This Companion Animal Adoption Agreement ("Agreement") is effective upon execution this {date} (Date of Adoption), by and between The Rescue House, Inc. ("TRH"), {primaryGuardian} {coguardianif} ("Guardian(s)").
By signing this Agreement, Guardian certifies that all answers previously provided to The Rescue House during the adoption process are true and accurate, and hereby agrees to be bound by the following terms and conditions:
I. CARE:
The Companion Animal(s) shall be provided with proper food, water and humane shelter at all times. For purposes of this Agreement, “humane shelter” shall mean an indoor area of sufficient size to allow for normal activities, including but not limited to, sleeping, eating, and recreation.
II. PURPOSE:
Guardian expressly certifies that the Companion Animal(s) is being adopted for the sole purpose of companionship and shall be kept indoors at all times (except for purposes of direct transportation in a secure carrier) and in no event shall be declawed. At no time shall the Companion Animal(s) be used by Guardian or any third parties for vivisection, experimentation, or other laboratory work (except as deemed necessary by licensed veterinarian for diagnostic or healing purposes).

III. ILLNESS:
Guardian acknowledges that TRH often has limited information regarding the cats it offers for adoption. Although TRH has disclosed the best information presently available to it regarding each cat’s health, age, breed, habits and temperament, it disclaims all warranties, express and implied, regarding these manners. It is possible that any cat may be afflicted by diseases, medical conditions or parasites of which TRH is presently unaware. Guardian accepts each cat in its present condition and assumes all risk of ownership.
If the Companion Animal(s) becomes ill or injured after the Date of Adoption, Guardian agrees to obtain immediate care by a licensed veterinarian and shall be responsible for all veterinarian charges incurred. Guardian further agrees not to euthanize Companion Animal(s) unless specifically recommended by a licensed veterinarian due to acutely diminished and unalterable quality of life.

IV. COMPLIANCE WITH STATE AND LOCAL LAWS AND REGULATIONS:
Guardian shall at all times comply with State and Local Laws and Regulations pertaining to the humane treatment of Companion Animal(s).

V. RETURN OF COMPANION ANIMAL(S):

Guardian agrees not to abandon, give away, sell or dispose of the Companion Animal(s) in any way. If, at any time, Guardian is no longer able or willing to comply with the terms and conditions of this Agreement, Guardian expressly agrees to return and relinquish custody of the Companion Animal(s) to TRH according to its directions. If more than one Companion Animal was adopted at the same time, TRH shall have the sole discretion to require the return of all. In no event shall custody of the Companion Animal(s) be relinquished to any third party without the express written consent of TRH. Such consent shall be within the sole and absolute discretion of TRH.

VI. RELEASE OF LIABILITY:
Guardian agrees to release, hold harmless and waive any and all claims against, TRH, TRH directors, officers, agents, employees, volunteers and assigns, TRH Adoption Centers, and the businesses in which Adoption Centers are located, from any and all claims and liabilities, whether known or unknown. This agreement is binding on the Guardian, all members of the Guardians’ household and any successor in interest of Guardian.

VII. FEES:
Guardian acknowledges that any fees paid in conjunction with the adoption of the Companion Animal(s) are non-refundable.
VIII. LIQUIDATED DAMAGES IN THE EVENT OF GUARDIAN’S FAILURE TO COMPLY WITH THE TERMS AND CONDITIONS OF THIS AGREEMENT:
If Guardian fails to comply with the terms and conditions of this agreement, and/or TRH reasonably believes that the health and/or safety of the Companion Animal(s) is in danger, Guardian agrees to immediately relinquish custody of the Companion Animal(s) to TRH. TRH reserves the right to physically retrieve the Companion Animal(s) from Guardian. Guardian further understands that TRH will institute legal action and expressly acknowledges that the amount of damages sustained by TRH as a result of a violation of the terms and conditions of this agreement are difficult to determine. Therefore, TRH and Guardian hereby agree to liquidated damages in the amount of One Thousand Dollars ($1,000) per Companion Animal, to be paid to TRH, should Guardian fail to comply with the terms and conditions of this agreement. Payment shall be made by Guardian within thirty (30) days of receipt of written notice of violation from TRH. Failure to submit payment will result in further legal action by TRH.
