note remittance, "For Radioactive Waste Transport Permit."

NOTE: Radioactive Waste Transport Permits may be purchased for more than one facility or location of a company, corporation, etc. However, an application shall be submitted for each facility to include the additional fee and the required certificate of insurance or bond.

FEES

An annual fee of $2500.00 will be assessed by the Agency for each permit for the transporting of irradiated reactor fuel, transuranic wastes, and/or high-level wastes within or through the State. Fees for low-level radioactive wastes will be assessed annually according to waste classification and volume, if that volume exceeds the annual total listed in Table 3.

Permit fees will not be pro-rated.

Permit fees are not refundable.

Institutions of higher learning will be exempted from the permit fee. However, these entities must comply with all remaining aspects of the regulations.

Shipper Requirements

a. Prior to the transport of any nuclear waste into, within or through the State, the shipper shall provide advance notification to the Agency.

b. The advance notification shall be made in writing to the Director of the Agency. The advance notification shall be made utilizing Agency Form RAD 5-3, "radioactive Waste Shipment Advance Notification and Manifest." A notification delivered by mail must be postmarked at least seven days before transport of a shipment within or through the State. A notification delivered by messenger must be received by the Agency at least four days before the transport of a shipment within or through the State.

7. A Certificate of Liability Insurance shall be submitted as evidence of financial ability to protect the State of Mississippi and the public at large from possible radiological injury or damage due to pack- aging, transportation, or delivery of radioactive waste. For those applicants not maintaining liability Insurance, they must deposit and maintain with the Agency a cash or corporate surety bond In the amount of Five Hundred Thousand Dollars ($500,000,00)

In compliance 'With Chapter 432, Laws of 1982, the Mississippi Radioactive Waste TransportationAct, I hereby certify on behalf of the above-named applicant (shipper) to the Mississippi EmergencyManagement Agency, that: (A) the above-named applicant (shipper) will comply fully with all appli-cable laws and administrative rules and regulations, both State and Federal, and any disposal facilityradioactive material license requirements regarding the packaging, transportation, storage, disposal,and delivery of such wastes; (B) the above-named applicant (shipper) will hold the State of Mississippiharmless for all claims, actions, proceedings in law or equity arising out of radiological injury or dam-ages to persons or property occurring during the transportation of its radioactive waste into, withinor through the State including all costs defending same; provided, however, that nothing containedherein shall be construed as a waiver of the State's sovereign immunity; (C) the above named appli-cant (shipper) has current copies of the Regulations for the Transportation of Radioactive Waste into,within or through the State of Mississippi, DOT Regulations 49 CFR Parts 171-179, and when appli-cable, the disposal site radioactive material license and the disposal site waste acceptance criteria;(D) the above-named applicant' (shipper) has prepared this application to conform with MississippiState Board of Health and Mississippi Emergency Management Agency Regulations for Transportationof Radioactive Waste into, within or through Mississippi, and that all information contained herein,including any required supplements attached hereto, is true and correct to the best of my knowledgeand belief.
