This Rental Agreement (this "Agreement") is made by and between the Facility Owner (hereinafter known as "Owner") and the above-named Renter.
Payment Amount and Taxes
The amount of payment agreed by the Renter is exclusive of taxes and other fees.
Booking and Payment
Rental of facilities and dates is a contractual commitment. A rental deposit of 50% is required upon execution of the Agreement. The remaining 50% balance is due after the event.
Usage of the facility may be extended depending on the circumstance which may allow it. If the venue is reserved already on the hours requested, extension may not be allowed.
Reservation and Usage of Facility
Reservation of the facility shall be on a first-come, first-serve basis. Usage of the facility shall be for the purpose agreed upon reservation and cannot be used for other purposes. Subleasing shall not be allowed without prior consent of the administrators of the facility.
Cancellation
Should Renter cancel his/her reservation due to fortuitous causes, the 50% downpayment shall be refundable.
If the cancellation was due to other reasons, with the reservation 1-week prior to the scheduled reservation, 20% shall be deducted from the refundable amount.
In any case, there shall be no refunds for causes that are non-fortuitous and the scheduled reservation is wished to be canceled 3-days prior to the scheduled reservation date.
Reservation Hours
Setup, interior design, vendor drop-offs, and cleanup must take place within the specified rental period.
Setup
Period of rental must include setup period. Rental of table and chairs may be provided in-house, by a third party vendor, or renter's choice. The management shall not be responsible for any damage incurred to the facility or any other 3rd party materials.
Decorations
No decorations, temporary fixtures, or any materials or application that may cause irreversible damage may be affixed to the walls of the facility that requires the puncturing of walls such as the use of nails, staples, or tacks.
Alcohol
Alcohol may only be served to persons over the age of 21 under the terms and under the conditions applicable to the laws of the state. Any penalties in violation of the state and federal laws by which may be caused during the event shall solely be the responsibility of the renter.
Caterers
We are partners with some of the city's highly recommended caterers where you can get better deals with them if you hold your event with us. We likewise recommend to you the list that we can provide. However, you may still have an option to choose your own caterer.
Smoking
Smoking is prohibited within the Banquet. There are however designated smoking areas near the parking area.
The Entire Agreement
This Agreement constitutes the terms and conditions agreed upon by the parties and supersedes any and all verbal agreements made in the prior or in the future. Any modifications set forth after the execution of this Agreement must be set forth in writing and signed by both parties hereto.
Governing Law
This agreement shall be governed by rules of the state of California, to the exclusion of other state laws and jurisdictions.
