The above named responsible party is hereafter referred to as "Client," enters into the following agreement with Wendy Atkinson, doing business as, Let the Light in Photography, hereafter referred to as "Photographer." This contract constitutes the entire agreement between both parties and will apply to all future transactions.

Client agrees to pay photographer a retainer of $ 100 at the time of booking to secure their appointment date and time. This is a non-refundable retainer fee that goes toward your session.

I understand that once I have chosen a package, I can only upgrade, and cannot downgrade. I have the choice to upgrade my session once I get my gallery and can pay separately. Any other products outside of the package I select will have to be purchased separately. The Retainer Fee is Non-Refundable. Package Fees includes the Session time, the time and talent of photographer, basic retouching and creative editing of images, as determined by the photographer. Additional editing is available at additional expense to be determined by photographer.

A digital download of digital images will be provided to the client from the final edited photographs. Client agrees to use the digital images for personal use only up to an 8x10 size. The number of digital images is based upon the package Client chose above. Prints larger than 8x10 can be purchased at a per print price from Photographer. Images may not be altered in anyway or sold by the client. Packages include a Print Credit, to be used by the client to purchase photographic prints. Print Credits may not be used toward Canvas, or special order products unless Client has purchased the "I Want It All Collection".

Upon hiring Let the Light in Photography, client understands the style of photography and editing that Let the Light in Photography does. The creative session fee covers all editing. All images are processed with Photographers signature post processing. Minor retouching such as skin smoothing, removal of unsightly items in the photograph, and adjusting colors are all to be done with photographer's personal discretion. Clients are allowed to ask for only ONE minor adjustment, such as head swaps, color tone change that does not stray from photographer's style, or anything that can be quickly fixed with the spot heal, or clone tool in photoshop. Any requests for re-editing after the first re-editing will be charged an additional fee. Re-editing fees start at $25.00 depending on client requests.

If an illness or situation prevents a photo session from taking place, client may reschedule at least 24 hours prior to their session without penalty. Please make every effort to reschedule as soon as possible with the photographer. Should client decide to completely cancel the session or does not show for the session, the retainer fee is forfeited and will not be refunded. Photographer reserves the right to reschedule due to illness, weather, equipment malfunction, or other circumstances beyond her control.

Within three weeks of the Session, Photographer will post an online viewing gallery for the Client. Client will be presented with an image gallery of their best edited images. Client will choose images from the gallery for their digital download and personal use. Client can expect digital images to be available within 1 week after they finalize their gallery. If the Release box below is marked, a sneak peak will be provided of 2-3 images posted on Photographer’s Website and/or Facebook or Instagram Page. Photographer will mail prints via USPS. All Special Order Products such as canvas products will need to be picked up from the Photographer. Special Order Products can be shipped to the Client for an additional expense to be determined by the photographer, depending on size, weight and mailing costs of the items.

Re-shoots are determined at the discretion of the photographer. Re-shoots will not be given for poor choices of clothing, make-up, hair, weather related issues, or not following the recommendations of the photographer.

All payments are due in full unless payment arrangements have been made. Orders will not be processed until payment in full is received. If client has arranged a payment plan, order will be placed after the final payment has been received. Please make all checks payable to Let the Light in Photography.

Photographer is not responsible for the damage of digital files or prints after delivery to client. Client assumes all responsibility for the safety of all digital files, portraits upon receipt. Client is responsible to notify the photographer within 24 hours of receipt of digital download and Prints delivered via USPS for any damages that may have occurred during shipping.

All images will be available for ordering online for one (1) month following client viewing date. After one (1) month, there will be a $25 fee to renew your gallery or extend your viewing time. After 6 months all images will be purged from photographer’s hard-drive, except as needed for promotional purposes, to be determined by photographer at photographer’s sole discretion. Photographer is not responsible for loss or damage to the digital files due to circumstances beyond photographer’s control.

Photographer and property owners are not responsible for any injuries and/or damages inflicted upon any participating parties or property. Client(s) will be responsible for themselves, their children and indemnifies photographer and property owners from any claims against their person or their business. Photographer is not responsible for damage to items that are brought by the client, cell phones, sunglasses, props etc. Please have something safe to store your items in during the session if you carry items with you.

In the unlikely event that the photographer is injured or becomes too ill to photograph the session, every effort will be made to reschedule the Session as soon as an agreed upon date can be secured between Client and Photographer. In the unlikely event that photographs have been lost, stolen, or destroyed for reasons within or beyond Photographer control, Photographers liability is limited to the return of all payments received for the portrait session. The limit of liability for a partial loss of originals will be a prorated amount of the exposures lost based on the percentage of total number of originals.

In the event that the weather conditions are not desirable for the shoot based on Photographer recommendations, the session will need to be rescheduled and the reschedule fee will be waived. Due to liability and equipment damages this decision will be at Photographer discretion.

Let the Light in Photography retains all copyrights to all images created during client’s session. A print release will be included with your digital files to print portraits for personal use up to 8x10 size listed on print release. The print release DOES NOT allow publication of your portraits (i.e. entering in contests), selling or altering (color, saturation, hue, changing from color to black and white) of your images without the photographer’s written permission. It is illegal to copy, scan, download, print, share, alter, or otherwise steal any image created by Let the Light in Photography during client’s photo session. This applies to "sneak peek" images, images posted in an online proofing gallery, blog, Social Media, or hard copy images. If client misuses images via any method listed above, or any other method, client will be invoiced for the cost of EACH digital image client has stolen, at photographer’s current price per digital file. Note from photographer: I work very hard to create images that reflect you and your family, while keeping in line with my artistic vision and creativity. I know you will want to share them and include a sneak-peek for that very reason. However, I ask that you simply link back to my Blog/Website/Facebook page instead of right-clicking, saving, and sharing the image via your own page. To make things easy, simply tag yourself and/or share the post. I hope that you will respect not only my hard work, but the time, money, and dedication that I have put into training and equipment to capture these images for you.

*No cameras/camcorders/recording devices (including cell phone cameras) are allowed during the session unless prior arrangement has been made between client and photographer, including a written agreement. The photographer will not continue if there are other cameras or videotaping during the session. *Session starts at the agreed upon time. It is strongly encouraged that client arrives 15 minutes prior to the start of session. *Please do not bring any children not being photographed to the session. *Please make sure hair is combed and face is clean and free of runny noses or eyes. *Please avoid eating or drinking red or orange food or drinks before session, as red and orange tend to leave a stain on the face.

Let the Light in Photography kindly requests the use of the images made during our session to be displayed on my Blog www.letthelightinphotography.com and Social Media Pages. Let the Light in Photography does NOT use client names or children's names. By clicking the box the Client releases the use of these images for all persons in our session for internet usage by the Photographer and for promotional materials. Please note "Sneak Peeks" are provided though Social Media and/or Photographer's web page.
