What is Form 5500?
Form 5500, Annual Return/Report of Employee Benefit Plan, gives the Department of Labor, the IRS, and the Pension Benefit Guaranty Corporation information about an employee benefit plan's finances, investments, and operations. It's a joint form, so a single filing covers the annual reporting requirements of all three agencies.
Who files Form 5500?
The plan administrator or the employer sponsoring a pension or welfare benefit plan covered by ERISA generally files it. Smaller plans may qualify for the shorter Form 5500-SF, and one-participant plans that cover only an owner (and spouse) or partners often file Form 5500-EZ instead.
When is Form 5500 due?
Form 5500 is due by the last day of the seventh month after the plan year ends, which is July 31 for calendar-year plans. You can get an extension of up to two and a half months by filing Form 5558 before the original due date.
Can I file a paper Form 5500?
No. Form 5500 and its schedules must be filed electronically through the Department of Labor's EFAST2 system. The PDF version is for information and preparation, so use your completed PDF as a worksheet, a review copy for your plan's advisors, or part of your plan records.
Which schedules might my plan need?
It depends on the plan's type and size. Common ones include Schedule A for insurance information, Schedule C for service provider information, Schedule H for large plan financial information, Schedule I for small plan financial information, and Schedule R for retirement plan information. Defined benefit plans also file Schedule SB or MB.
How do I fill out Form 5500?
Part I covers basic plan information, such as the plan year and whether this is a first, amended, final, or short plan year return. Part II asks for the plan name and number, the plan sponsor's and administrator's names, addresses, and EINs, participant counts, plan characteristic codes, and the plan's funding and benefit arrangements.
Then check the schedules you're attaching and have the plan administrator (and the employer or plan sponsor, if required) sign.
