What is Form 8919?
Form 8919, Uncollected Social Security and Medicare Tax on Wages, is for workers who were treated as independent contractors but believe they were really employees. It lets you figure and report only the employee's share of Social Security and Medicare tax on those wages, instead of paying self-employment tax on the full amount.
Who can use Form 8919?
You can use Form 8919 if you performed services for a firm as an employee, the firm didn't withhold your share of Social Security and Medicare tax, your pay from that firm wasn't for services as an independent contractor, and one of the reason codes on the form applies to you. If you really were self-employed, use Schedule SE instead.
What are the reason codes on Form 8919?
Code A means you filed Form SS-8 and got a determination letter saying you're an employee. Code C means you received other correspondence from the IRS saying you're an employee. Code G means you filed Form SS-8 and haven't heard back yet. Code H means you received both a W-2 and a 1099 from the firm, and the 1099 amount should have been on the W-2.
How do I fill out Form 8919?
For each firm, enter its name, its federal ID number, the reason code that applies, the date of any IRS determination, whether you got a Form 1099 from the firm, and the wages you received with no Social Security or Medicare tax withheld. Add up the wages and report the total on your Form 1040 as the form directs.
The rest of the form figures the Social Security portion (which is capped at the annual wage base) and the Medicare portion. The total tax is carried to Schedule 2 of your Form 1040.
Where does Form 8919 go when I'm done?
Form 8919 is attached to your individual return, such as Form 1040, 1040-SR, or 1040-NR. It isn't mailed to the IRS on its own. If you haven't filed Form SS-8 yet and want the IRS to decide your worker status, that's a separate form.
