What is Form 3520?
Form 3520, Annual Return To Report Transactions With Foreign Trusts and Receipt of Certain Foreign Gifts, is an information return. It tells the IRS about certain transfers to and distributions from foreign trusts, U.S. ownership of foreign trusts, and large gifts or bequests from foreign persons. Filing it doesn't usually mean you owe tax on a gift, but the reporting itself is required.
Who needs to file Form 3520?
You may need to file if you're a U.S. person who created or transferred money or property to a foreign trust, received a distribution from one, or are treated as the owner of a foreign trust. You also file it if you received gifts or bequests from a nonresident alien individual or foreign estate totaling more than $100,000 during the year, or gifts from foreign corporations or partnerships above a lower limit that the IRS adjusts every year.
Executors of certain estates may also need to file. The Form 3520 instructions list the exact situations.
When and where is Form 3520 due?
For individuals, Form 3520 is generally due by the due date of your income tax return, including extensions. It isn't attached to your Form 1040. It's filed separately with the IRS at the address given in the instructions.
What happens if I file Form 3520 late?
The penalties for not filing, filing late, or leaving out information can be steep, often calculated as a percentage of the amount that should have been reported. If you've missed a filing, it's worth reviewing the instructions or talking with a tax professional about your options.
How do I fill out Form 3520?
