    Agency staff must not disclose to any person (other than a person authorised by Able Staffing LTD or the Client) any information acquired by them in connection with the work assignments they undertake.

    Computer Access within the Clients Establishment:

    As an Agency Worker you may be give Authorisation by the Client to gain access to certain computer systems and certain programs and data within those systems. You must not attempt alone, or in concert with others, to gain access to data or programs to which authorisation has not been given. In using any Client computer systems, as an agency worker you must:

    • Observe the computer security instructions in respect of the proper use and protection of any password used in connection with such computer systems and if there is a need to use or insert into any computer and floppy disk, CD ROM disk, removable hard drive or any other device for the storage and transfer of data programs;
    • Not load any program onto any computer via disk, typing, electronic data transfer or any other means;
    • Not access any other computer or bulletin board or information service (including, without limitation, the internet) except with the specific prior authority from the Clients representative;
    • Not download any files or connect any piece of computer equipment to any network or other item of computer equipment except with the prior authority of the client’s representative.

    1. We must make every effort to ensure we deliver the very highest levels of service, care and professionalism to both our Clients and Service Users

    2. As a representative of Able Staffing Ltd, every element of your professional and personal conduct must uphold and endorse our exemplary reputation.

    I therefore agree to adhere to the following in their entirety:

    • I agree to arrive at an Able Staffing Ltd assignment appropriately groomed and attired.
    • In the event of being unable to honor an assignment, I agree to inform Able Staffing Ltd at least 24 hours prior to the agreed start of the assignment.
    • Should I be unable to complete an assignment, I will notify Able Staffing Ltd immediately, giving at least 1 full working weeks’ notice.
    • I agree to allow Able Staffing Ltd to send my DBS (PREVIOUSLY KNOWN AS CRB) to where I will be working.
    • I agree to treat Service Users and related persons with the highest level of care and respect and to work at a pace conducive to supporting the challenges and workload of the Clients’ department.
    • I agree that when working as a locum for Able Staffing Ltd but under the control & direction of third party company I am obliged to take all reasonable steps to observe and comply with all prevailing Health & Safety procedures, on the site I am working, so that in the event of an accident I will know who I am to report to.
    • I agree that in the event of an accident or injury to my person while at Able Staffing Ltd assignment that I will advise or cause to advice, my line manager and Able Staffing Ltd, who will then instigate the “Workplace Specific Incident Procedure”.
    • I agree that a copy of any subsequent reports will be forwarded to Able Staffing Ltd.
    • I agree that I will not swap or exchange bookings with other Service Users. Should any alterations be required, Able Staffing Ltd must be informed immediately with all arrangements made through them.
    • I understand that every Client will now be asked to grade my performance on a monthly basis. The areas attracting comment are Appearance, Punctuality, Attitude, Speed, Service Care and Expertise. Outstanding consistent feedback will attract bonuses under our new bonus scheme. Failure to achieve consistent acceptable feedback could result in Able Staffing Ltd ceasing to require my services.
    • I understand that I am under no pressure to accept a booking through Able Staffing Ltd, and will only do so once it has been fully explained to me and I have agreed that the booking made meets my previously agreed requirements.
    • Once agreeing to and verbally accepting a possible booking through Able Staffing Ltd, I hereby agree to honor that booking regardless of any future offers which I may receive from other sources prior to the commencement of an agreed booking with Able Staffing Ltd Recruitment Group Ltd.

    1. DEFINITIONS

    1.1. In this Agreement the following definitions apply: “Agency Worker” means yourself;
    “Assignment” means the period during which the Agency Worker is supplied to provide services to the Client;
    “Client” means the person, firm or corporate body using the services of the Agency Worker;
    “Employment Business” means Able Staffing Limited of 40-44 The Broadway, Wimbledon
    London SW19 1RQ – United Kingdom.
    “Working Week” means an average of 48 hours each week calculated over a 17-week reference period.

    1.2. References to the singular include the plural and references to the masculine include the feminine and vice versa.

    1.3. The headings contained in this Agreement are for convenience only and do not affect their interpretation.

    2. RESTRICTION

    The Working Time Regulations 1998 provide that the Agency Worker shall not work on an Assignment with the Client in excess of the Working Week unless s/he agrees in writing that this limit should not apply.

    2.1. CONSENT

    The Agency Worker hereby agrees that the Working Week limit shall not apply to the Assignment.

    3. WITHDRAWAL OF CONSENT

    The Agency Worker may end this Agreement by giving the Employment Business 3 months’ notice in writing.

    3.1. For the avoidance of doubt, any notice bringing this Agreement to an end shall not be construed as termination by the Agency Worker of an Assignment with a Client.

    3.2. Upon the expiry of the notice period set out in clause 4.1 the Working Week limit shall apply with immediate effect.

    4. THE LAW

    This Agreement is governed by the law of England to the exclusive jurisdiction of the Courts of England.

     Safeguarding Children and Vulnerable Adults

    Everyone working in close proximity to children and vulnerable adults should have an awareness of and practice due diligence in regard to safeguarding children, vulnerable adults and themselves by recognizing and observing a simple code of conduct.

    • All of our clients will have an approved policy for dealing with matters relating to child and vulnerable adult protection. Staff should be aware of its existence and everyone may have access to it through their Operations Manager. We work in conjunction with our Client’s own policies.
    • This code of conduct is issued not only for the protection and proper treatment of children and vulnerable adults, but also to facilitate the protection of our people. It also raises awareness of child protection issues.
    • We are committed to ensuring that an up to date DBS Disclosure is obtained for anyone who works within the company.
    • Staff working in Schools, Care Homes, Hospitals* are exempt in the provision of the Rehabilitation of Offenders Act 1974 (Exceptions) Order 1975. Therefore, any spent convictions, cautions, reprimands or police warnings must be declared prior to and during employment.
    • A copy of the Client’s policy is held on site and all staff should be aware of, understand and have received training in relation to this.
    • We commit to ensuring all relevant staff receive training commensurate to their role with regard to Safer Recruitment, Safeguarding children and vulnerable adults.

    *this is not an exhaustive list and could / will include other locations and places of business

    Behaviour and Responsibilities of Staff

    All staff must observe specific procedures when in contact with children or vulnerable adults. There is always a risk that actions by staff may be misinterpreted even though these may be genuine signs of care and concern. These form an addition to the specific guidelines as stated by the school.

    • Always act with professionalism and maturity
    • At no time should an Agency staff member be alone in the same room as a child or vulnerable adult.
    • On no occasion should you arrange to contact, communicate or meet with a child or vulnerable adult. This includes the use of cards, emails, social networking sites such as Facebook, Snapchat, Text or any other messaging system. I.e. Do not make friends with children on Facebook.
    • Do not ever take pictures or videos of the Client Site/Unit or any children or vulnerable adults without the express written permission of the Client.
    • Don’t give lifts to a child or a vulnerable adult and don’t invite them to your home.
    • Any contact with a child or vulnerable adult outside the normal parameters of the catering department should first be cleared with the Operations Manager and Head Teacher.
    • At no time should an Agency staff member go to a boarding or residents’ corridor alone (except if your contract provides a Housekeeping service).
    • There should be no physical contact with any child or vulnerable adult in any circumstances.
    • Agency staff members should at all times be friendly, positive and respectful and fair and to respond to reasonable requests as helpfully as possible.
    • Agency staff members should be vigilant at all times, asking unknown visitors whether they can assist them and reporting such visitors to the school/home reception.
    • Agency staff members should wear identification at all times when on the Client’s site.
    • Do not allow anyone to tailgate you and close all doors/gates behind you – you don’t know if the person behind you is a safe person to be on school grounds.
    • Agency staff members should immediately refer any poor behaviour, unacceptable attitudes or any related concerns to a designated member of the teaching/care staff (designated person) and the Site Manager/Operations Manager. Under no circumstances should the Agency staff member attempt to investigate an allegation, take unilateral disciplinary action, nor attempt to scold a child or vulnerable adult.
    • Agency staff members should at no time use any intimidating aggressive, suggestive or derogatory remarks, obscene or offensive language and/or behaviour towards or in the presence of children or vulnerable adults.
    • Do not embarrass or humiliate children or vulnerable adults.
    • Treat all vulnerable and adults equally and avoid favouritism. Do not single out one pupil/resident in a group because you know their name. This could upset people who are feeling isolated or unhappy
    • Don’t allow children to involve you in excessive attention seeking that is overtly physical or sexual in nature.
    • Our Agency staff members must not keep confidential to them a disclosure of abuse. This must be referred to the School’s designated person for child protection and safeguarding immediately. At this point the Operations Manager needs to be notified that a report has been made to the school
    • If an allegation has been made, it is very important that this is only discussed with the designated person, Unit Manager, Head Teacher or Operations Manager. Confidentiality needs to be maintained at all times
    • The school should ensure that AGENCY are kept fully informed with regard to any allegations and subsequent investigation of any Agency staff member. AGENCY will at all times work closely with the school and the Clients pending any allegation to an Agency staff member.
    • Do not accept any gifts from pupils/residents.
    • Agency staff members are advised to consider very carefully any situation which could give rise to any allegations whatsoever and to avoid such situations completely.

    Whilst at work, you should not:

    • Have on your person any materials that could be described as pornographic or offensive.
    • Have on your person electronic equipment such as laptops and mobile phones, that contains pictures or text that would lead a reasonable person to question your motivation or intentions.
    • Have on your person any alcohol, drugs or other illicit substances or provide any of the aforementioned products to students or adults.
    • Any other item or material that could be considered inappropriate.
