FAQ
What is Form 8843?
Form 8843, Statement for Exempt Individuals and Individuals With a Medical Condition, explains to the IRS why certain days you spent in the United States shouldn't count toward the substantial presence test. That test decides whether you're treated as a U.S. resident for tax purposes.
Who needs to file Form 8843?
Nonresident aliens who are exempt individuals generally file Form 8843. This includes students on F, J, M, or Q visas, teachers and trainees on J or Q visas, and professional athletes competing in certain charity events. It also applies to people who couldn't leave the U.S. because of a medical condition.
Each person files their own form, including a spouse and children in F-2 or J-2 status.
Do I need to file Form 8843 if I had no income?
Yes. Form 8843 isn't an income tax return, so you generally need to file it even if you had no U.S. income. If you have income and file Form 1040-NR, you attach Form 8843 to that return.
When and where do I file Form 8843?
If you're filing Form 1040-NR, attach Form 8843 and send it by the return's due date. If you're filing Form 8843 on its own, mail it to the IRS address listed in the instructions by the Form 1040-NR due date, which is usually April 15 if you had wages subject to withholding and June 15 otherwise.
Dates can shift when they fall on a weekend or holiday, so check the current instructions.
How do I fill out Form 8843?
Everyone completes Part I with their name, U.S. taxpayer ID if you have one, visa type, passport details, and the number of days you were present in the U.S. for the current and past two years. Then fill in only the part that fits you.
Students complete Part III with their school, program director, and visa history. Teachers and trainees use Part II, professional athletes use Part IV, and those with a medical condition use Part V. Sign and date the form at the bottom.
Is it free to fill out Form 8843 with Jotform?
Yes. Jotform lets you fill out Form 8843 and download the completed PDF for free. Jotform doesn't mail or e-file the form for you, so you'll print, sign, and send it to the IRS yourself.
