What is Form 8332?
Form 8332 is the IRS form a custodial parent uses to release their claim to a child, which lets the noncustodial parent claim the child as a dependent. That release allows the noncustodial parent to claim the child tax credit, the additional child tax credit, or the credit for other dependents, if they otherwise qualify.
The same form is also used to revoke a release that was signed in an earlier year.
Who files Form 8332, and who signs it?
The custodial parent (usually the parent the child lived with for the greater part of the year) fills out and signs Form 8332. The noncustodial parent then attaches it, or a similar signed statement, to their own tax return for each year they claim the child.
What doesn't Form 8332 transfer to the other parent?
Releasing the claim doesn't hand over every tax benefit. The custodial parent can generally still claim head of household filing status, the earned income credit, and the child and dependent care credit based on the child, if they qualify. Check the IRS instructions for Form 8332 for the full rules.
How do I fill out Form 8332?
Start with the child's name, then the custodial parent's name and Social Security number, and the noncustodial parent's name and Social Security number. In Part I, list the tax year you're releasing the claim for. Use Part II instead if you want to release the claim for future years, either specific years or all future years.
If you're taking back a release you signed before, complete Part III and list the years the revocation applies to. Sign and date the form in the part you completed before giving it to the other parent.
Can I revoke a Form 8332 release later?
Yes. Complete Part III to revoke a prior release and give a copy to the noncustodial parent (or make a reasonable effort to do so). A revocation generally takes effect no earlier than the tax year after the year you provide it, so plan ahead if your arrangement changes.
