Throughout this document the person signing this agreement will be referred to as the "Client". The photographer will be referred to as Lyza Maye Photography.
Retainer
Please note that any services provided by Lyza Maye Photography are not valid until the retainer fee is paid, this contract is signed and both are submitted back to Lyza Maye Photography. The Client understands and agrees that the retainer fee of $500.00 is not refundable. The retainer fee is used to secure Lyza Maye Photography's services on the agreed upon date/time listed above in this agreement.
1. Upon signature, Lyza Maye Photography reserves the time and date agreed upon, and will not make other reservations for that time and date. The retainer is non-refundable. The retainer is to be paid at time of client signing this contract. If, for any reason, the client changes the event date and time, the retainer can be transferred to a new event date, if Lyza Maye Photography has the date available, otherwise there is no refund for retainer paid.
2. All final fees must be paid 30 days prior to the wedding date listed above. Payment plans are accepted only if agreed to by Lyza Maye Photography. Payment methods are PayPal, Venmo, cash or check. If your payment needs to be made by check, please write the checks personally to Alyza Yasenchack. Bounced checks will incur an additional $50.00 fee. Any time beyond the agreed upon package time will be compensated as such: $350.00/hour for the extra time and photographs taken.
3. The client will assist and cooperate with Lyza Maye Photography in obtaining the desired photographs, including, but not limited to: specifying persons and/or scenes to be photographed; taking time to pose for photos at Lyza Maye Photography's direction. Lyza Maye Photography will not be held responsible for photos not taken as a result of the client’s failure to provide reasonable assistance or cooperation. Lyza Maye Photography is not responsible for any injuries inflicted upon any participating parties. Client(s) will be responsible for their children and for themselves and release Lyza Maye Photography from any claims against their person or their business.
4. The Client can expect to receive digital photographs from their wedding day in an online image gallery 10-12 weeks after the wedding date. The Client may use the provided printing lab withing the gallery to purchase/order high quality prints. Lyza Maye Photography is not responsible for the resolution of photos printed. If the website provided is not ideally financially, the Photographer will refer The Client to another high quality printing provider. The Client's photos will remain in the online gallery for 6 months after the published date. The Client is responsible to download the photographs within the 6 month time frame. Upon the 6 month expiration date, the images will be archived. If The Client requests Lyza Maye Photography to re-upload the album, there will be an unarchive fee of $150.00. The Client will be authorized to access the unarchived gallery for 30 days after the unarchive fee of $150.00 is paid. Lyza Maye Photography is held harmless in the event that The Client does not download their photos within the allotted time limit.
5. Model Release: The Cleint hereby grants Lyza Maye Photography and it's legal representatives the irrevocable and unrestricted right to use and publish photographs of The Cleint, or in which The Client may be included, for advertising or any other purpose that Lyza Maye Photography sees fit. The Client agrees that Lyza Maye Photography may display and use the photographs taken for advertising, display, website and social media promotion, photo contests, public display, and other other purpose thought proper by Lyza Maye Photography. No compensation will be given to The Client for Lyza Maye Photography's use of the photographs.
If The Client would like to share photographs to websites, social media, blogs, or any other online platform, it is required that The Cleint tags Lyza Maye Photography in the posts. The Client also agrees that there will be no altering of the images produced by Lyza Maye Photography.
If there are guests at The Client's event that do not want to be photographed, or do not want their photos used for advertising, it is The Client's responsbility to inform Lyza Maye Photography of this information.
6. Photography may be limited by guidelines or rules made by the ceremony official, ceremony venue, or reception venue. The Client understands and agrees that Lyza Maye Photography will abide by such guidelines or rules and that they are outside the control of Lyza Maye Photography. Client agrees to hold Lyza Maye Photography harmless for the impact such guidelines or rules may have on finished photos.
7. Editing Requests: All packages include basic photo editing. Lyza Maye Photography reserves the creative right to edit and release only those photos deemed credible as professional quality and within Lyza Maye Photography's artistic standards. Unedited and RAW files will not be available to The Client. Post processing is performed to remove blemishes, smooth skin, and to correct color, exposure and lighting at Lyza Maye Photography’s discretion. Extra editing requests for details in The Client’s control (such as, but not limited to, bra straps, tan lines, unwanted body hair, piercings, unflattering clothing, weight issues, removal of prop, entire background changes, etc.,) are not included.
8. Client agrees that Lyza Maye Photography and any staff she hires will receive a meal at the event. If The Client does not agree to provide a meal, Client agrees that Lyza Maye Photography and staff are able to leave for a 30 minute break to eat.
9. Amendments: This contract shall be recognized as the entirety of the agreement between The Cleint and Lyza Maye Photography. Only changes specifically placed within writing signed by The Client and Lyza Maye Photography will be recognized as amendments to this contract.
I, The Cleint, have read and understood the terms stated above. I here by agree to the terms of this contract/agreement.
