  • ENTIRE AGREEMENT: This agreement contains the understanding between Videographer and the client. It supersedes all prior and simultaneous agreements between the parties. The only way to add or change this agreement is to do so in writing, signed by all the parties.

    RESERVATION: A "Wedding Video Contract" form and retainer of $500 are required to reserve the specified coverage from Branded Films invoice with the remainder due on the day of the wedding day. Videographer for documentary coverage is subject to change based on availability.

    HOUSE RULES: The Videographer is limited by the guidelines of the event site management. Client agrees to accept the technical results of their imposition on the Videographer. Negotiation with the officials for moderation of guidelines is client's responsibility; the Videographer will offer technical recommendations only.

    FILM and COPYRIGHTS: Until final payment for services is made, the videos produced by the Videographer are protected by Federal Copyright Law (all rights reserved).

    EXHIBITION: Client grants the Videographer permission to display selected images or clips as an example of the Videographer's work.

    PRODUCT: The first draft of a highlight reel will be available online two to eight weeks following the wedding date (depending on the season) All corrections and suggestions made by client must be submitted no more than 60 days after the latest draft is received or client will be charged an additional hour of editing per 60 days. Any additional edits outside what is specified on the invoice will be charged the hourly rate.

    MODEL RELEASE. The client hereby grants to the Videographer and its legal representatives and assigns, the irrevocable and unrestricted right to use and publish videos of the client or in which the client may be included, for editorial, trade, advertising and any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same. The client hereby releases the Videographer and its legal representatives and assigns from all claims and liability relating to said videos. 

    LIMIT OF LIABILITY: In the unlikely event that the Videographer is injured or becomes too ill to cover the event, the Videographer will make every effort to secure a replacement videographer. If the situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the event package. The Videographer takes the utmost care with respect to exposure, transportation, and processing the videos. However, in the unlikely event that videos have been lost, stolen, or destroyed for reasons within or beyond the Videographer's control, the Videographer's liability is limited to the return of all payments received for the event. The limit of liability for a partial loss of originals shall be a prorated amount of the footage lost based on the percentage of total footage.

    RETAINER: In the event of cancellation, the retainer paid is non-refundable. The client agrees to provide cancellation notice in writing and releases the Videographer from any responsibilities and liabilities.

     

    TRAVEL: Videographer will cover transportation costs if total mileage covered is under 70 miles from Seattle. If total travel incurred is over 70 miles, Client will be charged 55 cents per mile as a travel fee.


    LODGING: In the event that over 3 hours of travel is involved from Seattle to the venue destination, the videographer will require two nights of lodging to be covered by client. If only two hours of travel is involved, videographer will require only one night of lodging covered by client.
