What is Form 843 used for?
Form 843, Claim for Refund and Request for Abatement, lets you ask the IRS to refund or reduce certain taxes, interest, penalties, fees, and additions to tax. Common reasons include penalties you believe should be removed for reasonable cause, interest caused by IRS errors or delays, and excess Social Security or Medicare tax withheld by an employer that won't refund it.
When shouldn't I use Form 843?
You generally can't use Form 843 to claim a refund of income tax. For that, you'd file an amended return, such as Form 1040-X. Form 843 also isn't used to request abatement of income, estate, or gift taxes themselves, though it can cover related interest and penalties. The instructions list other exceptions.
Is there a deadline for filing Form 843?
Generally, a refund claim must be filed within 3 years from the date the original return was filed or 2 years from the date the tax was paid, whichever is later. Some claims have different time limits, so check the instructions for your situation.
How do I fill out Form 843?
Enter your name, taxpayer ID, and address, then on line 1 give the tax period and on line 2 the amount to be refunded or abated. Line 3 asks for the type of tax, and line 4 for the type of penalty and the Internal Revenue Code section, if known.
