What is a 1099-C form?
Form 1099-C, Cancellation of Debt, reports debt that a lender or creditor has canceled or forgiven. Canceled debt is often taxable income to the borrower, so the form tells both the borrower and the IRS how much was discharged.
Who files Form 1099-C?
Applicable financial entities file it. That includes banks, credit unions, certain federal agencies and other organizations with a significant trade or business of lending money. They generally file when they cancel $600 or more of a debt owed by a person and an identifiable event occurs, such as a bankruptcy discharge, an agreement to settle the debt, or a decision to stop collecting.
I received a 1099-C. Do I have to pay tax on it?
Not always. Canceled debt is generally taxable, but exclusions exist, for example if the debt was discharged in bankruptcy or you were insolvent right before the cancellation. To claim an exclusion, you usually file Form 982 with your return. Talk to a tax professional if you're not sure how the rules apply to you.
When is Form 1099-C due?
The borrower's copy is generally due by January 31 of the year after the debt was canceled. The IRS copy is generally due by the end of February on paper, or March 31 if filed electronically. Check the current instructions for exact dates.
How do I fill out Form 1099-C?
Enter the creditor's name, address and TIN, then the debtor's TIN, name and address, plus an account number if you have one. In box 1, add the date of the identifiable event, and in box 2 the amount of debt discharged. Box 3 shows any interest included in box 2.
Next, describe the debt in box 4, check box 5 if the debtor was personally liable, enter the identifiable event code in box 6, and add the fair market value of any property in box 7.
Can I use the Jotform PDF as the IRS copy?
For the debtor's copy and your records, yes. For paper filing with the IRS, Copy A has to be the official red-ink scannable form, or you can file electronically. Jotform lets you fill out the form and download the PDF for free, but it doesn't send anything to the IRS.
