This Real Estate Photography Contract (this "Agreement") is executed on the {day} day of {month}, {year}, is executed by and between:

Scope of the Agreement
The Photographer shall provide photography services for real estate on {dateScheduled}, that shall take {numberOf} hours, of photos of the real estate, including that of the interior consisting of the bedrooms, toilet and bathrooms, dining room, living room, other rooms, and the exterior areas.
The photography service includes basic editing of images such as, but not limited to, cropping, toning, color adjustments, among others.
The Photographer shall provide {numberOf15} photographs of the real estate in TIFF and JPEG format.
The Photographer shall provide low-resolution images to the Client for review purposes within {daysTo} days after the date of shoot.
Client Responsibilities
It shall be the responsibility of the Client to prepare the property such as cleaning, gardening, among others, for photography. Before the service, the Photographer will provide instructions on how to prepare the Property in order for the photographer to achieve the intended results.
In the event that the Property it's not ready at the date of the shoot, the Photographer may refuse to shoot and charge additional expense for travel for rescheduling or proceed with the shoot in its actual state or condition.
Ownership
The Photographer provides to the Client full ownership of the images. The Client may grant to the Photographer rights for the benefit of the portfolio of the Photographer with regard to the taken photos.
In any case, no third party can claim the photo as his or her own without the consent of both parties hereto.
Payment Amount and Terms
The Parties agree that the amount of Сustomer will pay Photographer a total amount of {contractAmount}, subject to change which may constitute an addition or reduction requests by the Client.
A non-refundable downpayment of at least {downpaymentPercentage} shall be made by the Client upon signing of this Agreement.
Any remaining balance to the agreement shall be due on the date of the service, with a period up until {daysDue} days after the service to the Client.
Cancellation
Any cancellation made within 24 hours from the date of the shoot shall be nonrefundable and chargeable to the Client at the full amount of the Contract.
In the event was due to inclement weather or any unforeseen circumstance, the Parties may agree to set the agreement on a different date without additional cost.
Modifications
Any modification in this Agreement must be with the express permission of both parties made in writing and signed by them.
Disputes Resolution
Any dispute or breach arising out of this Agreement shall be resolved by arbitration under the exclusive laws of the state of {governingLaw}, without regard to the conflict of laws of other states.
Separability
The invalidity or unenforceability of any part in this agreement shall not affect in any way the whole or the remainder of the provisions herein. The remaining provisions in this agreement shall continue to be valid and enforceable.
Waiver
Only waivers expressly made by the waiving party in writing and signed by both parties shall be recognized as an actual waiver in compliance to this agreement.
Assignment
This Agreement may not be assigned to any other party without the consent of the other.
Entire Agreement
This Contract constitutes the final and entire agreement made by and between the parties hereto and supersedes all other oral or written prior agreements.
